Dear Mr. Coffey:
On behalf of Henderson County, CDM has prepared this request for an extension of the
operating permit for their Construction and Demolition (C&D) Landfill located in
Hendersonville, North Carolina. The current Permit to Operate will expire on October 4,
2006.
The Henderson County C&D Landfill is estimated to have approximately 2 years of storage
remaining based on an average annual disposal rate of 15,000 tons per year. The landfill
capacity was estimated using the topographic survey of the landfill, performed in March
2006, and the closure grading plan in conjunction with the anticipated annual disposal rate.
The remaining gross volume of the landfill, which consists of the airspace between the current
grades and the proposed final surface, was estimated to be on the order of 60,500 cubic yards.
Taking into account the volume of the 2400t thick cover system to be placed over the landfill,
the remaining net volume for waste disposal is approximately 51,800 cubic yards. Using a
utilization factor of 1,200 lb/yd3 (0.6 tons/yd3), the available tonnage of waste to be placed in
the C&D Landfill is estimated to be on the order of 31,000 tons, which corresponds to a
remaining storage life of about 2 years at 15,000 tons per year. The topographic survey of the
current waste grades and the proposed closure grades for the C&D Landfill are provided on
Figures 1 and 2, respectively.

Conditions of the Permit to Operate
PART I: GENERAL FACILITY CONDITIONS
l . When this property is sold, leased, conveyed or transferred, the deed or other instrument of transfer shall
contain in the description section in no smaller type than that used in the body of the deed or
instrument, a statement that the property has been used as a sanitary landfill.
2. The approved Facility Plan, in accordance with 15 NCAC 13B .1619, defines the comprehensive
development of the facility including all onsite solid waste management facilities and related facility
infrastructure.
3. The MSWLF unit stopped receiving waste in December of 1997. The landfill permit was amended to
allow the disposal of C&D waste over the closed MSWLF on September 17, 1998 and again on October
27, 1999. The Permit for Closure of the MSWLF and the C&DLF on top of the closed MSWLF was
issued on April 11, 2006. This permit is for the continued operation of the separate C&DLF unit which
has disposal capacity remaining on the permit issued October 4, 2001.
4. This permit is not transferable.

SPECIFIC CONDITIONS
General Conditions
l . The anticipated operating life of this facility is approximately two years, in any event, the permit will
expire on or before July 1, 2008. Renewal and/or modifications to the permit shall be required in
accordance with rules in effect at the time of review.
2. The landfill is permitted to receive construction and demolition debris and land clearing and inert
debris generated within Henderson County. The owner or operator of the landfill facility shall not
knowingly dispose of municipal solid waste that is generated within the boundaries of a unit of
local government that by ordinance:

a. Prohibits generators or collectors of municipal solid waste from disposing of that type or
form of municipal solid waste.
b. Requires generators or collectors of municipal solid waste to recycle that type or form of
municipal solid waste.
3. The C&DLF unit is permitted to receive construction or demolition debris and land clearing and
inert debris as follows:
a. "Construction or demolition debris" as defined in G.S. 130A-290(a)(4) means solid waste
resulting solely from construction, remodeling, repair or demolition operations on pavement,
buildings, or other structures, but does not include inert debris, land -clearing debris or yard
debris.
b. A land clearing and inert debris landfill as defined in Rule .0101(54) means a facility for the
land disposal of land -clearing waste, concrete, brick, concrete block, uncontaminated soil,
gravel and rock, untreated and unpainted wood and yard trash.
C. Land Clearing Waste as defined in Rule .0101(53) means solid waste which is generated
solely from land clearing activities, limited to stumps, trees, limbs, brush, grass, and other
naturally occurring vegetative material.
d. Asphalt in accordance with G.S. § 130A-294(m).
4. The C&DLF unit shall not receive the following waste types:
a. "Yard trash" as defined in G.S. 130A-290(a)(45) shall not be disposed in the landfill area.
However, yard trash along with land -clearing debris may be accepted for processing as mulch
or disposal in a LCID landfill.
b. Municipal solid wastes, hazardous wastes, or liquid wastes are not permitted for acceptance
or disposal in the C&DLF unit.
Operational Conditions
5. Operation of the C&DLF unit shall be in accordance with 15A NCAC 1313, Rule.0505, the
Operations Plan approved in the Permit to Operate issued October 4, 2001, and the following
specific conditions.
6. Waste shall be covered with six inches of suitable cover at least once per week, or when the active
working area reaches one-half acre in size, or more often as necessitated by the nature of the waste,

