Reference is made to your June 7, letter transmitting your
technical review of the Transition Plan for the Henderson County
Stoney Mountain Road Landfill. The following is in response to
your review comments and questions in order of your review:
LANDFILL GAS COLLECTION SYSTEM
As you are aware the landfill gas collection system is being
developed and installed by Enerdyne. This system is not being
designed by our firm. Enclosed is a copy of the extraction well
layout and proposed collection piping and flare station location.
To date wells have been installed and Enerdyne is in process of
installing collection system. We have requested Enerdyne to
prepare the requested design information and provide this to your
office.
Enerdyne is planning to collect the landfill gas and pipe the
gas to an end user as an alternative fuel. Final agreements are
now being developed for this alternative energy system. In order
to pipe the gas off site it will require an easement from the N.C.
Department of Correction to cross their property adjacent to the
landfill. The easement has been verbally approved by the DOC and
we are awaiting final easement documents being prepared by the DOC.
The proposed pipeline will follow the State road system and
encroachments for use of the right of way have been obtained.
As a part of the encroachment agreement with the DOC,
Henderson County will be acquiring an existing sanitary sewer lift
station on the DOC property which is connected to the
Hendersonville wastewater collection system. It is planned to
utilize this lift station for condensate disposal from the planned

landfill gas collection system. All of the aspects of the landfill
gas collection system have been developing over the past couple of
years. Additional information will be transmitted to your office
as the landfill gas collection system program continues to develop.
LANDFILL CLOSURE
We are aware that our proposed closure plan is an alternative
to the RMC. It is still our belief that the existing side slopes
of the landfill have sufficient cover and due to the steep slope
may be equivalent or better than the RMC. We are discussing with
Camp Dresser & McKee in obtaining their services to assist in
making a demonstration on an alternative cap at the Henderson
County Landfill. In addition CDM will be addressing transfer
station and C & D area issues. The Henderson County Board of
Commissioners have recently approved a proposal from CDM to begin
a scope study of these issues. It may take several months to go
through the cap demonstration study and make a submittal to your
office. We feel that the RMC has been developed to address caps
of less than 5% slope and that steeper side slope areas have not
been adequately studied.
We have met with Mr. Jim Patterson and Mr. Matthew Gantt with
your Division concerning the various issues at the Henderson County
Landfill. There assistance has been appreciated and we will try to
keep them informed as to future developments. We hope this
additional information is helpful in your continued review of the
Henderson County Transition Plan. It may be helpful if a meeting
is held to discuss these various issues. Should you like to meet

Dear Mr. Owen,
The Henderson County Landfill is currently in assessment monitoring. Monitoring well data
from previous sampling episodes indicates numerous Appendix I constituents are present in
groundwater at the facility.
Henderson County had the monitoring wells sampled for the Appendix II list of chemicals on
October 30, 1995. The pesticide alpha-BHC was detected. Consequently, background
concentration for it must be established (Rule .1634). This will require sampling each
monitoring well (background and downgradient) three additional times for alpha-BHC since
background levels must be determined with four independent samples. If you have not already
done so, please begin this process as soon as possible. The initial Appendix II sampling can
count as the first of the four samplings. The April 8, 1996 monitoring event was for the
Appendix I list only and did not include an analysis for alpha-BHC.
In order for Henderson County to be in compliance with Solid Waste Management Rules 15A
NCAC 13B, water quality monitoring requirements (Rules .1633 through .1637) should be
followed. This includes the requirements for analyses of samples, statistical analyses of
monitoring data, and measurements of groundwater flow rate and direction that must be
determined each time the wells are sampled.

