inspection that the 'know-how to operate a sanitary landfill is there
and this office requests your assistance in seeing that the operation

Regulations Providing Standards for Solid Waste Disposal-"

prepared for the site prior to the date that the present regulations
became effective. I am also requesting that It. kloore show you a
set of plans that was prepared by TVA� for Hardison County so " that you

This office requests that prior to completion of the present working
area that this office be provided at least a plot and cross sectional
drawing,s showing the present elevation, the com-plated elevation and
ho-v drainage will be managed to Prevent erosion.

Dear Mr. Harmon;
I received your landfill plan for the McDowell County site.
The written report is fine but the drawings, including cross sections and
etc., are entirely inadequate. I plan to be in your area during the month
of August and I will let you know as soon as I am sure of the date so we
might discuss the plan requirement.
Mr. Harmon, I am enclosing a special report made by Mr. J. W. Moore, Jr.,
District Sanitarian, as well as the last two routine inspections of the
McDowell County landfall. Mr. Moore, you, and I inspected your site on
January 20, 1975, and the site was in good condition. The know-how is
available to operate in compliance with the Division of Health Services
"Rules and Regulations Providing Standards for Solid Waste Disposal" but
the know-how is not being used.
After reviewing the records, I have no choice but to inform you that the
site must be brought into full compliance and operated within the intent
of the law or properly closed.
Representatives from this agency have made numerous trips to seek compli-
ance and we will make others if we can be of assistance.
Your cooperation in this matter is sincerely requested and if you know'
of any way we can assist you, please let us know.

I made an inspection of the McDowell County Landfill on
December 1, 1975, and found that problems with surface drainage,
erosion control, and leachate were evident as they have been for
the past two years, as verified by DHS Form 1709 Inspection
Reports.
There is obviously some silt being washed into the stream
below the landfill. However, I was unable to establish that
leachate is also entering the stream, although a small amount may
possibly be doing so.
Steps which would improve this situation have been discussed
with Mr. Jack Harmon, McDowell County Manager, several times and he
has indicated a willingness to carry them out. However, these
steps which include sealing off the finished area with dirt and
seeding this area with grass have not yet been taken. In a
conversation with Mr. Harmon on October 23, 1975, he indicated
that this had not been done because he has possible plans for
bringing another lift over this area.

We have had a complaint from the Water Quality and Land Quality Division of
the Department of Natural & Economic Resources concerning erosion and leach
ate problems at the McDowell County landfill.
In reviewing our records I find that the site has been marked for these two
violations repeatedly over the past two years I requested Mr. Jim Moore,
District Sanitarian, to give me an up-to-date report. This report is en-
closed and it reveals that there continues to be a problem with erosion con-
trol as well as leachate.
Mr. Sidney H. Usry, Head, Solid Waste & Vector Control Branch, and I visited
the site with you on August 22, 1975, and discussed the plan requirement as
well as the two problems listed in Mr. Moore's reports. You assured us on
that visit that both the plan requirement and the daily operation would be
brought into full compliance with the Division of Health Services "Rules and
Regulations Providing Standards for Solid Waste Disposal." As of this date
no operational plan has been received.
The McDowell County solid waste disposal site will.be. inspected on or about
February 1, 1976, and if the site is not in full compliance with the Division
of Health Services "Rules and Regulations Providing Standards for Solid Waste
Disposal," including plan requirements, this office will have no choice but
to request the Attorney General's office review the records.

[dear Mr. Strickland:
In reference to your registered letter of Orcember 3, this is
to inform you that as of December 5, seeding of areas of the McDowell
County Landfill has begun. Vie have six men working on those areas
today.
Apparently there has been some misunderstandinj in the past as
to when seeding should take place. When you and Mr. Usry visited the
site an August 22 you indicated that you could see few, if any problems.
We discussed seeding and we were under the impression that as sol5n as
a dumming area was finished, it was to be seeded. At this point little
or no area of the landfill is finished to the p,)int where additional
waste will not he placed in that area. Being a bit tight with our
taxpayers money, we did not want to seed an area then cover it again
with waste, reseed again and again. However, we are proceedinj as

I do not anticipate any problem meeting the deadlinm indicated
in y..iur letter and invite: you to visit the landfill at anytime. As
I indicated in our telephone conversation a few days ago, we had had
no cf)ntact for the Water Quality and Land Quality Division o tthe
