The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on October 20, 2021.
2. The facility is open Monday through Saturday, 8:00am to 4:00pm.
3. The required signage was observed at the entrance of the facility and the scale house. Additional directional
and informational signage is posted throughout the facility to aid customers.
4. The facility is secured by gates at both entrances and a portion of the facility is fenced to prevent unauthorized
access. In areas where fencing has not been installed, topography serves to limit access as well.
5. The facility is currently constructing a new scale house to the southwest of the current building. This capital
improvements project also includes a new traffic pattern to reduce congestion at the scales.
Records Review
6. Tonnage records were reviewed from the FY2020-2021 Facility Annual Report. The facility disposed
30,226.69 tons of waste from July 1, 2020 to June 30, 2021.
7. North Carolina Certified Landfill Managers:

9. North Carolina Certified Landfill Operators Training was conducted by Labella Associates at the facility on
July 7, 2021 and the following individuals attended:
• Dwayne Smith
• Kenn Webb
• Dwayne Shipman
10. Landfill gas monitoring data was provided by email for review. Records indicate that sampling was conducted
on October 20, 2020, January 4, 2021, April 21, 2021 and July 22, 2021, as required and no exceedances were
reported.
11. Waste screening forms from January 5, 2021 to October 8, 2021 were available for review. The forms showed
the final disposition of unacceptable waste that was encountered. The facility is meeting the one vehicle per
week requirement as stated in the approved operations plan. However, additional waste screenings need
to be performed to ensure that the facility is meeting the one percent by weight of the waste stream that is
also outlined in Section 4.2 of the approved operations plan.
Operations Inspection of the MSWLF Unit (8807-MSWLF-I990)
12. The facility is currently filling in Phase 5.
13. The access roads were constructed of all-weather material and were being maintained.
14. A small amount of windblown material was observed in the unused portion of Phase 5. Facility staff were
actively picking up windblown material at the time of inspection. As stated in 15A NCAC 13B .1626 11(c): "At
the conclusion of each day of operation, all windblown material resulting from the operation shall be collected
and returned to the area by the owner or operator." Collect and return all windblown material at the end of
each working day.
15. Some waste was observed on the western side of the working face. Staff stated that it was from the removal of
the tarp from the working face. Facility staff sent photographs at the end of the day showing the material was
removed.
16. The working face was of manageable size, compact and no banned waste was observed.
17. Litter was observed in the operational area around the landfill lift which appeared to have been tracked by
equipment. Facility staff sent photos at the end of the working day showing that additional soil was added. It is
recommended to minimize equipment traffic on areas of the cell that are not actively having waste placed
on them.
18. Slope drains have been installed on the slopes of Phase 1 and Phase 4 to control storm water runoff. Slopes have
been stabilized and no evidence of erosion was noted.

19. The leachate tank was inspected and found to be well maintained, the secondary containment area was clean, free
of debris and the valve was closed.
Operations Inspection of the White Goods, Tires and Electronics Collection Area
20. Two scrap tire trailers are located to the east of the scale house. Seven tires which were filled with soil were
observed stored outside the trailer. Staff stated that the tires had been brought in on October 19, 2021. Ensure
all tires that are capable of holding water are placed in a trailer or covered within ten days of receipt as
required by 15A NCAC 13B .1107 (2)(c).
21. White goods are collected and placed in a roll off container adjacent to the scrap tire trailers. Some material
was observed on the ground that resulted from loading the roll off container. Facility staff sent pictures at the
end of the day showing the pieces were cleaned up from the area.
22. Facility staff stack televisions and monitors on separate pallets and place miscellaneous items such as printers
and cords in gaylord boxes. The packaged materials are sent to Electronics Recyclers International, Inc. (ERI)
in Badin, NC for processing.
Operations Inspection of Household Hazardous Waste Unit (8807-HHW-2002)
23. The permanent household hazardous waste collection unit is permitted to receive household hazardous waste
(HHW) generated by homeowners and conditionally exempt small quantity generators of Transylvania County.
24. The HHW collection unit is open Monday through Saturday, 8:00am to 4:00pm and is secured by gates and
fencing to prevent unauthorized entry.
25. Citizens place HHW on carts and facility staff sort and store the materials according to its class. The sorted
HHW is placed into a three compartment storage building with secondary containment.
26. The facility has partnered with the North Carolina Department of Agriculture (NCDA) to collect outdated and
unwanted pesticides. The pesticide containers are stored in a shipping container and are picked up by NCDA
for disposal.
27. Used motor oil is collected to the southeast of the HHW building. The tank appeared to be in good condition
with no visible leaks.
