STATUS OF PERMIT:
Notified LCID - Permit required by 1/1/2026. Information emailed to Facility. PURPOSE OF SITE VISIT: Follow-up Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: On-going violations from the 8/31/2021 inspection. Corrective action is in progress. OBSERVED VIOLATIONS: No new violations observed.

ADDITIONAL COMMENTS: 01 - Mr. Newbern is currently working to correct the observed violations on the August 31, 2021 inspection report. 02 - The waste outside of the landfill footprint has been placed back inside the estimated Edge of Waste. 03 - Edge of Waste markers will need to be re-installed to define the 3 separate facilities (LCID, YWN &TDDS) on this same tract of land. More work needs to be done to separate the 3 facilities. Need to check ALL Setbacks. 04 - Your signage still needs to meet the requirements as noted in the August 31, 2021 inspection report. 15A NCAC 13B .0566 OPERATIONAL REQUIREMENTS FOR LCIDLFS: (14) A sign shall be posted at the site entrance
showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site. See pdf attached to email with this report.
05 - Your access roads still need to meet the access requirements noted in the August 31, 2021 inspection report.
15A NCAC 13B .0564 SITING CRITERIA FOR LCIDLFS: (7) The site shall establish and maintain an access road around
the waste boundary for access by emergency or fire-fighting vehicles and equipment. See pdf attached to email with this report. Some fire lanes have been established. Once the waste has been covered, Mr. Newbern can construct the required fire lanes. 06 - The Air Curtain Burner (ACB) is currently being used and appears to be operating correctly. 07 - Mr. Newbern is going to be pushing the Land Clearing waste into piles to get ready to construct and cover the LCID per this inspection. 08 - Mr. Newbern’s large dozer is currently being repaired to accomplish these out of compliance issues. 09 - Another large dozer has been brought in and is currently being used during this inspection. 10 - Due to the amount of corrective action that has been done, a Notice of Violation (NOV) will not be issued at this time. 11 - John College and Andrew Hammonds will conduct another follow-up inspection in December 2021 or Early January 2022 to ensure compliance has been met. 12 - If the facility is still out of compliance then, an NOV will be issued. 13 - Please keep John College notified of progress made during the month of November, 2021 by email at the email address below. 14 - Digital pictures were not taken during this inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
