The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Met with Mr. Oaks to discuss a permit modification to re-include Field #1 (which was dropped from the last
permit) and to also include additional acreage at the back of the site. This office has received a submittal for this
permit modification. Rode around the site with Mr. Oaks & discussed current setbacks/field boundaries for
Fields 1 & 2 and also required setbacks for the additional acreage at the back of the site. No septage activity is
occurring at the site at this time.
2. I went around the site and posted orange flags at the angled back corner of Field 2, at the 50’ setback from the
adjacent property line on the back side, at the high slope area on the creek side and also a post at the bottom of
the swale on Field 1. These orange flags need to be replaced with permanent posts. Field 1 (with the
additional acreage at the back of the site) was re-GPS’d for a new site map. If the GPS data indicates that the
required setbacks are not present from the creek then the field boundaries may need to be adjusted.
3. The fescue cropstand is not currently established enough for land application to occur (the fields were replanted
this fall). Also damage from wild hogs is evident – a trap is currently on site. The cropstand will have to be
reinspected in the future and approval given by the Department before land application can occur.
4. The required signs are posted and the access road is adequate. However, Field identification signs (Field 1,
Field 2) need to be posted when the new permit is issued. Adequate field boundary markers will also remain
posted to clearly delineate the two field boundaries & required setbacks – for land application to occur.
5. Mr. Oaks stated that he has obtained the required continuing education hours.
