RE: Ground -Water Monitoring System Design Options.
Dear Mr. Abernathy:

Per our earlier telephone conversation on 1/23/89, and, as referenced in the
3/31/87 letter from this office, 10 NCAC 10G, Section .0601 allows this agency to
require a facility to provide such G.W. monitoring capability as the Division
determines to be necessary. Your are therefore required to submit the following
by 6/30/89, and, select one of the two options listed on the following page.
I. Map (preferably 8 1/2" X 11") delineating the entire landfill and
adjacent property owned (or leased) by you. This map should also
clearly show the location of the landfill with respect to the entire
property.
2. A specific map of the landfill itself illustrating the
shape/configuration of the landfill per the original permit description.
This map must show the proposed monitoring well locations.
Additionally, each well must be numbered on the map (e.g. MW-1; MW-2
etc...). Note: These wells must also be permanently numbered in a
corresponding fashion in the field.
3. Designate in writing to this office an annual sampling date that you
will use to contract out, and subsequently perform, annual ground -water
monitoring extraction.
4. Submit within 15 days upon well installation, a complete and accurate
well completion report (DHS 3342) for all ground -water monitoring wells
around the landfill. These records will clearly identify the following:
- Well construction specifications pertaining to inner/outer casing
diameter.
- Borehole Depth
- 24-hour water table elevations
- Screen length
- Screen slot size
- Vertical extent of screen (e.g. where the screen is placed in the
aquifer).

- All other data required on well construction forms as specified in
the "N.C. Water Quality Monitoring Guidance Document for Solid
Waste Facilities".
This office in recognizing the current capabilities of the regulated
community (e.g., McDowell County Landfill) may choose one of two options in
designing, and subsequently implementing, an acceptable ground -water monitoring
system.
Option #One
Install one upgradient and three downgradient monitoring wells at
locations which based upon topography, are believed to represent suitable
well locations. The screened interval in this case will be 10' screens placed
12' into the surficial saturated zone.
Option #Two
Compile a boring plan for the site and submit it to this office for
approval, designate well locations, and install the wells (following
approval); and set the screens into the part of the aquifer which denotes
maximum conductivity. The following two paragraphs clearly outline the
details regarding Option #Two.
In order to determine the vertical placement of the screened interval, basic
hydrogeologic data must be obtained prior to screen placement. Specifically,
aquifer thickness, determination of the most conductive unit(s), and flow
direction of the surficial aquifer. These basic hydrogeologic characteristics
must be ascertained in order to justify the vertical placement of the screens.
Proper screen placement is essential to proper well installation, and more
importantly, to proper contaminant detection.
The thickness of the surficial aquifer and the determination of where the most
conductive unit(s) are located will determine where the screens are to be set.
Dependant upon this outcome, well nests rather than singular wells may be
necessary. I highly recommend that a hydrogeologist determine this for you based
upon an initial exploratory boring program. After this baseline data is
available, the well depths can be easily determined, and subsequently, installed
in a second drilling episode.
This office highly recommends that Option #Two be employed whereas this
option adequately addresses all State (and forthcoming EPA Subtitle "D")
regulations. If Option #Two is selected, no retrofitting of the G.W. Monitoring
Program will be required for the existing landfill (excluding a future expansion
of the facility).
Option #One, on the other hand, may invariably be inadequate to accommodate
short-term future monitoring requirements. Therefore, retrofitting of the site to
include additional borings and well installation may be required.

wells, please be advised that the Division of Health Services is responsible for
sanitary landfill monitoring well approval. Reference is made to page nine, item

(1) PLAN AND PERMIT REQUIREMENTS
(a) Construction plans shall be approved and followed.
— (b) Specified monitoring and reporting requirements shall be met.
(2) SPREADING AND COMPACTING REQUIREMENTS
— (a) Solid waste shall be restricted into the smallest area feasible.
(b) Solid waste shall be compacted as densely as practical into cells.
(3) COVER REQUIREMENTS
— (a) Solid waste shall be covered after each day of operation, with a
compacted layer of at least six inches of suitable cover or as
specified by the division.
(b) Areas which will not have additional wastes placed on them for
12 months or more shall be covered with a minimum of one foot
of intermediate cover.
(c) After final termination of disposal operations at the site or a
major partthereof or upon revocation of a permit, the area shall
be covered with at least two feet of suitable compacted earth.
(4) EROSION CONTROL REQUIREMENTS
(a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
— (b) Adequate erosion control measures shall be practiced to pre-
vent excessive on -site erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
_ (a) Surface water shall be diverted from the operational area.
(b) Surface water shall not be impounded over or in waste.
— (c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
— (b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
— (a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
— (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction
and maintained in good condition.
(d) Dust control measures shall be implemented where necessary.