so as to prevent the site from becoming a visual nuisance and to prevent fire, windblown materials,
vectors, or water infiltration. Areas that have not received additional waste for twelve months or
more, but where final elevations have not been reached, shall be covered with one -foot of soil cover.
7. The facility operator shall have completed an approved operator training course in compliance with
G.S. 130A-309.25.
a. A responsible individual certified in landfill operations shall be on -site at all times during all
operating hours of the facility at all times while open for public use to ensure compliance
with operational requirements.
b. All pertinent landfill -operating personnel shall receive training and supervision necessary to
properly operate the C&DLF unit in accordance with G.S. 130A-309.25 and addressed by
memorandum dated November 29, 2000.
8. The permittee shall actively employ a screening program for the C&DLF unit that detects and
prevents the disposal of MSW, hazardous, liquid or non -permitted wastes. At a minimum, the
program shall include:
a. Random inspections of incoming loads or other comparable procedures.
b. Records of any inspections.
C. Training of personnel to recognize hazardous and liquid wastes.
d. Development of a contingency plan to properly manage any identified hazardous, liquid or
MSW wastes.
e. The plan must address identification, removal, storage, and final disposition of waste.
9. Closure Requirements - The C&DLF unit shall be closed in accordance with the approved plans and
the requirements of the Division of Waste Management at the time of closure. A closure and post -
closure plan must be submitted for approval at least 90 days prior to closure or partial closure of any
landfill unit. The plan must include all steps and measures necessary to close and maintain the
C&DLF unit in accordance with all rules in effect at that time. At a minimum, the plan shall address
the following:
a. Design of a final cover system as required by the solid waste management rules in effect at
the time of closure;

b. Construction and maintenance/operation of the final cover system and erosion control
structures,
C. Surface water, ground water, and explosive gas monitoring.
Monitoring and Reporting Conditions
10. Ground -water monitoring wells and monitoring requirements for the C&DLF Unit shall be in
accordance with the monitoring system approved for the facility and these additional conditions:
a. The permittee shall sample the monitoring wells on a semi-annual basis, or as directed by the
SWS Hydrogeologist.
b. Sampling methods and equipment shall conform to specifications in,
"North Carolina Water Quality Monitoring Guidance Document for Solid Waste Facilities".
Sampling parameters shall conform to those found in, "Sampling and Analysis
Requirements".
C. The permittee shall maintain a record of all monitoring events and analytical data. Reports of
the analytical data for each sampling event shall be submitted to the Division in a timely
manner.
d. A readily accessible unobstructed path shall be maintained so that four-wheel drive vehicles
may access the monitoring wells at all times.
11. The permittee shall maintain a record of all monitoring events and analytical data. Reports of the
analytical data for each water quality monitoring sampling event shall be submitted to the Section in
a timely manner.
12. Explosive gas monitoring shall be performed as needed to ensure compliance with the standards in
Rule .0503 (2)(a).
13. The permittee shall maintain a record of the amount of solid waste received at the facility, compiled
on a monthly basis. Scales shall be used to weigh the amount of waste received.
14. On or before August 1 annually, the permittee shall report the tons of waste received and disposed in
the C&DLF unit to the Solid Waste Section and to all counties from which waste was accepted on
forms prescribed by the Section. The following is information regarding the annual reports:
a. The reporting period shall be for the previous year beginning July 1 and ending June 30.

b. The annual report shall list the amount of waste received and landfilled in tons and be
compiled:
i. On a monthly basis.
ii. By county, city or transfer station of origin.
iii. By specific waste type.
iv. By disposal location within the facility.
V. By diversion to alternative management facilities.
C. A copy of the completed report shall be forwarded to each county manager for each county
from which waste was received at the facility.
d. A copy of the report and documentation that a copy of the report has been forwarded to all
counties from which waste was accepted must be sent to the regional Waste Management
Specialist by the date due on the prescribed annual report form.

Dear Mr. Tweed:
The Solid Waste Section (the Section) has received and reviewed documentation submitted by CDM on
behalf of Henderson County, regarding closure of the subject facility. Based upon the certification
report dated December 2004, the Section has determined that the unlined municipal solid waste landfill
(MSWLF) unit at the subject facility has been closed in accordance with the applicable requirements and
the approved closure plan. This determination may be rescinded should any of the documentation prove
to be inaccurate.
The MSWLF unit at the subject facility is considered closed subject to the post -closure conditions in the
permit. The owner/operator of the landfill unit, Henderson County, is responsible for compliance with
these conditions. Please note, that the 30-year post -closure period is effective starting December 2004,
the closure certification date as stated by the certifying engineer.
Rule .I 627(c)(8) and Condition #5 of this permit requires that, following closure of the MSWLF unit,
the owner or operator record a notation on the deed to the landfill facility property, or some other
instrument that is normally examined during title search, and notify the Division that the notation has
been recorded and a copy has been placed in the operating record. The notation on the deed shall in
perpetuity notify any potential purchaser of the property that:
(a) The land has been used as a landfill facility; and
(b) Its use is restricted under the closure plan approved by the Division.

