PO Box 65 Grifton, NC 28530 SUBJECT: Notice of Deficiency Compliance Inspection Report Cannons Septic Tank Service, Inc. SLAS-74-08 Pitt County Dear Ms. Cannon and Mr. Maready: During the past weeks, Chester R. Cobb, representing the State of North Carolina, Division of Waste Management Solid Waste Section, has reviewed the submitted land application site logs for the above referenced facility for compliance with North Carolina solid waste statutes and rules. The following violation was noted: A. 15A NCAC 13B .0842(b)(1) states “Maximum land application rates for septage shall be determined based upon the following: (1) domestic septage land application rates shall be in accordance with 40 CFR Part 503.12(c).” Federal Rule 40CFR Part 503.12(c) basically states that domestic septage shall not be applied to agricultural land if the annual application amount has been reached. Permit Condition 7 states “the maximum annual application rate shall be 50,000 gallons per acre per year. Upon review of the land application site logs that were submitted for permit renewal, it was noted that the maximum annual application volume of 150,000 gallons (50,000 gallons/acre/year * 3.0 acres) for Field 7 was exceeded by 29,250 gallons in 2020. The spreadsheet for tracking septage applications to the site was modified to show total amount applied to each field throughout the year. Talked with staff on September 09, 2021 about the spreadsheet and tracking amount applied to each field throughout the year. The above violation may have or can compromise the facility’s ability to ensure protection of the public health and the environment and thus require remedial action on behalf of the facility in order to maintain compliance with 15A NCAC 13B .0842(b)(1). Based upon the foregoing, Cannons Septic Tank Service, Inc. shall come into compliance immediately with all requirements of the regulations in 15A NCAC 13B .0842(b)(1) by completing the following at the SLAS-74-08: 1. Subtract 29,250 gallons from the remaining application balance to Field 7 for 2021. 2. Ensure that the maximum annual application rate and amount is not exceeded by field or site in the future. SLAS-74-08 Notice of Deficiency Page 2 of 2 November 3, 2021 The violation listed above was observed by Section staff and requires action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection to verify that the operator has completed the requirements of this Notice of Deficiency.
