Subject: Disposal of approximately one ton/week of process wastewater treatment
sludge at the Henderson County Landfill, (Permit #45-01).
Dear Mr. Bush:
The Solid Waste Management Section has received a request for
characterization of the subject waste. Based upon the submitted information, the
waste appears to be non -hazardous. The Solid Waste Management Section has no
objection to the sanitary landfill disposal of this waste, if in accordance with
the conditions listed below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined, compacted, and
covered in accordance with the Solid Waste Management Rules (10 NCAC
10G).
3. Additionally, a submittal of the Waste Determination Form and supportive
analytical data is required on the anniversary of this approval.
Failure to meet these conditions may result in revocation of this approval
and, subsequently, an administrative penalty. The approval is subject to change
if new regulations were to prohibit this practice. If the process which generates
the waste changes or if the composition of the waste changes significantly, this
approval is void and re-evaluation of the waste will be required prior to
subsequent disposal.

PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services
to determine whether a waste is (1) hazardous as defined by 10 NCAC
10F, and (2) suitable for disposal at a solid waste management
facility.
`L"he types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request
additional information or waive some of the requirements based on the
type of waste if it deems necessary. The Division may also require
some wastes to be treated or altered to render the wastes
environmentally immobile prior to disposal at a sanitary landfill.
Wastes disposed at sanitary landfills must be non -liquid and in a
form that can be confined, compacted, and covered in accordance with
the "Solid Waste Management Rule". APPROVAL TO DISPOSE OF THE WASTE
SHALL ALSO BE OBTAINED FROM THE OWNk'R OR OPr_'ATQ,_R OF Tim LA2'DL ILL
PRIOR TO DISPOSAL.
The following information is required for an evaluation. An
asterisk(*) denotes information required for Publicly Owned Treatment

Variance to co -dispose of City of Hendersonville and Cranston
Print Works wastewater treatment plant sludge at the Henderson
County Landfill until October 1, 1989.
Dear Mr. Myers:
In response to your request of March'31, 1989, the Division of
Health Services, Solid Waste Branch hereby grants a variance to the
Henderson County Landfill, Permit #45-01.. The variance is based. on
the authority outlined in 10 NCAC 10G, Section .0205 and appliE:s to
10 NCAC 10G, Section .0505 (11)(f) only. The variance will allow the
Henderson County Landfill to co -dispose of wastewater treatment plant
sludge from the City of Hendersonville and Cranston Print Works until
October 1, 1989. After this date, codisposal of sludge will be a
violation of 10 NCAC 10G .0505 (11)(f) and may be subject to
penalties up to $500.00 per day.
Permit 445-01 is hereby amended to allow the temporary variance
from 10 NCAC 10G, Section .0505 (11)(f).

HENDERSON COUNTY LANDFILL
Dear Mr. Layton:
In accord with instructions set forth in your February
16, 1989 Letter to Mr. A. J. Palazzo, Cranston Print Works
Company, please consider this as a request for a variance
from 10 NCAC 10G, Section .0505 (11) (f). The variance
requested is for a six-month period and would apply only to
Cranston Print Works and the City of Hendersonville.
Attached to this letter are copies of relevant back-
ground material as prepared by the two entities affected by
the variance.
This matter has been reviewed and approved by the Board
of Commissioners of Henderson County and a six-month exten-
sion of a practice condoned for over 20 years would not
appear to have a significant impact on the County Landfill.
We do understand and appreciate the rationale for the new
regulation and feel that both Cranston Print Works and the
City of Hendersonville have developed viable plans for the
alternative disposal of wastewater treatment plant sludge.
Both entities indicate that their alternative disposal plans
should be operational within six months from the date of
issue of a variance.

