Our consultant, Richardson Smith Gardner & Associates, Inc. (RSG) has identified through field topographic survey and test pit survey that the existing Phase II area of the landfill has exceeded the approved waste limits as shown in Figure 1. Avery County intends to resolve this issue through one or a combination of the following options: • Additional Property Purchase; o Adjacent Owner Waivers; 6 Waste Relocation; and/or • Engineering Controls (ie. improved cover systems, etc.); The airspace study prepared by RSG further revealed that our permitted facility has no remaining capacity. However, we are currently preparing an updated Site Study Report for expansion of the existing C&D landfill and plan to submit the report to the department for review. We are currently reviewing our options regarding the above discovery and would like to meet with the Division at its earliest convenience to receive your input and discuss a final solution. Insufficient earthen cover material and exposed waste Phase II C&D area. The following corrective actions were taken. Approximately 5000 cubic yards of spoil material was relocated to sufficiently cover the previous operational area of phase II, additionally all unseeded exposed areas of both phase I and phase II were hydro -seeded. Further corrective actions were taken on all AREAS OF CONCERN. 2) In response to the Solid Waste Sections notice of violation compliance order TRANSFER STATION AND WHITE GOODS PERMIT NO: 06-02-T dated 3/03/08. States the following, failing to keep floor drains in receiving bay of transfer station free of debris. The following correction actions were taken. Drains were immediately cleaned of debris and checked to ensure proper drainage. Standard operating procedures were place in affect to include daily cleaning of receiving bay and associated drains to ensure of proper drainage. Project Background The existing Avery County C&D landfill property was originally permitted to contain both a C&D landfill and an LCID landfill. Currently, two (2) phases of the C&D landfill have been constructed. An MSW transfer station is also located on the site (NC Solid Waste Permit No. 06-02T). In the original permit, the C&D landfill was to be constructed over approximately 11.2 acres. The permit also included approximately 29 acres of LCID landfill. To our knowledge, the LCID landfill was never constructed. Proposed Modifications Avery County would like to expand their C&D landfill. The maximum limits of the proposed expansion are shown on Drawing S3 in the Preliminary Facility Plan included in Appendix H of the Revised Site Study. The expansion will add approximately 1.2 million cubic yards of gross volume to the landfill facility. Local Government Approval The Avery County Board of Commissioners have held a preliminary vote to expand the landfill which passed unanimously on September 4, 2007 (a copy of these meeting minutes are included in Appendix G). However, this was a preliminary step by the County and did not meet the local government approval process. This submittal includes a draft Local Government Resolution and Construction/Demolition Landfill and Land Clearing and Inert Debris Permit Application prepared by Municipal Engineering Services Company dated October 1995. 14 N.
