OBSERVED VIOLATIONS: NA
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Purpose of visit was to do a follow up inspection on the Robeson County Landfills and the recent Notices of Violation Corrective Actions. A letter from the Robeson County Solid Waste Department was also received by Mr. Powell morning of this inspection following up on progress made on corrective actions and, after speaking with Mr. Walters and Ms. Locklear-Cummings, requesting additional time to finish addressing onsite corrective actions. Forty-five days from when inspection is sent was agreed upon. 2. NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3) acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes.
3. The MSW contaminated soil was removed from the NLCID and the waste in water had been removed. Pictures
were provided of the repaired area where the MSW soil was removed and copies of cover logs for the NLCID since July 2021. Good job. These violations have been resolved and a resolution letter will be following this inspection report. Although the previous waste was removed, Mr. Walters indicated during inspection, that
very recently, some waste had rolled down hill and into wet area. This waste was being removed during inspection and brought back inside EOW. Reminder for covering NLCIDLF - 15A NCAC 13B .0566 (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.

4. NLCID had good cover during inspection. Although there was additional EOW markers on the NLCIDLF, once approval for expansion is giving by Section permitting, there should be additional markers placed were staff/inspectors/public can tell where the edge of waste is located. They should be visible from one to the next. This will help keep operations inside of that boundary as well as new staff and the public use the facility.

5. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. County staff have requested a Permit for LCID. Permits and approved operations plans must be followed. Contact Information for Robeson County Section Engineer Project Manager Benjamin Jackson – Benjamin.Jackson@ncdenr.gov / 919 -707 – 8234 office. Recommend that County staff follow up on the status of the permit application. 6. Moving forward, the County should consider all options including if necessary, contracting out the operation of this site or possibly modifying the hours of operation until staffing and equipment are sufficient to maintain compliance and doesn’t fall behind again. Once the County receives the permit for expansion into a total of 7 acres’ foot print, EOW markers should be installed to mark the approved area. The County should also be mindful of allowing waste being spread across that larger footprint and not compacted into smaller working face. Per rule waste should be “compacted” and this would also be easier to manage.
