Subject: Disposal of Approximately One Ton/Week of Lime Stabilized
Wastewater Treatment Sludge at the Henderson County
Landfill, (Permit #45-01).
Dear Mr. Bush:
This acknowledges receipt of the TCLP data obtained by PACE
Laboratory on the re -sample of your wastewater treatment sludge. As
you know, this second analysis was made necessary because the May 24,
1991 data from that laboratory was obtained using too high detection
limits on eight (8) of the regulated organics. The latest (October
4, 1991) data is improved in that a too high detection limit was used
only on one constituent this time, that being on the pesticide
heptachlor. The standard NC Landfill Leachable Limit for heptachlor
is <.0008 ppm and PACE reports it be <.002 ppm (2.0 ug/1). Today I
spoke with your Mr. Dan Yarborough and he confirmed to me that you do
not use any herbicides or pesticides in your process. Therefore,
this error does not present a problem to the Solid Waste Management
Division's approving disposal of this waste at the targeted sanitary
landfill, if in accordance -with the conditions listed below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Additionally, a resubmittal of the Waste Determination Form
and current supportive analytical data, is required on the
anniversary of this approval.
I am very sorry about the difficulties the formentioned errors
have caused you. Please understand the Solid Waste Management
Division's position in such situations. We have limits against

which wastes must be judged and that is all we are trying to
accomplish in this case. Thank you for your patience.
This 10/25/91 approval replaces the 8/23/91 letter of approval.
Therefore, renewal data and a resubmittal of the Waste Determination
Form is not required until October, 1992.
Failure to meet the above conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new regulations were to prohibit
this practice. If the process which generates the waste changes or
if the composition of the waste changes significantly, this approval
is void and re-evaluation of the waste will be required prior to
subsequent disposal.

This Procedure will be used by the Solid Waste Management Division to determine
whether a waste is (1) hazardous as defined by 15A NCAC 13B, and (2) suitable for
disposal at a.solid waste management facility. `iYle types of wastes that will be
evaluated by this procedure are primarily, but not exclusively, industrial and
eaunercial wastes and sludges, and Publicly Owned Treatment Works Sludges.
The Solid Waste Management Division reserves the right to request additional
information or waive some of the requirements based on the type of waste if it deems
necessary. The Division may also require some wastes to be treated or altered to render
the wastes y immobile prior to disposal at a sanitary landfill. Wastes
disposed at sanitary landfills must be non -liquid which can be properly managed in

The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Additionally, a resubmittal of the Waste Determination Form
and current supportive analytical data, is required on the

This procedure will be used by the Division of Health Services
to determine whether a waste is (1) hazardous as defined by 10 NCAC
10F, and (2) suitable for disposal at a solid waste management
facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request
additional information or waive some of the requirements based on the
type of waste if it deems necessary. The Division may also re

