STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was received by the Solid Waste Section on August 22, 2016. The
Notification was filed for recordation with the Wilkes County Register of Deeds on August 16, 2016.
PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
Resolved Violation - 15A North Carolina Administrative Code 13B .0566(1) states: “The site shall only accept those
solid wastes that it is permitted to receive.”
During an inspection on June 16, 2021, multiple pieces of painted wood were observed on the north side of the disposal
area. Therefore, Louisiana-Pacific was found in violation of 15A NCAC 13B .0566(1).
To achieve compliance, Louisiana Pacific was required to remove all unacceptable waste and properly dispose of it at a
solid waste management facility permitted by the Division of Waste Management within 30-days of issuance of the
previous Facility Compliance Inspection Report issued on June 29, 2021.
On July 30, 2021 the Solid Waste Section received a letter from Mr. Witherspoon documenting Louisiana-Pacific’s
efforts to comply with the noted violation. The letter included photos showing where equipment had been used to
remove unacceptable wastes. Photos also showed silt fence had been installed along the edge of the disposal area. Mr.
Witherspoon also provided copies of multiple landfill receipts verifying disposal of 16.48-tons of waste at the Wilkes
County Roaring River MSWLF (97-04).

Inspection of the facility on October 14, 2021 verified all previously observed unacceptable wastes had been removed
from the landfill. Therefore, this violation is considered resolved. Thank you for your cooperation in this matter.
OBSERVED VIOLATIONS:
None
ADDITIONAL COMMENTS
1. The facility is located on a 405.2-acre parcel of land located on ABTCO Road and is owned by Louisiana-Pacific
Corporation.
2. This inspection was performed to evaluate Louisiana-Pacific’s efforts to comply with the violation documented on
the previous Facility Compliance Inspection Report issued on June 29, 2021. Please refer to “Status of Past Noted
Violations” for comments.
3. Access to the site is secured by a gate and access must be granted via scale house personnel. A secondary gate
consisting of electrified wire is located at the direct entrance of the landfill area.
4. The waste area appeared to be less than 2-acres at the time of inspection.
5. Waste within the landfill consisted primarily of soil and wood chips. A small amount of broken concrete and
asphalt was observed along the southern edge of the disposal area.
6. No erosion or off-site sedimentation was observed.
7. Silt fence with a washed stone outlet had been installed along the edge of the landfill area since the last inspection.
However, majority of silt fence had fallen from the wooden stakes and was in need of repair. Mr. Bowles stated he
believed the damage was caused by cows that were previously grazing in the area of the landfill. Please ensure the
silt fence is repaired to proper design.
8. It appeared that all required setbacks were being maintained.
9. No standing water was observed.
10. Since the previous inspection, the waste area had been seeded with some germination of seed.
11. All access roads were of all-weather construction and well maintained.

or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