Dear Mr. Myers:
In response to our previous request for a variance on the use of
the Henderson County Landfill for waste water treatment plant sludge,
we would appreciate your submitting an application containing the
following elements.
(1) We propose to burn the sludge as a fuel supplement
in our pulverized coal-fired boiler.
a. The sludge will be dried in a steam heated
indirect dryer to reduce the moisture content
from the current level of 85% to less than
10%. This will also reduce the weight and
volume of the sludge from 15 tons per day to
3 tons per day.
b. The dried sludge will be transported to the
boiler, and blended with the coal in the
coal elevator system to create a homogeneous
blend of coal and dried sludge. The coal to
sludge ratio at this point would be 25 parts
coal to 1 part sludge. The blend would then
pass through the coal pulverizers, which would
further blend and powder the coal and sludge
for injection into the boiler fireball.
C. We have applied with the North Carolina
Department of Natural Resources and Community
Development for an air quality permit to
reflect this change at the boiler, and should
have no problems in this area. The analysis
of the sludge shows that it will burn 2.7
times cleaner than the coal being used.

(2) The timetable for our project is as follows:
a. The engineering and design work is complete,
except for minor details in the material
handling.
b. The steam line from the main plant to waste
treatment is currently under construction,
and should be completed by May 31, 1989•
C. The necessary permits to burn the sludge
have been submitted, and should not be a
problem after we generate enough sludge
to conduct trial burns.
d. We have set a timetable on purchasing a
dryer as follows.
1. We will continue to search for a
used dryer until April 30, 1989.
This will be our quickest option
on installing a dryer due to the
long delivery time on new equip-
ment.
2. We will order a new dryer if we
cannot find a used one. The
delivery time on a dryer is six
to eight months due to a dryer
having to be custom fabricated
to an individual application.
This would advance our timetable
to October 31, 1989 if it is
necessary to purchase new equip-
ment. We feel that the delivery
time on a new dryer creates the
necessity of allowing time to
continue the search for a used
dryer.
We feel that our most accurate request should be for a variance
of six months to begin on the date of issue to allow enough time to
complete our program.
I am enclosing the necessary analytical data on the sludge to
complete the application.

Re: Request for Variance
State Landfill Regulations
Dear Mr. Meyers:
The purpose of this letter is a request for permission to continue to
dispose of biologically treated wastewater sludge in the Henderson
County landfill for an additional period of six months.
The City of Hendersonville is currently pursuing a permit to allow
disposal of the wastewater sludge on farm land as a crop supplement.
As of this date, we have completed a sludge analyses (a copy of which
is attached for your review) and identified approximately 850 acres
of acceptable farm land. A site evaluation has been conducted at each
of these sites and we are currently awaiting results of the soil
analysis prior to final submission of the permit application.
We anticipate that the complete permit application will be submitted
to the Department of Natural Resources and Community Development no
later than May 1, 1989. To allow for any unforeseen review problems,
we would like to request a variance to allow disposal of the City of
Hendersonville's wastewater sludge at the County landfill until
September 30, 1989.

Re: Monitoring Well Locations For The Henderson County Landfill
(Permit #45-01)
Dear Mr. Myers,
Our office is in the process of updating our ground -water
monitoring files. In reviewing the Henderson County Landfill file,
we found that there is not a current map of your facility that shows
the locations of all the ground -water monitoring wells and identifies
each well with a number corresponding to the designation of the wells
in the field. Within the next 30 days would you please provide our
office with such a map.
This map (preferably 8 1/2" x 1111) should be a specific site map
of the landfill illustrating the configuration of the landfill per
the current permit description. On this map please indicate the
following:
1. Areas of past landfilling activity
2. Area of present landfilling activity
3. Areas of proposed future landfilling activity
4. Areas of demolition waste landfilling
5. Locations of existing monitoring wells; Each well should be
numbered on the map (e.g. MW-1, MW-2, etc.) in a manner
corresponding to the designations of the wells in the field.
Please designate which wells are upgradient (background) wells
and which wells are downgradient. Any additional hydrogeological
data from past boring operations you could provide our office would
also be appreciated. Also, please designate in writing to this
office the name of the contractor you have chosen to perform your
annual ground and surface water monitoring extractions, and the date
on which you plan to perform your annual sampling.