SCALE OPERATOR:
During the development of the 1990-91 budget, the Board discussed the creation of a Scale Operator position at the
County Landfill. At that time, we had not ordered the scales and did not have a firm timetable for Installation and placing
them In operation. It was the consensus of the Board that once the scales were Installed and operational, a decision
on the position would be made using such funds as were required from the contingency line Item. The scales are now
Installed and will be operational within the next few days.
I respectfully request that the Board authorize the creation of a Clerk 111, Landfill Scale Operator position, Grade 57
(14,390-21,301), at the Landfill and authorize the appropriation of $7,500 from Landfill revenues for the salary and fringe
benefits for the remainder of this fiscal year.
ENGINEERING SERVICES:
After the development of the 1990-91 budget and during the design phase of the Scale Project while the surveyors were
at the County Landfill, staff asked them to shoot some elevations on the Landfill. At that time It was determined that
we had exceeded the elevation limitations on our existing permit. This matter was brought to the attention of the Board
in September 1990, and the Board accepted a proposal from Lapsiey and Associates to conduct the engineering services,
necessary to obtain a vertical permit modificatlon. The estimated cost of this work, Including preparation of an up-to-
date topographic map of the entire Landfill tract, was not to exceed $18,000. At that time sufficient funds were available
In the Landfill Contracted Services line Item to allow acceptance of the proposal without a budget amendment. Board
Members were made aware that prior to the end of the fiscal year these funds would have to be replaced.
I respectfully request that the Board authorize the appropriation of $18,000 from Landfill revenues to the Landfill
t.
Contracted Services line Item to meet this obligation.
ARTIFICIAL DAILY COVER:
Staff has received state approval to use a waterproof fabric cover on the working face of the Landfill In lieu of the
current daily cover of 6 Inches of soil. Use of this material will accomplish several objectives Including: 1) Reducing the
daily cubic yard capacity usage at the Landfill by the amount of soil currently deposited each day to cover the solid
waste; 2) Extend the life of the remaining cover soil; 3) Reduce the daily operating expense and maintenance costs for
earth moving equipment (two pans and one bulldozer); 4) Possibly extend the remaining life of the Landfill.
1 respectfully request that the Board authorize the appropriation of $10,000 from Landfill revenues to the Landfill Capital
Improvements line Item for the purchase of an artificial daily cover to use on an experimental basis.
UNANTICIPATED LANDFILL REVENUES:
During the development of the 1990-91 budget, because of the newness of the tax, an estimate of potential revenues
from the state mandated 1% tax on tire sales was not available and was not Included In the budget. Since that time,
these revenues have ranged from $8,000 to $10,000 per quarter, and we anticipate approximately $38,000. in unbudgeted
revenues for this fiscal year. The use of Landfill revenues to defray the cost of Landfill expenses would appear
appropriate.
SUMMARY -
I recommend that the Board consider appropriating $35,500 of unanticipated Landfill revenues to fund the scale operator,
engineering expenses, and an experimental artlficial daily cover for the Henderson County Landfill.

RESOLUTION ESTABLISHING A SOLID WASTE ADVISORY COMMITTEE
WHEREAS, the Henderson County Landfill currently receives and disposes of approximately three hundred tons per day
(3001pd) of solid waste generated by the residents, businesses, Industries and Institutions within the County; and
WHEREAS, the Henderson County Landfill's remaining life expectancy Is being significantly affected by the enactment
and enforcement of the several Federal and State laws, rules, and regulations pertaining to the handling and disposal
of solid waste; and
WHEREAS, the Henderson County Board of Commissioners Is Interested In deriving the maximum number of years' use
from the present landfill site while complying with applicable Federal and State requirements and Is willing to consider
reasonable alternative methods of solid waste handling and disposal which may reduce the size and volume of solid
waste reaching the current landfill; and
WHEREAS, the Henderson County Board of Commissioners Is Interested In developing and maintaining an
environmentally sound system of solid waste handling and disposal at the current site or such future sites as may be
required which will serve the several residents, businesses, Industries and Institutions within the County for the
foreseeable future;
WHEREAS, the Henderson County Board of Commissioners feel that h Is In the best Interest of Henderson County to
establish an advisory committee which Is representative of the community, Its residents, businesses, Industries, and
Institutions to advise the Commissioners of the short and long-range needs for solid waste disposal;
NOW, TTIEREFORE BE iT RESOLVED by the Henderson County Board of Commissioners as follows:
1. That a "Solid Waste Advisory Committee" (SWAC) consisting of not leas than seven members be created to
study, Identity, evaluate, and recommend to the Board of Commissioners such methods of handling and disposal
of solid waste at the current site or such future sites as may be required which will allow Henderson County
to comply with the mandates of State and Federal governments and to provide the necessary solid waste
disposal services for the foreseeable future.
2. That the SWAC shall review and consider such other projects, programs and matters as may be referred to It
by the Board of County Commissioners.
3. That the members of the SWAC shall be appointed by and serve at the pleasure of the Board of County
Commissioners on a three-year, staggered -term basis, whereby one third of the membership may be appointed
or reappointed each year.
4. That the SWAC shall present its findings and any proposed comprehensive plan, Including present and projected
characteristics of the waste stream, alternative methods of handling and disposal of solid waste and estimated
costs for program components to the Board of Commissioners on a monthly basis beginning no later than three
months from the date of appointment.
5. That the Henderson County Board of Commissioners shall assign staff support to the SWAC and provide the
resources as may be necessary and feasible, to accomplish the purposes and mission of the Committee.
6. That this Resolution shall become effective upon Its adoption.