Dear Mr. Thompson:
The Division of Waste Management has completed its review of the Transition Plan for the
referenced landfill submitted by the consultant, William G. Lapsley & Associates, on behalf of
the owner and operator, Henderson County.
Rule .1603(a)(4)(A) of the Solid Waste Management Rules codified at 15A NCAC 13B requires
the owner and operator of an existing MSWLF unit to submit a Transition Plan application for
continuing operation and closure of the existing MSWLF unit by April 9, 1994. Rule .1617(d)
requires that the plan contain: an Operation Plan in accordance with Rule .1625, a Closure and
Post -Closure Plan in accordance with Rule .1629, a Water Quality Plan in accordance with
.1623(b)(3), and a report that contains a schedule for closure of the existing MSWLF unit and, if
necessary, submittal of an application for a new facility, a lateral expansion or permit renewal.
Rule .1603(d)(2) requires the Division to establish a review schedule for the Transition Plan
applications which determines the adequacy of all the plans by October 9, 1996. The rule allows
the Division to issue full or partial approvals and to determine the schedule for closure of the
existing MSWLF unit based on its review of the complete Transition Plan application.
In accordance with Rule .1603(d)(2), the Division has completed its review of the submitted
application as amended through September 24, 1996, and hereby issues full approval of the
Transition Plan for the referenced landfill contingent upon receipt of an Alternative Final Cover
Demonstration by this office within 180 days of the date of this letter.
The approved Transition Plan shall be effective through December 1997, or until the permitted
contours are reached. Rule .1625(b)(3)(C) requires that operation drawings illustrate annual
phases of development which are consistent with the minimum and maximum closure slope
requirements. In accordance with this rule and Rule . 1627(c) (10)( 4), the existing unlined
MSWLF unit shall be operated in such a manne�.o to cease receiving solid waste on or before

Landfill for the month of May. We have resumed testing the wells on the Trace property

Nippy, I have enclosed the monitoring reports for the month of May. As we discussed over the phone,
we included testing this month of monitor wells on the former Trace property. On both occasions test

Dear Mr. Eades:
Reference is made to our telephone conversation on October 17,
1996 concerning the Henderson County Stoney Mountain Road Sanitary
Landfill. This letter and attached documents have been prepared to
bring your office up to date on the developments at the Henderson
County Stoney Mountain Road Landfill with respect to the landfill
gas collection system being constructed by Enerdyne Power Systems,
Inc., the proposed transfer station, proposed C & D landfill, and
the cap equivalency study. The status of each of these items is as
follows:
TRANSFER STATION
Henderson County is in the process of negotiating a contract
with Camp Dresser & McKee (CDM) for the design of the transfer
station. It is planned to have CDM design and obtain the required
permit from your office. Our firm will take the design, bid the
project, and provide project administration for the construction.
The time frame for this project is to have designs completed and
permitted by next Spring with construction completed by next Fall
prior to the closure of the landfill.
C & C LANDFILL
It is planned to have CDM assist our office with the design
and permitting of a C & D Landfill to be located within the
existing borrow area at the current site. This area has been
reviewed by Mr. Jim Patterson and Mr. Matthew Gantt with your
Division in which they felt this area would be acceptable for a C
& D Landfill. It is planned to have CDM begin this project
concurrent with the designs of the transfer station.

CAP EQUIVALENCY STUDY
As we have discussed it has been our intention to provide only
the RMC on the final top of the landfill leaving the steep side
slopes to be covered with existing on site material. During the
construction of the landfill gas collection system the cover
material was shown to be 3 to over 6 feet deep in most all areas.
In the drilling of gas collection wells all solid waste being
encountered was dry and no water was found. It is planned to have
CDM review the existing cover material and prepare a cap
equivalency study to demonstrate the adequacy of the existing cap
and to make recommendations for an alternative cap and closure
plan. It is intended to conduct this study this winter and to
submit a closure plan with cap equivalency study by next spring.
This should give your office sufficient time to review the closure
plan prior to closure construction which would begin in early 1998.
LANDFILL GAS COLLECTION SYSTEM
As you are aware the landfill gas collection system at this
landfill has been in the development for several years. A few
years ago your Division issued a noncompliance order to the County
for the off site migration of landfill gas along the property line
at the top of the landfill. The County began the process of
evaluating the situation, first with Cargan Resources whom
developed a plan during 1993 for the remediation of the site. Due
to Cargan Resources inability to obtain financing, their project
did not materialize. The County proceeded with bidding a project
during the winter of 1994 for the remediation of the landfill gas.
During this time all plans were reviewed with Mr. Jim Patterson and
the Air Quality Section at the Asheville Regional Office. We were
instructed to begin with the project and that there were no permits
required. During the bidding of the project, Enerdyne Power
Systems, Inc. made a proposal to the County to provide an immediate
remediation of the off site migration and to develop a plan for the.
collection of landfill gas from the landfill. In exchange the
County would allow Enerdyne the gas rights to the landfill. The
County entered into a contract with Enerdyne which during 1995
installed several gas collection wells along the upper property
line and a portable vacuum pump flare station to remediate this
area.' This system was successful in remediating the off site
migration and is still in operation.
During 1995 Enerdyne began the design of the landfill gas
collection system and contracted with our firm for the design of an
off site methane gas transmission line. At this time your Division
had not developed any permitting procedures for these type
projects. The transmission pipeline designs were completed and the
various encroachments obtained from the N.C. D.O.T. and
Norfolk/Southern Railway. We have received verbal approval from

