violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such
further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1. Waste was disposed of within the required 200' setback from property lines. The waste and the waste drop off area
must be moved back approximately 50' to meet the setback requirement.
2. Watch for non — C&D waste (tires) in the waste stream.
3. The waste was well compacted and covered as required.
4. The lower closed cell developed erosion channels that need to be repaired.
5. The road into the C&D facility was in good condition.
The landfill will be re -inspected in approximately 30 days; failure to move waste out of the 200' buffer may result in a
Notice of Violation.

Dear Mr. Sullivan,
This letter is written in response to your letter of June 17,
2005, to Mr. Jim Barber of the N.C. Solid Waste Section requesting
"revised operation plans of Phase 1" of the Avery County C&D
Landfill to allow for additional excavation. As we discussed in
our meeting of this past Friday, there is not sufficient
hydrogeologic information presently available to demonstrate a
vertical separation of at least four feet from the seasonal high
ground -water table if additional excavation were to be done.
No revisions to the base grades in the currently approved plan
can be authorized unless additional hydrogeologic characterization
is done to demonstrate compliance with the Solid Waste Management
Rules. Therefore the request to revise the operation plans of
Phase 1 to allow additional excavation must be denied at this time.

AREAS OF CONCERN AND COMMENTS:
1. The newly constructed phase of the landfill has been in operation approximately 2 months. This phase was at least
one-third full.
2. A berm was constructed to delineate the boundary of the phase. The berm had breached at its lowest point; a
sedimentation basin was constructed in front of the berm in this area to effectively prevent sediment from moving
beyond the berm.
3. The facility appeared to have accepted on those wastes that it was permitted to receive.
4. A large amount of waste from new construction had recently been hauled to the facility.
5. The working face was steep and needs to be flattened so that the waste can be properly compacted and cover
applied. Adequate soil cover was applied to the remainder of the waste.
6. The active cell should be kept to as small as practical.
7. Waste screenings were conducted and documented.
8. There was a small area of erosion along the new access road that needs to be addressed to prevent sediment from
washing into the nearby stream.

landfill space should be assessed.
4. The cell should be kept to as small as practical
5. The working face was steep and should be worked in a lesser slope.
6. Demolition from recent flood events was observed.
7. Glass beverage containers were present in the waste.
8. Final cover was in the process of being placed on the cell that was recently closed.
9. Windblown litter should be picked up from around the access roads and closed cells.