Dear Mr. Setzer,
On Tuesday, February 5, 1991, at 11:30 pm, the Henderson
County Sheriff's Department contacted me to tell me the Mtn. Home
Fire Department had received a call about a fire at the landfill.
I called a landfill employee who arrived at the site and put the
fire out. The Fire Department did not distinguish the fire. The
landfill employees had the fire under control and put out by 12:30
an. A small truck load of trash had been left uncovered because it

On Tuesday, January 22, 1991, at 7:00 am, the Henderson County
Landfill employees discoverd a fire in the landfill. The Mountain
Home Fire Department was called and arrived at 7:15 am. The Fire
Department did not distinguish the fire. The landfill employees had
the fire under control and put out by 7:30 am.

On Tuesday, March 19, 1991, at 11:30 pm, the Henderson County
Sheriff's Department contacted me to tell me the Mtn. Home Fire
Department had received a call about a fire at the landfill. I
called a landfill employee who arrived at the site and put the fire
out. The Fire Department squirted water on the fire and the
landfill employee covered an area approximately 10 ft. sq with
dirt. The landfill employees had the fire under control and put out
by 12:00 am.

Reference is made to previous correspondence from our office
dated January 11 and 15, 1991, concerning proposed improvements
to the Henderson County landfill (copies attached).
As of this date, we have not received any reply to these
requests for approval and feel that a decision on these matters
is very crucial to the continued operation of this facility.
We have been advised by Mr. Gary Ahlberg of your staff that
we could not expect a formal review for at least 90 days. We
appreciate the fact that the staff in the Solid Waste Section is
experiencing an extemely heavy workload and that it has been
difficult to keep up with all the activity around the State.
Our principal concern at this time is to obtain approval for
a demolition landfill within an existing permitted area at the
site. The detailed plans have been submitted with the earlier
correspondence, and it appears that it would only take a short
period of time to clear this item. The balance of our request
can be reviewed at a later date.
If you have any questions or need additional information,

Henderson County
Dear Mr. Coffey:
On behalf of the Henderson County Board of Commissioners, we
submit a request for a demolition landfill to be operated at the
Henderson County Landfill site. The proposed demolition landfill
is described on the enclosed plans.
The proposed demolition landfill would be located on the
property obtained in 1985 in an area excavated for fill. Inert
building materials and wood would be deposited there and not
placed in the sanitary landfill. After completion of the fill,
the area would be graded for drainage, seeded, and mulched.
Run-off from the demolition landfill will be directed to an
existing sediment basin to remove suspended solids before
leaving the site. Silt fence will be erected below the
demolition landfill and drainage will be diverted around the
fill.
We look forward to your response regarding the proposed

The Solid Waste Section has conducted a preliminary review of the
referenced application for completeness. The following comments
must be addressed in order to continue the review process:
1. The description of waste types to be disposed in the
demolition area must be more explicit as the acceptance or
exclusion of certain wastes will dictate siting and design
requirements. Please refer to the enclosed Policy Memorandum
#16 which explains the Section policy regarding the disposal
of yard waste, inert debris, land -clearing debris, and
construction and demolition wastes.
The application requirements for a disposal site accepting
only yard waste, inert debris, and land -clearing debris are
addressed in Section .0506 of the Solid Waste Management
Rules. Should you wish to accept construction and demolition
wastes in the proposed disposal area then the requirements of
15A NCAC 13B Sections .0503 and .0504 must be addressed with
the exception of the liner-leachate collection system
requirement.,
2. A minimum of two cross -sections shall be provided for the
demolition area which illustrate existing grade, proposed
excavation, if any, final grade, and proposed cover.
3. Sedimentation and erosion control plans shall be provided. A
copy of the application will be transmitted to the Land
Quality Section for approval. Please contact the Land Quality
Section, Asheville Regional Office, at (704) 251-6208, for
details regarding Sedimentation and Erosion Control Plan
requirements and fee schedules.

