Re: Disposal of Asbestos in Henderson County Landfill
Dear Mr. Snodgrass:
The Division of Health Services has no objection to disposal of asbestos waste
in permitted sanitary landfills if performed in accordance with 40 CFR Part 61.
The following procedures should be followed:
1. Permission from the owner/operator of the landfill should
be obtained prior to delivery since the owner/operator has
the right to deny acceptance of any waste.
2. A copy of this letter should accompany the waste at time of
disposal.
3. The waste is placed wet into plastic bags and securely
sealed to prevent an airborne condition during handling.
4. The operator shall be notified that the waste is to be
covered immediately with sufficient amounts of dirt or
other waste so as to prevent an airborne condition during
final disposal.
5. The operator shall place the waste as far from the top of
the landfill as possible, but in no case within ten (10)
feet of the landfill surface.
The preparation of the asbestos and delivery should comply with OSHA and DOT
standards,

Dear Mr. Laughter:
Subject: Henderson County Landfill Expansion Permit Request
This letter is to advise you of this agency's decision to deny your permit
request on behalf of Henderson County for the referenced site.
Based on the information submitted, an expansion of this landfill will
create an increased potential for contamination of adjacent water supplies.
This permit application does not contain adequate evidence that nearby water
supplies would not be affected the proposed expansion.
This application would be reconsidered if the private water systems in the
area could be replaced by the municipal water system and steps could be taken
to ensure no new wells were developed in the future.
You may appeal this decision within 30 days after you receive this
notification by requesting an administrative hearing concerning this matter.
The request must be submitted in writing to Mr. 0. W. Strickland, Head, Solid
and Hazardous Waste Management Branch, Division of Health Services, P.O. Box
2091, Raleigh, N.C., 27602, and must state the legal and factual issues in
dispute. When a hearing is requested, it shall be in accordance with the
rules contained in 10 NCAC 1B .0200, a copy of which is enclosed.