the N.C. Department of Correction to cross there property and are
awaiting a final easement document. During early 1996 Enerdyne
began installing the landfill gas collection wells at the landfill.
Just recently Enerdyne completed the installation of the collection
system within the landfill connecting the previously install gas
collection wells.
During 1996 Henderson County negotiated the purchase of the
property at the top of the landfill where the landfill gas
migration had occurred. The County now owns this property and has
extended its buffer in this area by over 300 feet. An additional
9.4 acres was obtained in this area. Even though the County
purchased the property they have continued the operation of the
flare system at the top of the landfill.
It should be noted that the development of the overall site
landfill gas collection system has not been done with respect to
the control of landfill gas, but for the purposes by Enerdyne to
provide an alternative energy source. It has been totally
Enerdyne's responsibility for the design and construction of this
system. With respect to your Divisions recent policy on the
permitting of the landfill gas collection system, the County would
look to Enerdyne to meet your requirements. Therefore the
following information is being provided:
1- Landfill gas collection plan showing layout of landfill
gas collection wells, the collection piping system, and
the location of vacuum station/flare. Also shown is the
existing vacuum station/flare station at the top of the
landfill. Detail sheets are provided showing the typical
landfill gas collection well, pipeline, knockouts, etc.
2- Plans for the off site methane gas pipeline.
3- Plans for the construction of on site sanitary sewer
system for service to the transfer station. This system
will also be utilized for the disposal of condensate for
the methane gas collection system.
4- A preliminary concept plan for the transfer station.
5- A narrative report addressing those items outlined in the
August 7, 1996 Division policy for permitting.

We hope this information is sufficient to bring your office up
to date on activities at the Henderson County Stoney Mountain Road

