Please excuse me for not getting to Raleigh as I wrote you last month. My
schedule has been very tight since I've made the decision to leave Butler
Associates, P.A.; however, I do want to clear up some projects before I
actually leave, this being one.
Attached is a sketch showing the summary conclusions reached between
Jim Moore, Julian Foscue, Richard Tennant and myself on the probable
best direction to proceed given the site limitations. Naturally that spring.
and running water is a major consideration. This can be taken care of
by installing two silt basins, both on virgin soil. and a concrete or paved
ditch between them to prevent further erosion. The scope of the existing
site all runs towards this ditch and by making it very permanent it will
not only help during rainy periods but eliminate the leaching into the
existing landfill.
Next,a dyke extending from the cut slope on the south side to the access
road will solve the following problems:
1. Provide a bank to fill against.
2. Direct drainage into the ditch or silt basin.
3. Visually blind the site from the highway.
4. Prevent the amount of blowing refuse that is scattered now over the area.

5. Provide for a desirable downhill operation while still controlling
drainage.
Borrow for cover material would continue to come from the ridge to the north.
Very rough calculations seem to indicate that this proposal could serve the
County for several years, perhaps seven to eleven; if there is sufficient
borrow.
Please look this over, consult Julian since he was on the site as we discussed
this project and advise. If this solution is acceptable, I believe a letter from
you to the County Manager could start the County thinking towards this plan.

We made an official inspection of the McDowell County Land-
fill on July 17, 1980. The site was greatly improved since the
last inspection on April 17, 1980. We truly appreciate the
efforts by you and your staff which have resulted in a sanitary
landfill operation which basically meets the intent of State
Solid Waste Management law. There is, however, one problem which
remains and needs to be corrected. On the two consecutive in-
spections referred to above the violation of "Blowing Material
Controlled" was recorded. This is in violation of the Division
of Health Services Solid Waste Management Rules, Section .0103.
We must require that this violation be corrected immediately by
policing the site for any loose debris and by carrying on a con-
tinuous program of picking up loose solid waste and placing it
in the daily working area to be compacted and covered. We
suggest the utilization of CETA workers or other County employees
in this effort. -
We also noted that the erosion control devices at the site
will soon need maintenance. They need to be cleaned out so as to
allow space for future trapping of siltation.
A question was also raised as to the possibility of a fire
hazard from potentially ignitable waste from Drexel, Inc. and
Pine Valley, Inc. Richard Tennant and I plan to investigate
this situation on July 24, 1980 and we will advise you of our
findings.

this solid waste disposal site and please notify us when we can be

The enclosed operational plan is approved and a permit is issued in
accordance with G.S. 130-166.18 with the following conditions:
1. Filing of the certified copy of the permit with the register of
deeds.
2. Site preparation IN ACCORDANCE WITH PLANS.
3. Implementation of construction notes on Sheet 2 of plans.
4. Cover, grade and seed areas outside of planned area immediately.
It is recommended that technical assistance be offered to the county
to implement these plans, and that a meeting take place immediately, on -site,
between McDowell County, Butler and Associates, and J. W. Moore, Jr.
If this office can be of further assistance, please advise.

with Article 13B of the General Statutes of North Carolina and all rules promul-
gated thereunder. The facility is located on the below described property.
BEGINNING at a point on the northeast side of U.S. Route 226 at southwest
boundary of land conveyed from this grantor to the State of North Carolina
by deed dated August 3, 1953 and recorded in the McDowell County Registry,
of Deeds, Book_125, Page 119; said point of BEGINNING being N 400 33' W,
30 feet. From the centerline of said U.S. Route 226 and the southwest corner
of said North Carolina land; thence by said U.S. Route 226 the following
three calls: N 45°41' W, 287.82 feet; N 36003W, 209.02 feet; N 29051" W,