(9) SIGN REQUIREMENTS
— (a) Signs providing information on dumping procedures, the hours
during which the site is open for public use, the permit number
and other pertinent information shall be posted at the site
entrance.
— (b) Signs shall be posted stating that no hazardous or liquid waste
can be received without written permission from the division.
— (c) Traffic signs or markers shall be provided as necessary to pro-
mote an orderly traffic pattern to and from the discharge area
and to maintain efficient operating conditions.
(10) SAFETY REQUIREMENTS
(a) Open burning of solid waste is prohibited.
(b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
— (c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
— (e) Barrels and drums shall not be disposed of unless they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS ?
—(a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
— (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

Subject: Disposal of 1,000 pounds/month of aluminum shot blast dust in the
McDowell County Landfill (Permit #56-01)
Dear Mr. Hussey:
General Statute 130A-294 authorizes the Solid Waste Management Section to
regulate solid waste management in North Carolina. It, therefore, gives authority
to the Section to evaluate wastes that may pose a threat to the environment or to
public health and to subsequently prohibit disposal of these wastes at a sanitary
landfill in accordance with Sections .0103(d) anC (e) of the Solid Waste
Management Rules, 10 N.C.A.C. 10G.
Your recent request for disposal of the subject waste has been critically
reviewed and evaluated by section personnel. It is concluded that the waste is
not suitable for sanitary landfill disposal because of extractable cadmium
exceeding the 0.10 ppm limit allowed for landfill disposal. For this reason, your
request is denied. It is recommended that the waste be disposed in an industrial
waste landfill or a hazardous waste landfill.

PROCEDURE AND CP.ITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services
to determine whether a waste is (1) hazardous as defined by 10 NCAC
10F, and (2) suitable for disposal at a solid waste management
facility.
The types of wastes that will be evaluated by this procedure .are
primarily, but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request
additional information or waive some of the requirements based on the
type of waste if it deems necessary. The Division may also require
some wastes to be treated or altered to render the wastes
environmentally immobile prior to disposal at a sanitary landfill.
Wastes disposed at sanitary landfills must be non -liquid and,in a
form that can be confined, compacted, and covered in accordance with
the "Solid Waste Management Rule". APPROVAL TO DISPOSE OF TiE. WASTE
SHALL DSO BE OBTAINED FROM THE OWNER OR OPERATOR OF THE LANDFILL
PRIOR TO DISPOSAL.
The following information is required for an evaluation.
Incomplete waste determination forms will be returned to the
generator without review. An asterisk(*) denotes information

Re: Installment of Ground -water Monitoring Wells at the McDowell
County Landfill (Permit #56-01)
Dear: Mr. Abernathy,
As referenced in the letters from this office dated March 31,
1987 and September 21, 1987, solid waste facilities are required to
construct ground -water monitoring wells and implement a ground and
surface water monitoring program by June 30, 1989. The ground -water
monitoring system should be constructed and implemented in a manner
consistent with the specifications of the "North Carolina Water
Quality Monitoring Guidance Document for Solid Waste Facilities".
Accompanying your proposal for an amendment to the existing
sanitary landfill permit for vertical expansion, was a map showing
proposed monitoring well locations. In order that you may comply
with the June 30, 1989, deadline for establishing a ground -water
monitoring system, our office is tentatively approving the proposed
well locations with the following conditions:
1. A copy of the map showing well locations should be
resubmitted designating each well with a number (e.g. MW-1; MW-2;
etc...). Note: Upon construction, these wells must also be
permanently marked in the field.
2. Also indicate on the map which wells are "upgradient" and
which are "downgradient".
3. The screened intervals of the wells shall be established in
the most hydraulically conductive zones.
Within 15 days of the completion of well installation, a
complete and accurate Well Completion Record (DHS 3342) should be
submitted to this office for all ground -water monitoring wells.
These records should clearly indicate the following:

writing to this office the name of the contractor you have chosen to
perform your annual ground and surface water monitoring extractions,
and the date on which you plan to perform your annual sampling.

RE: NOTICE OF VIOLATION

Pursuant to NCGS 13OA-22(a) and to NCAC 10G, I conducted an inspection on
June 15, 1989 of the McDowell County Sanitary Landfill, Permit No. 56-01, located
in McDowell County off Highway 226 South near Marion, North Carolina. This
inspection found the McDowell County Sanitary Landfill to be in violation of
certain requirements contained in the North Carolina Solid Waste Management
Rules, codified at 10 NCAC 10G specifically:
1. 10 NCAC IOG .0505(2)(a) requires that solid waste be restricted into the
smallest area feasible. The McDowell County Landfill was operating in
violation of 10 NCAC IOG .0505(2)(a) in that solid waste was not restricted
into the smallest area feasible.
2. 10 NCAC IOG .0505(3)(a) requires that solid waste be covered after each day
of operation with a compacted layer of at least six inches of suitable
cover. The McDowell County Landfill was operating in violation of 10 NCAC
IOG .0505(3)(a) in that all solid waste was not covered after each day of
operation with a compacted layer of at least six inches of suitable cover.
3. 10 NCAC IOG .0505(4)(b) requires that adequate erosion control measures
shall be practiced to prevent excessive on -site erosion. The McDowell
County Landfill was operating in violation of 10 NCAC 10G .0505(4)(b) in
that adequate erosion control measures had not been practiced to prevent
excessive on -site erosion.
4. 10 NCAC 10G .0505(5)(b) requires that surface water shall not be impounded
over or in waste. The McDowell County Landfill was operating in violation
of 10 NCAC IOG .0505(5)(b) in that surface water was impounded over or in
waste.