Enerdyne Power Systems, Inc. has contracted with Henderson
County for the development of a landfill gas collection system at
the Stoney Mountain Road Landfill. This project has been in
development for several years and is currently under construction.
This engineering report has been requested by the N.C. Division of
Solid Waste to address the recently permitting policy of August 7,
1996 for landfill gas collection systems.
Henderson County has assigned the gas rights to the Stoney
Mountain Road Landfill to N.0 Municipal Landfill Gas, LLC, an
affiliate of Enerdyne Power Systems, Inc. The planned LFG
collection system is being developed by Enerdyne Power Systems,
Inc., not Henderson County, and Enerdyne Power Systems, Inc. has
sole responsibility for the design, construction, and operation of
the system.
The following report is a discussion of the various
information items requested by the Division of Solid Waste.
CONCEPT PLAN
A site plan has been developed showing the existing landfill
gas collection system including the gas wells, blowers, flares, and
related facility. Details of the various components are also
included.
PLAN FOR DISPOSAL OF THE GAS CONDENSATE
Condensate from the collection system will fall by gravity to
the low point of the system and be removed through two condensate
knock outs. From this location the condensate will be pumped into
a proposed sanitary sewer force main which is to be constructed to
provide sanitary sewer service for the proposed landfill transfer
station. A plan for the sanitary sewer system has been inclosed.
This sanitary sewer system is to be owned and operated by Henderson
Countv. The sanitary sewer system discharges to the City of
Hendersonville wastewater collection system.
EMERGENCY RESPONSE PLAN
The landfill gas collection system is constructed to collect
mostly gas and not the surrounding atmosphere. The system control
panel is equipped with methane sensors which will shut down the
system when methane drops below a set limit, normally 30 to 50
percent. Wells are monitored for oxygen levels, and are monitored
for leaks. Should leaks be detected, repairs are immediately made.
In the event of a landfill fire, the following emergency response
plan will be followed:
1- Voice communication to alert individuals in the area and to
identify the location of the emergency. Site telephones, cellular
phones, and two way radios will be used to notify the County staff
and local fire departments.
2- The operator will take steps, including system shutdown, to
reduce the available oxygen in the landfill.
3- The fire is to be extinguish using soil and chemical
extinguishers first if the fire is limited. Water is to utilized
as last recourse.
Enerdyne Power Systems, Inc. will instruct Henderson County
Landfill Staff of the procedures to follow during Enerdyne Power
Systems, Inc. absence. The blower station/flare access will be
limited.
COORDINATION OF LANDFILL GAS SYSTEM WITH ONGOING OPERATION
The Henderson County active landfill is confined to a small
area at the top of the landfill. The installation of the landfill
gas collection system has been conducted with little interference
to landfill operations. There are only a few gas wells within the
active working area of the landfill. These wells are being
extended vertically as the landfill rises.
MAIN'iENANCE OF THE COLLECTION SYSTEMS
Maintenance of the collection system is the responsibility of
Enerdyne Power Systems, Inc. The following plan for monitoring and
maintenance will be followed:
Following installation, the LFG gas collection system will be
subjected to an initial testing/ monitoring program. Once steady
state conditions are achieved after start up, the following routine
monitoring activities will be performed:
1- The LFG collection system will be visually inspected to
check for damage, leaks, etc. on a weekly basis, or more
frequently if required.
2- LFG quality, pressure, temperature, and flow measurements
will be taken at individual wellfield features on a
monthly basis, or more frequently if required. Equipment
will be kept calibrated per manufacturers specifications.
3- The LFG extraction rates from the individual wells will
be adjusted based on monitoring results to address issues
such as surging vacuum, decreased methane content,
increased oxygen content, and high or low flows.
4- On a weekly basis, the condensate management system will
be inspected to verify proper operation.
5- The LFG blower/flare station will be inspected daily to
verify proper operation. Operating conditions will be
recorded and kept on file.
6- Mechanical and electrical components of the condensate
management system and blower/flare station will be
maintained and serviced in accordance with the
manufactures recommendations. Operations manuals will be
maintained on file.
7- Non -routine maintenance requirements, such as equipment
replacement will be preformed as required.
LFG collection system monitoring and maintenance will be
performed by an operator assigned to the site on a part-time basis.
The operator will be on -call 24 hours a day to respond to non -
routine O&M requirements. The operator will be notified via an
auto dialer connect to the system control panel of system shut down
or improper operating conditions.
CLOSURE PLAN MODIFICATION
The majority of the landfill gas collection system is outside
the area which will be reworked at closure. The LFG system header
is around the outer perimeter of the landfill. There are a few LFG
wells in the planned closure area which will need to be raised or
eliminated at closure. Henderson County is in the process of
conducting a cap equivalency study and alternative closure plan.
Those areas of the LFG collection system falling within the
alternative closure plan will be addressed with the final closure
plan. Based on the information available at this time there
appears to be only 11 LFG wells that may require modification at
closure. The modification would require vertical extension of the
well head and collection piping.
LFG WELL DECOMMISSION
Should it be necessary to decommission a well during the
active life of the LFG system, the well head and piping will be
removed and the well casing backfilled with suitable material. The
landfill cap will be replaced to original conditions. Should the
LFG system be shut down and not to be restarted, all LFG wells will
be converted to passive gas vents.
AIR QUALITY PERMITS
Fnerdyne Power Systems, Inc. is applying for the required air
quality permits. During the original developments of this system
the Air Quality Section at the Asheville Regional Office had
advised that Air Quality Permits were not required. Enerdyne will
forward the Air Quality Permit to the Division of Solid Waste upon
receipt.
FINANCIAL ASSURANCE
Since Henderson County has assigned the gas rights to N.C.
Municipal Landfill Gas, LLC and contracted with Enerdyne Power
Systems, Inc. to provide the landfill gas collection system, the
County has no financial responsibility in the LFG System. Closure
costs still include sufficient funds to allow for any conversion of
wells if needed. Therefore, revision to the financial assurance
plan is not necessary. In any event the County's costs will be
less and the County has been able to post financial assurance
through the financial test procedures.