POST -CLOSURE CONDITIONS
MUNICIPAL SOLID WASTE LANDFILL (MSWLF)
GENERAL CONDITIONS:
(1) The owner or operator shall conduct post -closure care for 30 years following the closure
certification date of December, 2004, in accordance with the Section .1600 rules, except as
provided under Rule .I627(d)(2).
(2) The owner or operator shall maintain the integrity and effectiveness of any cap system, including
making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion,
or other events, and preventing run-on and run-off from eroding or otherwise damaging the cap
system.
(3) The owner or operator shall maintain and operate the leachate collection system in accordance
with the requirements in Rules .1624 and .1626. The Division may allow the owner or operator
to stop managing leachate if the owner or operator demonstrates that leachate no longer poses a
threat to human health and the environment.
(4) The owner or operator shall ensure that the MSWLF units do not violate any applicable
requirements developed under a State Implementation Plan (SIP) approved or promulgated by the
U.S. EPA Administrator pursuant to Section 110 of the Clean Air Act, as amended.
RECORDATION
(5) Rule .1627(c)(8) requires that, following closure of the MSWLF unit, the owner or operator
record a notation on the deed to the landfill facility property, or some other instrument that is
normally examined during title search, and notify the Division that the notation has been
recorded and a copy has been placed in the operating record. The notation on the deed shall in
perpetuity notify any potential purchaser of the property that:
(a) The land has been used as a landfill facility; and
(b) Its use is restricted under the closure plan approved by the Division.

FINANCIAL ASSURANCE:
(6) The owner or operator must provide continuous coverage for post -closure care in accordance
with .1628(e) until released from financial assurance requirements for post -closure care by
demonstrating compliance with Rule .1627(d)(3).
(7) The owner or operator shall annually adjust the post -closure cost estimate for inflation within 60
days prior to the anniversary date of the establishment of the financial instrument(s). For owners
and operators using the local government financial test, the post -closure cost estimate shall be
updated for inflation within 30 days after the close of the local government's fiscal year and
before submission of updated information to the Division. The Division may allow additional
time to submit this updated information.
(a) The owner or operator shall increase the post -closure care cost estimate and the
amount of financial assurance provided under .1628(c)(2), if changes in the post -closure
plan or MSWLF unit conditions increase the maximum costs of post -closure care.
(b) The owner or operator may reduce the post -closure cost estimate and the amount of
financial assurance provided under 1628(c)(2), if the cost estimate exceeds the maximum
costs of post -closure care remaining over the post -closure care period. Prior to any
reduction of the post -closure cost estimate by the owner or operator, a written
justification for the reduction shall be submitted to the Division. No reduction of the post -
closure cost estimate shall be allowed without Division approval. The reduction
justification and the Division approval shall be placed in the MSWLF's operating record.
POST -CLOSURE USES:
(8) Post -closure use of the property shall not disturb the integrity of the cap system, base liner
system, or any other components of the containment system, or the function of the monitoring
systems unless necessary to comply with the requirements in Section .1600. The Division may
approve any other disturbance if the owner or operator demonstrates that disturbance of the cap
system, base liner system, or other component of the containment system, including any removal
of waste, will not increase the potential threat to human health or the environment.
(9) The owner/operator shall submit a description of the planned uses of the property during the
post -closure period. Post -closure uses approved by the Division, are described in the List of
Approved Documents, Attachment 1, Part B.

