Hendersonville NC 28791 828/697-4506 June 15,2007 Mr. James Patterson, NC Division of Solid Waste 2090 US Highway 70 Swannanoa, NC 28778 Ref: Beneficial Fill Area Henderson County Waste Facility Dear Mr. Patterson, In follow —up to our earlier conversation, enclosed is a copy of a portion of the site map showing the area we are proposing to be used for clean fill material ( concrete, brick, mortar, etc.). The earth removed from this area was previously used as berm and daily cover material. By removing the soil from this area it has left the area's elevation such that it is trapping some storm water. We will have to refill this area to properly manage storm water and use of clean fill material will assist with refilling this area. This area on the site is approximately 300 feet from property line and approximately 1200 feet from adjoining property home. Should you need any additional information please contact my office. Easley, Governor September 25, 2007 NAME: Mr. Gary Corn, Supervisor ADDRESS: Henderson County Solid Waste Department 802 Stoney Mountain Road Hendersonville, North Carolina RE: NOTICE OF VIOLATION Leachate Discharge at Henderson County Transfer Facility County: Henderson Permit # 45-04-T Dear Mr. Corn: Natural Resources William G. Ross Jr., Secretary On the afternoon of September 17, 2007 Mr. Roy Davis of the Surface Water Division and I responded to a complaint from a citizen that something from the Henderson County Transfer Facility had turned the down radiant stream blue. As you related to us, one of the transfer facility employees had in washing down the tipping floor of the facility overflowed the wastewater drain and some wash water entered the stormwater drain. You said that the material that had turned the water blue was probably floor absorbent. Mr. Davis took a sample of the blue water at the stormwater grate and you soaked up the residue with a "pig" blanket. Based on this occurrence, we ask that you submit to us procedures that will be implemented to prevent this type of incident from occurring again. Please submit this information to Troy Harrison and to Deborah Aja at the Asheville Regional Office. Please call if you have any questions. Sincerely, .6 James E.
