NOTICE OF VIOLATIONS) (citation and explanation): 1) 15A North Carolina Administrative Code 13B .1626(2)(a) and (b) state that the owner or operator of all municipal solid waste landfill units must cover solid waste with six inches of earthen material or other approved alternative materials at the end of each operating day. The Haywood County municipal solid waste landfill was operating in violation of this rule in that waste has not been properly covered at the end of each operating day. All solid waste must be covered with six inches of soil or approved alternative cover. 2) 15A North Carolina Administrative Code 13B .1626(7)(b) states that adequate sediment control measures (structures or devices) shall be utilized to prevent excessive on -site erosion. The Haywood County municipal solid waste landfill was operating in violation of this rule in that excessive on -site erosion was observed in the protective soil cover in the new landfill cell. All eroded areas must be filled with soil, and erosion control structures or devices must be installed. The Haywood County municipal solid waste landfill was operating in violation of this rule in that windblown material is not being collected and returned to the working area at the conclusion of each day of operation. All windblown material must be picked up and returned to the working area. Steps need to be taken to ensure that windblown materials are picked up on a daily basis. A compliance date of April 1, 2002 has been established for correcting the violations noted above. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. This permit shall be reviewed, pursuant to 15A NCAC 13B. 0201(e), no later than November 27, 2006. 2. In the event of conflicts between this Permit to Operate and previously issued conditions, the conditions of this Permit to Operate shall supersede previously issued conditions. I The solid waste management units within this facility shall conform to all operating procedures described in the approved plans, 15A NCAC 13B, and the conditions specified herein. 4. Additional conditions and revision of the approved documents or changes during the operation of the landfill require approval by the North Carolina Solid Waste Section. 5. On or before August 1 of each year, the permittee shall report the amount of waste received (in tons) at this facility and disposed of in the landfill units to the Solid Waste Section, on forms prescribed by the Section. The reporting period shall be for the previous year, beginning July 1 and ending on June 30. This report shall include the following information: a. The amount of waste received and land filled in tons, compiled on a monthly basis by county or transfer station of origin and by specific waste type if diverted to a specific unit within the permitted facility. b. A survey of volume utilized in the MSW cells shall be performed during the second quarter of the calendar year. The date and volume, in cubic yards, shall be included in the report. C. The amount of waste, in tons from scale records, disposed in MSW cells since November 27, 2001 through the date of the annual survey. d. The completed report shall be forwarded to the Regional Waste Management Specialist for the facility. A copy of the completed report shall be forwarded to the County Manager of each county from which waste was received. Ground water quality at this facility is subject to the "Classifications and Water Quality Standards Applicable To The Groundwater of North Carolina", 15A NCAC 2L. This includes, but is not limited to, provisions for detection monitoring, assessment, and corrective action. PART II: MUNICIPAL LANDFILL UNIT CONDITIONS GENERAL CONDITIONS 7. This permit approves the operation of Phase 2 of the municipal solid waste landfill as well as the on -site environmental management and protection facilities as described in the approved plans. 8. This permit is for operational approval for five years with a Phase 2 gross capacity of approximately 1,159,361 cubic yards and an approximate waste capacity of 1,030,543 cubic yards, consistent with the contours as shown in the approved drawings. MONITORING AND REPORTING 9. Ground water monitoring at this unit shall be as prescribed by the appropriate requirements of 15A NCAC 13B .1630-.1637 and the approved monitoring plan. 10. A readily accessible unobstructed path shall be cleared and maintained so that four- wheel drive vehicles may access monitoring well locations at all times. 11. A field log book which details all development, sampling, repair, and all other pertinent activities associated with each monitoring well and all sampling activities associated with each surface water and leachate sampling location shall be kept as part of the permanent facility record. 12. Records of all ground -water, surface water and leachate analytical data shall be kept as part of the permanent facility record. 13. Ground water monitoring wells and surface water sampling locations must be sampled for Appendix I constituents at least semi-annually according to the specifications outlined in the approved water quality monitoring plan and the current policies and guidelines of the Section in effect at the time of sampling. 