A permit renewal request, submitted to the Solid Waste Section on February 22, 2021, is currently under review by Permitting staff. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: A. 15A NCAC 13B .0203(d) states, "By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit. " Permit No. 342 1 -COMPOST, ATTACHMENT 3, PART I: COMPOST OPERATION, condition 4 states, `A sign must be maintained at the site entrance providing the site information including the permit number, prohibited materials, and emergency contact information. " The City of Winston-Salem is in violation for failure to maintain the required signage at the site entrance. To achieve compliance, the City of Winston-Salem shall immediately post the required signage at the Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section entrance to the facility. B. 15A NCAC 13B .1406(9)(a) states, "Signs providing information on waste that may be received, dumping procedures, the hours during which the site is open for public use, and the permit number shall be posted at the site entrance. " The City of Winston-Salem is in violation for failure to maintain the required signage at the site entrance. To achieve compliance, the City of Winston-Salem shall immediately post the required signage at the entrance to the facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Photos included in this report were taken by Susan Heim on November 15, 2021 during the inspection, unless otherwise indicated. 2. The facility is permitted as a small Type 3 compost operation that may accept manure, straw, animal bedding, vegetative agricultural waste (gin trash, tobacco dust), livestock mortality and inorganic nitrogen sources. Only waste generated in the livestock barn is currently accepted for composting. No waste is received from the public or from other outside sources. 3. Organic waste is generated during events in the livestock barn at the fairgrounds. The animal bedding material and manure are collected and brought to the facility for composting. 4. All compost produced at the facility is used at the facility; none is distributed to the public. 5. The fair was cancelled in 2020 due to the pandemic. As a result, no waste was received at the facility and no composting took place in 2020. Therefore, no tonnage or temperature records were submitted with the facility annual report for FY 2020-2 1. 6. The fair resumed in 2021, and the animal bedding and manure were brought to the facility for composting in October, 2021. 7. Facility records were provided by email following the inspection as requested. Temperature logs listed the daily monitoring of the compost bins from October 11 through October 25, 2021. Records also indicated that the compost thermometer had been calibrated on October 11, 2021. 8. The facility's permit to operate expired on October 18, 2020. A permit renewal request was submitted to the Solid Waste Section on February 22, 2021 and is under review by permitting staff. Facility Inspection: 9. The composting operation is secured by a perimeter chain link fence with locking gate to prevent unauthorized entry. In addition, the composting area is located in a section of the fairgrounds property that houses an equipment storage area and, therefore, is secured by a second perimeter fence with locking gate. 10. The facility's permit to operate requires that a sign is posted at the facility entrance that includes the permit number, prohibited materials and emergency contact phone number. No such signage was observed at the facility entrance gate. Ensure that the required signage is installed at the gate/facility entrance. (See Observed Violations section of this report for additional information) 11. Composting operations take place in a series of 7 concrete bunkers (bins), 6 of which are outfitted with a fan that is used to force air through the waste to speed up the composting process. Bins 1 through 3 were filled with new material from the 2021 fair. Bin 7 appeared to contain finished compost leftover from the 2019 season. In addition, a small pile of finished compost and a larger pile of mulch were observed in the storage area on the Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section south end of the compost bins. 12. In a phone conversation following the inspection, Mr. Smith stated that, during the 2020 season when no composting was taking place, facility staff had replaced the piping that forces the air through the compost in the bunkers. The old piping was observed to be strewn throughout the site, including some that was mixed in with the compost in bin 7. Following the inspection, the old piping had been removed for proper disposal, and Mr. Smith provided photos showing the area to be clean and free from pipe debris. 13. The compost operational area is sloped to direct surface water to a low gravel berm located east of the compost bins. The water filters through the berm then slowly sheet flows onto the grassy bank beyond. The area between the compost bins and the berm is normally kept clear and is maintained as a gravel pad. At the time of this inspection, this gravel area contained several small piles of wood waste. In addition, the low area in front of the berm held stagnant, ponded water, indicating that stormwater was not filtering through the berm and the stormwater device was not functioning as designed in the approved plans. Following the inspection, the wood waste had been removed from the compost area to the storage area, and the area between the gravel berm and the compost bins had been cleared to ensure the unimpeded flow of stormwater at the site.
