PURPOSE OF SITE VISIT: Follow-up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective Action in Process. OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES (l) Drainage control and water protection requirements: (4) Leachate shall be contained on-site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - This Life of Site Permit approves the continued operation of the C&DLF Unit phases 1-9 and 3301-COMPOST-2020. The Permit to Operate for the Edgecombe County C&D Landfill was recorded in the Edgecombe County Register of Deeds on April 07, 2010 in Deed Book 1551 Pages 645-669. (DIN 10349). 02 - This facility is permitted to receive permitted waste generated in the following North Carolina counties: Edgecombe, Nash, Halifax, Wilson, Pitt, and Martin. 03 - NOTED FROM THE LAST INSPECTION: The C&DLF has a large working face. Minimal Cover material was stockpiled at the working face. Not sure if equipment and/or staffing issues (or both) is the problem with in- adequate cover material. Facility has a borrow pit to obtain cover material. This issue was discussed with Eric Evans during this inspection. Currently, Equipment has been rented to ensure adequate cover material is available. 04 - Working face must be covered weekly at a minimum or when the working face reaches one half acre or whichever comes first. 05 - From Last Inspection Report: Due to the cover issue above, this has been noted as an Observed Violation; 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES: (f) (1) & (2). Rule was attached to the email for the last inspection report link. 06 - There was a leachate breakout found on the West side, at the edge of the edge of waste during the last inspection. This was repaired to prevent the leachate from leaving the landfill footprint. Repair has failed. FACILITY HAS SUBMITTED A PLAN OF ACTION (11/12/2021) TO ADDRESS THE ACTIONS NEEDED TO BE TAKEN TO CORRECT THE PAST NOTED LEACHATE RELEASE AND COME INTO COMPLIANCE. 07 - There were 2 new leachate releases noted that were outside of the Edge of Waste. A NOTICE OF VIOLATION WILL BE ISSUED. 08 - There will be a Follow-up Inspection performed to ensure compliance has been met at the deadline of 30 days. If compliance has been achieved before the deadline of 30 days, facility can contact John College for an earlier compliance inspection to resolve the prior Observed Violations. 09 - Edge of Waste markers are present for the most part. A few are in need of replacing. 10 - Digital pictures were taken during this inspection and some attached to this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