14. Reports of the analytical data for each water quality sampling event shall be submitted to the Section within 60 days of the respective sampling event. Analytical data shall be submitted in a manner prescribed by the Section. The four independent samples which comprise the initial baseline sampling event shall be collected from each ground water monitoring well and the report shall be submitted to the Section within six months after issuance of the Permit to Operate. 16. Untreated leachate shall be sampled and analyzed at least semi-annually concurrently with the ground and surface water sampling. The leachate shall be analyzed for all Appendix I constituents, pH, specific conductance, BOD and COD, phosphate, nitrate, and sulfate. Test results shall be submitted to the Section along with ground.and surface water test results. In the event leachate is recirculated, additional leachate sampling may be required. OPERATIONAL CONDITIONS 17. The landfill unit shall conform to all operating. requirements described in the approved plans, 15A NCAC 13B .1626, and the conditions specified herein. 18. The use of alternative daily cover requires approval, prior to implementation, by the Solid Waste Section. Requests for alternative daily cover approval must include a comprehensive use and demonstration for the effectiveness plan developed according to Section guidelines and consistent with the approved plan. Plans which are approved by the Section will be incorporated into, and made a part of, the approved documents found in Attachment 3. 19. The use of leachate recirculation as a leachate management tool requires approval, by the Solid Waste Section, prior to implementation. Requests for leachate recirculation approval must include a comprehensive management plan developed according to Section guidelines and which is consistent with the approved operation plan. Plans which are approved by the Section will be incorporated into, and made a part of, the approved documents found in Attachment 3. 20. The MSWLF unit is permitted to co -dispose of wastewater treatment sludges generated within the facility's approved service area, subject to the terms and procedures of the approved plan. 21. Closure or partial closure of any MSWLF unit shall be in accordance with the Closure Plans described in the approved plans and 15A NCAC 13B .1629. Final Closure Plans shall be submitted to the Division at least 90 days prior to implementation. RECIRCULATION PLAN FOR THE COUNTY OF HAYWOOD, NORTH CAROLINA March 13, 2002 Haywood County intends to utilize recirculation as a means of disposal of their leachate. The intention is to utilize recirculation as a method by which some relief can be given to the pumping and hauling. This relief will come in the form of evaporation and retention of water within the solid waste. The remaining leachate will be hauled to the Waynesville Waste Water Treatment Plant for disposal. There is no runoff of water that comes in contact with the present surface of solid waste except the water that goes into the leachate collection system. The County will spread the leachate over the surface of the solid waste in Phase I only. Phase I is the only phase that has been constructed with the regular lining system unlike Phase II which has an alternate lining system. The spreading will be accomplished by simply backing the leachate hauling truck into the landfill. A spreader hose will then be attached to the leachate tank and Haywood County personnel will manually discharge the leachate over the top of Phase I. Berms will be constructed around the top of Phase I so that leachate cannot run down any slopes. The slopes will be monitored to assure that no leachate is breaking out and then running down the slopes. At a later date, a pumping system may be incorporated into the system. The pumping system will pump directly from the leachate lagoon and the leachate will then be spread in the same manner as from the tank truck. Leachate will be recirculated on top of Phase I until either there is no room to allow for ponding the leachate or Haywood County is permitted to recirculate over Phase II which has the alternate lining system. The semi-annual monitoring that is ongoing will analyze the leachate for BOD, COD, temperature and pH and Subtitle D Appendix I Constituents. The following conditions will be met by Haywood County: • A rain gauge and thermometer will be placed on site; • A base line sampling of leachate has been performed (See Attachment 1); • Weekly record of leachate recirculated and leachate disposed (see Attachment 2) will be maintained; • Weekly record of visual monitoring log (see Attachment 3) will be maintained; • Weekly record of rainfall and lagoon depth (see Attachment 4) will be maintained; • Records will be kept on a weekly basis; • No leachate will be recirculated when it is raining or when the waste is too wet; • No run off or side seepage will be allowed; • Odors will be controlled; • The application system will be properly maintained and documented; and, • Leachate will be tested semi-annually and a progress report will be submitted annually. There are no changes in the initiatives specified in the 3-year plan update concerning solid waste incineration, composting and mulching, or solid waste collection.
