STATUS OF PERMIT:
A Permit Approval to Construct Horizontal Expansion Phases 5 & 6 and a Permit Approval to Operate Existing Landfill
& Horizontal Expansion Phases 1 -4 was issued to Louisiana-Pacific Corporation on April 27, 2020.
PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
Resolved Violation - 15A North Carolina Administrative Code 13B .0505(a)(1)(C) states: “Areas that will not have
additional wastes placed on them for the next 12 months, but where final termination of disposal operations has not
occurred, shall be covered with no less than one foot of compacted soil.”
During an inspection of June 16, 2021, Mr. Witherspoon stated the landfill had not received waste since April of 2020.
This information was also verified via the 2019-2020 Facility Annual Report submitted to the Solid Waste Section on July
30, 2020.
Louisiana-Pacific Corporation was found in violation of 15A NCAC 13B .0505(a)(1)(C) in that a minimum of one foot
of compacted soil had not been provided within 12-months of the last placement of waste within the landfill.
To achieve compliance, Louisiana-Pacific Corporation was required to cover all areas of exposed waste with a
minimum of 12-inches of compacted soil within 90-days of issuance of the previous Facility Compliance Inspection
Report.

Inspection of the facility on October 14, 2021 found all areas of previously exposed waste had been covered with soil
and seeded with good germination of seed. Mr. Witherspoon stated 12-inches of soil was placed over the former areas
of exposed waste. As a result, this violation is considered resolved. Thank you for your cooperation in this
matter.
OBSERVED VIOLATIONS:
None
ADDITIONAL COMMENTS
1. The landfill is permitted to accept wood ash generated from wood-fired boilers and zinc borate sludge from the
facility’s waste water treatment plant.
2. This inspection was a partial inspection to evaluate the facility’s efforts to comply with the observed violation
documented on the previous Facility Compliance Inspection Report issued on June 29, 2021. Please refer to
“Status of Past Noted Violations” for comments.
3. The landfill has not received waste since April of 2020.
4. The landfill was not in operation at the time of inspection.
5. Multiple fire boxes equipped with hydrants and hoses were provided on top of the landfill to aid in fire control.
6. During the previous inspection, a small area of bare vegetation was observed on the west side of the top of the
landfill. The area was approximately 20-feet wide x 30-feet long. Inspection on October 14, 2021 found the area
had been seeded with little germination of seed. Mr. Witherspoon stated this area was supposed to have been
covered with additional soil and seeded during efforts to cover exposed waste within the landfill. However, it did
not appear that additional soil had been placed over the bare area. Please ensure that additional steps are taken to
ensure this bare area is stabilized with a groundcover sufficient to restrain erosion.
7. During the previous inspection, a void within the soil was observed at the crest of the south facing slope
approximately 25-feet east of fire box #37. Inspection on October 14, 2021 found the previously observed void
had been repaired. Thank you for addressing this concern.
8. Continue to monitor all vegetative growth in the recently seeded areas to ensure the establishment of a
groundcover sufficient to restrain erosion.
9. Permanent edge-of-waste markers were in place around the landfill.
10. The facility was secured by a gate and access must be granted via scale house personnel.
11. All access roads were of all-weather construction and well maintained.

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