RE: Analytical data from Henderson County Landfill (47-01).
Dear Mr. Levi:
Per your request I have enclosed copies of the most recent results of the
ground and surface water sampling episode at the above referenced landfill.
Coincidentally, the results from our organic laboratory were received in my office
2 hours after I last talked with you, subsequently, I have included them as well.
As you may be aware, this office took replicate samples along with a private
laboratory contracted out by the county. The samples reflect three surface water.
(stream) samples and three ground water samples. The results generally indicate
minor exceedances of iron and manganese (potentially naturally occurring) in all
sar,:ples and virtually no organic contamination in any of the samples. The
exception to this is the presence of caprolactam which is believed to be a
degradation by product of the nylon rope used to lower the bailers down the
monitoring wells. The absence of this material in the surface samples further
gives creedence to this belief.
Trace amounts of four organic constituents are indicated in the stream
samples but are below the 1 part per billion threshold, potentially suggesting
laboratory error in the preparation of the samples. At this time, based upon
these results, the ground waters and stream samples appear to have no significant,
adverse impact as a result of sanitary landfill operations.

The Branch has reviewed your request to test several synthetic
fibers for daily cover at the Henderson County Landfill.
The Branch approves the testing with the following conditions:
( a) The Eranch will Le I uL]Lficd when the test-Ing of each
product will occur so Branch personnel can be on -site.
(b) The Branch will receive test procedures and results from
each vendor.
(c) The daily working area shall be maintained on a slope
sufficient to insure that water does not collect on the
synthetic cover and infiltrate solid waste.
(d) The Branch will terminate the testing or use of any
material upon confirmation that the testing or use of such
material results in a violation or violations of the N.C.

RE: Wastewater Treatment Sludge Disposal
Dear Mr. Palazzo:
We are in receipt of your letter dated January 16, 1989, requesting a six
months extension of time, beginning March 1, 1989, to continue disposal of
wastewater treatment sludge in a sanitary landfill.
DHS Rule 10 NCAC 10G, Section .0505(11)(f) is a sanitary landfill operational
requirement, restricting the use of wastewater treatment sludge in the landfill.
The sludge may only be used as a soil conditioner in the final two feet of cover.
Effective March 1, 1989, this Branch will begin enforcement of this rule, thus
reducing the amount of sludge a landfill may uti!-Lze. We assume, from reading
your letter, that the landfill you presently use is not able to manage your sludge
as a soil conditioner, and thus must discontinue acceptance effective March 1,
1989, to assure compliance with 10 NCAC 10G, Section .0505 (11)(f).
This office will continue to work with the sanitary landfills in the State to
assure strict, but reasonable, compliance with this rule. Accordingly, we suggest
you make the county landfill management aware of your future plans for managing
the sludge, and request the county to ask this office for a variance from 10 NCAC
10G, Section .0505(11)(f). The request for a variance should include the
following.
1. Name of the company whose sludge would be managed under the variance.
2. A detailed description of the alternative sludge management plan the
company is pursuing.
3. The time period of the requested variance. (be specific, give dates)

In reference to our Waste Water Treatment sludge being
placed in landfills, we need to make the following request.
With the March 1, 1989 deadline approaching, we have decided
onga suitable. at this time of disposing of our sludge.
Purchase Orderd--and Engineering Studies have already been issued,
but it.appears that we will not make the March 1st deadline. Our
only alternative will be to have the sludge hauled- off to the GSY
Facility at Pinewood, South Carolina at a cost of upwards to
$3,000.00 per production day. We have also heard that the
Governor of South Carolina is going to stop shipments from
outside the State.
(�. As you can see this is a substantial price to pay and a
\' burden on our operation. We request a deadline extension for a
period of six months to allow us to complete our project.
Any advice or assistance that you could give us on this
matter would be greatly appreciated.

(a) Surface water shall be diverted from the operational area.
— (b) Surface water shall not be impounded over or in waste.
(c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
— (c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
— (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction
and maintained in good condition.

and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
