Dear Mr. Hargus: A recent evaluation of the data submitted for the above referenced waste indicates that the material appears non -hazardous and is suitable for landfilling if in accordance with the conditions listed below: 1. The waste is non -liquid and can be confined, compacted, and covered in accordance with the "Solid Waste Management Rules" (10 NCAC 10G). 2. The owner/operator of the landfill approves the disposal. In the event that the material is manufactured or utilized differently in the future, it may be necessary to re-evaluate the waste and/or to rescind approval of the waste for landfilling disposal. Additionally, failure to meet the above mentioned conditions may also result in revocation of this approval and an administrative penalty. Ficker: The Solid $ Hazardous Waste Management Branch has received a request for characterization of the subject waste. Based upon the submitted information, the waste appears to be non -hazardous, and therefore, this office has no objection to the sanitary landfill disposal of this waste if it is in accordance with the conditions listed below: 1. The waste contains no -free liquids and can be confined, compacted, and covered in accordance with the Solid waste Management Rules (10 NCAC 10G) 2. The owner/operator of the landfill approves the disposal. 3. Under no circumstances will oily waste be disposed of by mixing with routine waste or buried below ground in a separate area without specific SHIVB approval. 4. Waste shall be land applied in an area of the landfill which has received two feet of earthen cover or in a virgin area. S. The waste shall be applied in a thin layer not to exceed six inches in depth. 6. Surface water shall be diverted from the area of application. 7. The area shall be seeded to control erosion. 8. If the waste is delivered in drums and the dr..ims are to be disposed, they will be perforated with small holes, prior to delivery, to ensure that no liquids are present. 9. The waste is removed from the drums before disposal. 10. The waste is dry and all the organics are evaporated. Failure to meet these conditions may result is revocation of this approval, and subsequently, and administrative penalty. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. (5) DRAINAGE CONTROL REQUIREMENTS — (a) Surface water shall be diverted from the operational area. (b) Surface water shall not be impounded over or in waste. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS -- (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS _ (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. (b) Solid waste shall not be disposed of in water. (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. — (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. — (c) The access road to the site shall be of all-weather construction and maintained in good condition. (d) Dust control measures shall be implemented where necessary. Box 2749 Asheville, NC 28802 Dear Mr. Batts: This letter is being written to you to reiterate our telephone conversation of October 23, 1987 concerning waste determinations and disposal of wastes at Sayles Biltmore Bleacheries. First of all we discussed the fact that the sample results along with the completed waste determinations on the coal ash and sludge generated at Sayles Biltmore Bleacheries have been evaluated by our office and determined to be suitable to dispose of at a sanitary landfill. We further discussed the fact that at this time our Branch has no objection to Sayles Biltmore Bleacheries allowing individuals to haul coal ash off site for use as a base for roads or other construction purposes. Next we discussed the fact that our Branch would like to see the large stockpile of. coal ash onsite depleted within the coming months. Further, in the future we will only allow a small amount of coal ash to be stored onsite. If individuals do not utilize the coal ash, it will have to be taken to a sanitary landfill for disposal. Regarding the disposal of the sludge material generated at Sayles Biltmore Bleacheries, we agreed that it would not be disposed of onsite. The landfill will be the best place to take this material. I will be visiting Sayles Biltmore Bleacheries in the future to check on your progress in getting all the coal ash removed, along with the drums that were located in the same area as the ash. Please remember that if the drums are going to be landfilled, they must be totally emptied and perforated.