COMPLETION OF THE POST -CLOSURE CARE PERIOD:
(10) Following completion of the post -closure care period for each MSWLF unit, the owner or
operator shall notify the Division that a certification, signed by a registered professional
engineer, verifying that post -closure care has been completed in accordance with the post -
closure plan, has been placed in the operating record.
ONGOING SOLID WASTE MANAGEMENT ACTIVITIES:
(11) Continuing solid waste management activities within the MSWLF facility shall be conducted in
accordance with all pertinent requirements and permit conditions and shall not violate any post -
closure conditions. Any new solid waste activities must be approved by the Solid Waste Section
and included as part of the comprehensive.Facility Plan.
METHANE GAS REMEDIATION CONDITIONS:
(12) The owner or operator shall maintain and operate the gas monitoring system to ensure that:
(a) The concentration of methane gas generated by the facility does
not exceed 25 percent of the lower explosive limit for methane in facility structures
(excluding gas control or recovery system components); and
(b) The concentration of methane gas does not exceed the lower explosive limit for
methane at the facility property boundary.
(13) If methane gas levels exceeding these limits are detected, the owner or operator must
take all steps required in Rule .1626(4)(c). Methane gas remediation-plans approved by the
Division are described in the List of Approved Documents, Attachment 1, Part C.
GROUND WATER MONITORING AND CORRECTIVE ACTION CONDITIONS:
(14) In accordance with .1630(c), once established at a MSWLF unit, ground -water monitoring shall
be conducted throughout the post -closure care period for the MSWLF unit in accordance with the
requirements of Rules .1631 through .1637. Monitoring of the surface water shall be in
accordance with the requirements of Rule .0602.
(15) Detection monitoring is required at MSWLF units at all ground -water monitoring wells that are
part of the detection monitoring system as established in the approved monitoring plan. At a
minimum, the detection monitoring program shall include monitoring for the constituents listed
in Appendix I of 40 CFR Part 258.
(16) The monitoring frequency for all Appendix I detection monitoring constituents shall be at least
semiannual during the post -closure period. At least one sample from each well (background and
down gradient) shall be collected and analyzed during semiannual sampling events.

(17) If the owner or operator determines that there is a statistically significant increase over
background for one or more of the constituents listed in Appendix I or whenever a violation of
the North Carolina ground -water quality standards (15A NCAC 2L, .0202) has occurred at any
monitoring well, the owner or operator:
(a) Shall within 14 days of this finding, report to the Division and place a notice in the
operating record indicating which constituents have shown statistically significant
changes from background levels.
(b) Shall within 90 days of this finding, establish an assessment monitoring program in
accordance with Rule .1634 except as provided for in Rule .1633(c)(3).
(c) Shall within 90 days of finding that any of the constituents listed in Appendix II have
been detected at a statistically significant level exceeding the ground -water protection
standards, initiate an assessment of corrective action measures in accordance with Rule
.1635.
(d) Shall select based on the results of the corrective measures assessment, a remedy that,
at a minimum, meets the standards listed in Rule. 163 6(b). Within 14 days of selecting a
remedy, the permittee shall submit an application to modify the permit describing the
selected remedy to the Division for evaluation and approval. The application shall be
subject to the processing requirements set forth in Rule .1604 (c) of this Section. The
application shall include the demonstrations necessary to comply with the financial
assurance requirements set forth in Paragraph (d) of Rule .1628. Ground water corrective
action plans approved by the Division are described in the List of Approved Documents,
Attachment 1, Part D.
(e) Shall, based on the approved schedule for initiation and completion of remedial
activities, establish and implement a corrective action ground -water monitoring program,
implement the approved corrective action remedy; and take any interim measures
necessary to ensure the protection of human health and the environment in accordance
with Rule .1637.
(18) The ground -water monitoring program shall include consistent sampling and analysis procedures
in accordance with Rule .1632 that are designed to ensure monitoring results that provide an
accurate representation of ground -water quality at the background and down gradient wells.

AREAS OF CONCERN AND COMMENTS:
1. This facility may receive construction and demolition waste that is generated within Henderson County.
2. The average daily tonnage currently handled at the facility is 50 tons per day based on 312 operating days per year.
3. Small areas of erosion need to be addressed along access road to landfill. The surface of the access road appeared
to be maintained.
4. Waste was placed in a lift was approximately 3 feet high within the active cell. The active cell was approximately
three-quarters full.
5. A soil berm was constructed to delineate the perimeter of and contain the cell.
6. The waste was well compacted.
7. The landfill appeared to accept only those wastes that it was permitted to receive.
8. Waste must be covered weekly with a minimum of six inches of soil.
9. The recently issued permit was posted in the landfill office.
10. Waste screenings were performed and documented as required. Unacceptable waste including bagged municipal
solid waste, furniture, tires, and yard trash were identified during the screenings and removed for proper disposal.
Three loads were sent back to the transfer facility. Thirteen screenings were performed between 9/21/06 and
12/6/06.

4. The closed cell in the previous lift was compacted and shaped: Soil cover was being placed on the closed cell.
5. Grass was established on the sideslopes of the completed lift.
6. The landfill appeared to accept only those wastes which it was permitted to receive.
7. Small areas of erosion need to be addressed along access road to landfill. The surface of the access road appeared
to be maintained.
8. The newly issued permit was posted in the landfill office.
9. Waste screenings were performed as required.
10. The overall operation of the landfill was good.
