Landfill operations began in Phase 1 on this property. Facility Permit 51-03 is a combination of facility permits 51-01 and 51-02. Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020. Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020. Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020. Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057. PURPOSE OF SITE VISIT: Pre -Operation Inspection and Partial Compliance Inspection STATUS OF PAST OBSERVED VIOLATIONS: A. 15A NCAC 13B .1626 (8)(d), "Leachate shall be contained within a lined disposal cell or leachate collection and storage system." CORRECTIVE ACTIONS IN PROGRESS: The Johnston County Landfill is in violation of 15A NCAC 13B .1626 (8)(d) in that leachate was not contained within a lined disposal cell or leachate collection and storage system. Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E'"�m"""°"""' Solid Waste Section On January 21, 2021, Mr. Rick Proctor contacted Amanda Thompson to self -report a leachate release. The release was reported to Mr. Proctor by an operator at the end of the day on Wednesday, January 20, 2021. The release was located at the southern end of Phase 5, adjacent to the gas collection lines. Mr. Proctor stated that pressure on a pipe had blown a cap off the end of the pipe and forced leachate out of the pipe. During this inspection, Mr. Proctor stated that the liner should be repaired this week, pending contact with the contractor. OBSERVED VIOLATIONS: A. 15A NCAC 13B .1626 (8)(d), "Leachate shall be contained within a lined disposal cell or leachate collection and storage system." During this inspection, several leachate seeps were identified at the toe of the slope of Phase 4A. The leachate was flowing down the drainage ditch and pooling next to and draining into the stormwater inlet. The inlet drains into a perimeter ditch adjacent to the road between the closed landfill and C&DLF. The outfall of the stormwater inlet was inspected as well. No leachate was observed beyond the stormwater outfall, located approximately 1,000 feet east of the inlet. The leachate releases must be stopped and repaired immediately. The impacted soils within the drainage ditches will need to be removed and samples taken along the impacted area. The leachate impacted soils must be disposed of in the landfill. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS Phase 6 Pre -Operation Meeting 1. The Phase 6 cell had been constructed with a liner and a rain cover. 2. Erosion rills were identified in the soil along the western edge of Phase 6. During the meeting, it was recommended that the rills be repaired prior to accepting waste in Phase 6. 3. The rain cover will be moved as the progression of the first lift advances to the north. 4. Any stormwater that has pooled on top of the rain cover is pumped into the inlet of the stormwater basin. Any leachate will be collected by the leachate collection system. 5. Permanent edge of liner markers were in place and visible from one to the next. 6. An all-weather access road with a turnaround was located near the southwestern corner of Phase 6. The turnaround will be modified as needed to accommodate the larger vehicles 7. Permitting will review the submittals to determine whether additional information is needed prior to the issuance of the Permit to Operate for Phase 6. Facility Inspection 8. The facility is fenced and is secured by a locking gate when it is not open for operation. 9. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 10. The facility accepts waste Monday through Saturday from 8:00 am until 4:45 pm and closed on Sunday. 11. The permit, and operations plan, and records were not reviewed during this inspection. 12. The yard waste area was not inspected during this inspection. 13. The landfills had no woody vegetation and had been mowed. 14. Permanent edge of waste (EOW) markers were observed around the active portion of the MSWLF and closed CDLF. 15. The perimeter roadways around the active MSWLF and closed CDLF are being properly maintained. Numerous erosion rills were identified on the side slopes of the C&D Area 2. The erosion rills need to be repaired and graded. 17. During this inspection, the water truck was in use and applying water to the access roads to suppress dust. 18. Erosion rills were identified in the side slopes of the sediment basin at the northern end of Phase 6A. Mr. Proctor stated that the sediment would be cleaned out of the sediment basin and the rills repaired and seeded. Phase 4A 19. Phase 4A has almost reached capacity and is not currently in use. 20. Areas of exposed waste were observed on the top of Phase 4A. Mr. Proctor stated that the exposed waste was near the most recent working face of Phase 4A. Mr. Proctor also stated that he would have additional cover placed on Phase 4A to cover the exposed waste. 21. Mr. Proctor stated that he was in the process of removing sediment from Basin 6. Once the sediment was removed from the basin, the sediment was taken to the top of Phase 4A to dry out and to be used as cover. The dry sediment currently located on top of Phase 4A would be spread out to cover the areas of exposed waste. Ensure soils are dry enough to be placed in the landfill. 22. Landfill gases were escaping from an eroded area with exposed waste adjacent to the access road between Phase 4A and the C&D Area 2. The gases could be heard "boiling" prior to escaping the waste. Fuzzy "crystals" were also observed on the waste where the gases were escaping. The area where the gases were escaping, needs to be repaired immediately to prevent further release, exposure and potential fire hazards. 23. Mulch has been applied to the southern side slope for stabilization purposes. Mr. Proctor also stated that the entirety of Phase 4A would be stabilized with mulch after all waste had been covered and erosion rills repaired. Ensure that the mulch has not been applied so thick that vegetative growth is inhibited. 24. Mr. Proctor stated that Phase 4A and C&D Area 2 would be closed in tandem using a synthetic membrane. Phase 5 MSWLF 25. Phase 5 is currently in use, until a Permit to Operate has been issued for Phase 6A. The temporary cap had been peeled back to allow for disposal of waste. 26. The working face is small and compact. 27. Windblown waste was actively being picked up during this inspection. Portable fencing may be positioned nearer the working face as practical to help catch the windblown waste. Please contact me if you have any questions or concerns regarding this inspection report.