(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
— (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
(d) Dust control measures shall be implemented where necessary.

and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-

CONDITIONS OF PERMIT:
GENERAL
1. This permit shall not be effective unless the certified copy is
filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section and
shall have indicated on it the page and book number, date of
recordation, and the Register's seal.
2. When this property is sold, leased, conveyed or transferred, the
deed or other instrument of transfer shall contain in the
description section in no smaller type than that used in the
body of the deed or instrument, a statement that the property
has been used as a sanitary landfill.
3. This permit is subject to review every five years, effective
from the issuance date of this permit. Modifications, where
necessary, shall be required in accordance with Rules in effect
at the time of review.
4. This demolition waste disposal site is permitted to receive
solid waste as described in the approved plan and as defined in
15A NCAC 13B, .0101(5): stumps, limbs, leaves, concrete, brick,
wood, and uncontaminated earth.
CONSTRUCTION
1. This permit amendment is for the addition of the demolition
area, only, as delineated in the approved plan. This Permit and
the Conditions of Permit specified herein refer only to the
construction and operation of the demolition area and is in no
way intended to supersede the Permit issued for the Sanitary
Landfill. Additional conditions and revisions of the approved
plans shall be approved by the Division of Solid Waste
Management.

2. The following conditions shall be met prior to receiving solid
waste at the site:
a. Site preparation shall be in accordance with the
construction plan.
b. Site inspection shall be made by a representative of the
Division of Solid Waste Management.
OPERATION
1. The demolition disposal area shall conform to the operating
procedures in Rule .0507 of the Solid Waste Management Rules and
the following specific conditions:
a. Solid Waste shall be restricted to the smallest area
possible and compacted as densely as practical. The
active area shall not exceed one (1) acre in size.
b. Adequate soil cover, minimum 6-inch layer, shall be applied
monthly, or when the active area reaches one (1) acre in
size.
C. Solid waste shall not be disposed of in water.
d. A minimum four -foot separation between groundwater and the
bottom elevation of waste is required.
2. Ground water quality at this facility is subject to the
classification and remedial action provisions of 15 NCAC 2L.
3. All earth -disturbing activities will be conducted in
accordance with the Sedimentation Control Rules, codified at
15 NCAC 4.

The proposed demolition landfill would be located on the
property obtained in 1985 in an area excavated for fill. Inert
building materials and wood would be deposited there and not
placed in the sanitary landfill. After completion of the fill,
the area would be graded for drainage, seeded, and mulched.
Run-off from the demolition landfill will be directed to an
existing sediment basin to remove suspended solids before
leaving the site. Silt fence will be erected below the
demolition landfill and drainage will be diverted around the
fill.

This office has reviewed the erosion and sedimentation; control plan
submitted for the project listed below. We find the plan to be acceptable and
hereby issue this Letter of Approval. Please be advised that Title 15A, North
Carolina Administrative Code 413.0017(a), requires that a copy of the approved
soil erosion control plan be on file at the job site. Also, you should consider
this letter to give the Notice required by NCGS 113A-61(d) of our right of
periodic inspection to ensure compliance with the approved plan.
The State's Sedimentation Pollution Control Program is a ,performance -
oriented program requiring protection of the natural resources and adjoining
properties. If, following commencement of this project, it is determined that
the plan is inadequate to meet the requirements of NCGS 113A-51 to 66, this
office may require revisions to the plan and implementation of the revisions to
ensure compliance with the Act.
Please note that this approval is based in part on the accuracy of the
information provided in the Financial Responsibility Form which you have
provided. You are requested to file an amended form if there is any change in
