STATUS OF PERMIT:
A Permit to Operate Greenway Waste Solutions of Apex, LLC, permit numbers 9230-CDLF-2014 (Phase 1, 2, and 3) and
9230-COMPOST (Large Type 1), was issued on July 10, 2020 and February 21, 2020, respectively, and will expire on
December 10, 2062 and February 21, 2030, respectively.
PURPOSE OF SITE VISIT:
Follow up inspection concerning violation found during previous inspections.
STATUS OF PAST NOTED VIOLATIONS:
A. Violation: 15A NCAC 13B .0542 (1)(4) Leachate must be contained on -site or treated prior to discharge.
An NPDES permit may be required prior to the discharge of leachate to surface waters.
Status: Resolved. During the October 27, 2021 inspection, leachate was being contained within the footprint of
the C&DLF. A leachate collection system consisting of landfill wells, pumps and a tankard has been installed,
however the wells were not drilled deep enough to extract the leachate. Greenway Waste is working on drilling
additional wells at a depth that will allow for leachate extraction. The soil in the sediment basins and other areas
outside the landfill footprint impacted by leachate have been scraped and removed. All sampling and reporting

requirements have been met. Some leachate seeps were observed during the inspection, however they had been
plugged and Greenway Waste has been monitoring these wet areas daily.
B. Violation: 15A NCAC 13B .1406 (4) Leachate shall be contained on site or treated prior to discharge. A
National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with
15A NCAC 02B prior to the discharge of leachate to surface waters.
Status: Resolved. During the inspection, organic leachate was being contained onsite and was not entering
surface waters. The Northwest Compost Area had been cleared of organic matter and regraded. The east compost
area was still holding some water, however the leachate was being prevented from leaving the site. Continue to
monitor the east compost area for surface water ponding in and around the compost to prevent leachate.
C. Violation: 15A NCAC 13B .0542 (1) (2) Surface water must not be impounded over or in waste.
Status: Resolved. During the inspection, surface water was not impounding over the inactive or active C&DLF.
The top of the C&DLF had been regraded to shed water.
D. Violation: 15A NCAC 13B .1406 (3) Stormwater shall be diverted from the operations area.
Status: Resolved. During the inspection, stormwater was being diverted from the operational areas. Continue
to monitor and regrade as needed.
E. Violation: 15A NCAC 13B .0542 (g) (3) Appropriate methods such as fencing and diking must be provided
within the area to confine solid waste which is subject to be blown by the wind. At the conclusion of each
operating day, all windblown material resulting from the operation must be collected and disposed of by
the owner and operator.
Status: Resolved. During the inspection, windblown waste was at a minimum and was being collected daily.
On windy days make sure you are using methods to control windblown waste.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
A. The east compost area had been cleaned up and the compost rows were an appropriate size. This area is prone to
retaining water, so keep an eye on it and regrade as necessary.
B. The inactive portion of the C&DLF needs to be mowed to allow for inspection.
C. Land clearing debris and some yard waste was being stored on top of the inactive C&DLF. This area has been
approved for storage of land clearing waste only. Remove the yard waste from the top of the C&DLF.

D. The owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when
the waste disposal area exceeds one-half acre and at least once weekly. The working face of the C&DLF appeared
to be larger than half an acre. Immediately, apply 6 inches of earthen material to the working face of the
landfill.
E. Areas of erosion were present on the side slopes. Within 30 days, apply 6 inches of earthen material to all
eroded areas and implement erosion control measures such as vegetative growth or other stabilizing
material.
F. Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the
beginning of a calendar year commencing January 1, must be removed from the facility through sale, use,
or reuse by December 31 of the same year. A large amount of concrete for grinding has been stored at the
facility for what appears to be longer than a year. Additionally, there was unacceptable waste comingled with the
concrete, including some waste that may have contained asbestos. Remove all unacceptable waste and grind this
material within the appropriate timeframe.