Transition Plan

Dear Mr. Eades:
Reference is made to your June 7, letter transmitting your
technical review of the Transition Plan for the Henderson County
Stoney Mountain Road Landfill. The following is in response to
your review comments and questions in order of your review:
LANDFILL GAS COLLECTION SYSTEM
As you are aware the landfill gas collection system is being
developed and installed by Enerdyne. This system is not being
designed by our firm. Enclosed is a copy of the extraction well
layout and proposed collection piping and flare station location.
To date wells have been installed and Enerdyne is in process of
installing collection system. We have requested Enerdyne to
prepare the requested design information and provide this to your
office.
Enerdyne is planning to collect the landfill gas and pipe the
gas to an end user as an alternative fuel. Final agreements are
now being developed for this alternative energy system. In order
to pipe the gas off site it will require an easement from the N.C.
Department of Correction to cross their property adjacent to the
landfill. The easement has been verbally approved by the DOC and
we are awaiting final easement documents being prepared by the DOC.
The proposed pipeline will follow the State road system and
encroachments for use of the right of way have been obtained.
As a part of the encroachment agreement with the DOC,
Henderson County will be acquiring an existing sanitary sewer lift
station on the DOC property which is connected to the
Hendersonville wastewater collection system. It is planned to
utilize this lift station for condensate disposal from the planned

landfill gas collection system. All of the aspects of the landfill
gas collection system have been developing over the past couple of
years. Additional information will be transmitted to your office
as the landfill gas collection system program continues to develop.
LANDFILL CLOSURE
We are aware that our proposed closure plan is an alternative
to the RMC. It is still our belief that the existing side slopes
Cif file landfill have sufficient cover and due to the steep slope
may be equivalent or better than the RMC. We are discussing with
Camp Dresser & McKee in obtaining their services to assist in
making a demonstration on an alternative cap at the Henderson
County Landfill. In addition CDM will be addressing transfer
station and C & D area issues. The Henderson County Board of
Commissioners have recently approved a proposal from CDM to begin
a scope study of these issues. It may take several months to go
through the cap demonstration study and make a submittal to your
office. We feel that the RMC has been developed to address caps
of less than 5% slope and that steeper side slope areas have not
been adequately studied.
We have met with Mr. Jim Patterson and Mr. Matthew Gantt with
your Division concerning the various issues at the Henderson County
Landfill. There assistance has been appreciated and we will try to
keep them informed as to future developments. We hope this
additional information is helpful in your continued review of the
Henderson County Transition Plan. It may be helpful if a meeting

The NC Division of Solid Waste Management, Solid Waste Section (Section) has completed its
review of the revisions to the above referenced Transition Plan application. At this time, all
requirements of the engineering portion of the transition plan have been satisfied with the
exception of the following two issues.- - --
Landfill Gas Collection ;,stem
The Section requests that additional information with respect to the gas collection system
installed by Enerdyne be submitted including such details as exact locations of extraction wells
and piping, well construction details, locations of the supporting infastructure and the procedure
for removal and disposal of the gas condensate.
Landfill Closure
The closure cap system as specified does not meet the requirements for the minimum regulatory
cap (RMC) specified by rule .1627(c)(1)(A). Alternatives to the RMC are possible under rule
.1627(c)(2). In order to close with an alternative, the owner must demonstrate that the proposed
cap system will achieve an equal or greater reduction in inflitration as opposed to the RMC.
Therefore, a technical demonstration is required prior to the Section being able to make a
determination on the proposed closure plan. The demonstration must include site specific inputs
such as soil characteristics, types, depths and permeability. Section technical staff are available to
provide guidance on making such a demonstration.
With respect to the proposed RMC on the crest of the landfill. Is six inches of topsoil/protective
cover sufficient to protect the compacted clay barrier layer from frost, dessication, freeze/thaw,
and to a provide sufficient root zone to maintain a healthy stand of vegetation? Please adjust
accordingly.