5. 10 NCAC 10G .0505(5)(c) requires that completed areas shall be adequately
sloped to allow surface water run-off in a controlled manner. The McDowell
County Landfill was operating in violation of 10 NCAC 10G .0505(5)(c) in
that completed areas had not been adequately sloped to allow surface water
run-off in a controlled manner.
6. 10 NCAC 10G .0505(6)(b) requires that temporary seeding be utilized as
necessary to stabilize the site. The McDowell County Landfill was in
violation of 10 NCAC 10G .0505(6)(b) in that temporary seeding was not
utilized as necessary to stabilize the site.
COMPLIANCE SCHEDULE
Based upon the foregoing, the County of McDowell is hereby ordered to take
the following actions by July 28, 1989 to correct all violations as stated in
this Notice of Violation, and otherwise be in compliance with the North Carolina
Solid Waste Management Rules, codified at 10 NCAC 10G:
1. Comply with 10 NCAC lOG .0505(2)_(a) by restricting the solid waste into the
smallest area feasible.

I discussed with Paul the problems that you noted. In particular, the
erosion that has occurred in several areas of the ZandfiLl is already
being repaired.
Paul did state that the excessive rainfall that we have experienced
recently has made it difficult to repair these areas. Also we have
had several pieces of equipment that have been under repair for the
past several weeks. Paul has assured me that within the constraints
posed by the weather he will correct the erosion that has occurred.

division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.

and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

unless the owner/operator approves and the removal is not

and perforated sufficiently to ensure that no liquid or hazard-

WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
(a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by

— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-

Dear Mr. Harris:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids, however, there shall be
sufficient moisture to prevent dust from physical handling.
3. The waste shall be disposed within the 6 inch soil daily
cover at the top of the working area.
4. Additionally, a submittal of the Waste Determination Form
and supportive analytical data, is required on the second
anniversary of this approval.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new regulations were to prohibit
this practice. If the process which generates the waste changes or
if the composition of the waste changes significantly, this approval
is void and re-evaluation of the waste will be required prior to
subsequent disposal.

PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services
to determine whether a waste is (1) hazardous as defined by 10 NCAC
10F, and (2) suitable for disposal at a solid waste management
facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request
additional information or waive some of the requirements based on the
type of waste if it deems necessary. The Division may also require
some wastes to be treated or altered to render the wastes
environmentally immobile prior to disposal at a sanitary landfill.
.Wastes disposed at sanitary landfills must be non -liquid and in a
<.:form that can be confined, compacted, and covered in accordance with
the "Solid Waste Management Rule". APPROVAL TO DISPOSE OF THE WASTE

Upon a recent review of our files, our office found that we do
not have sufficient documentation on the ground -water monitoring
wells at the McDowell County landfill facility. Although our office
recently received a map showing the monitoring well locations, we
still have not received any documentation for the construction of
these wells. Within the next 30 days would you please provide our
office with the following information:
Complete and accurate Well Completion Records (DHS 3342) for
all ground -water monitoring wells. These records should
clearly indicate the following:
1. Well construction specifications pertaining to
inner/outer casing diameter
2. Borehole depth
3. 24-hour water table elevations
4. Screen length
5. Screen slot size
6. Vertical extent of screen (e.g. where the screen is
placed in the aquifer).
7. Which wells are "upgradient" and which wells are
"downgradient".
8. All other data required on well construction forms as
specified in the "N.C. Water rnialir.> Mom,;

In addition, please submit to us a summary of the hydro -
geological data accumulated for the landfill site from the boring
operations. Include boring logs and other pertinent subsurface
information. Also, designate in writing to this office the name of

I want to thank you for appearing before the Board of Commissioners to discuss
the new landfill regulations that are now in effect. The presentation was informative
and served to highlight the seriousness of the landfill problem that McDowell
County will face in the immediate future.
Also, as you know, the Commissioners changed the closing time of the landfill
from 5:00 p.m. to 4:00 p.m. This change should better enable us to meet the
requirement for daily cover.
Thank you again for the time that you took to meet with the Commissioners.

RE: Amendment to Permit No. 56-01, McDowell
County Sanitary Landfill
Dear Mr. Jensen:
The proposed revisions to the construction plans to allow
vertical expansion of the referenced landfill have been approved in
accordance'with G.S. 130A-294.
Since the Solid Waste Section received only two copies of the
revised plans, please ensure that the appropriate county personnel
receive a copy of the approved plans.
In addition, all sedimentation/erosion control activities must
be conducted in accordance with the Sedimentation Control Act (15NCAC
4). The Regional office of the Land Quality Section should be
contacted prior to commencement of land -disturbing activities.
Also, a closure and Post -closure plan will be required at least
90 days prior to final closure. Final cover will be evaluated based
upon performance and upgraded if necessary.
