STATUS OF PERMIT:
A Permit to Operate Shotwell Landfill, Phases 1, 2, 3, 4 and 5, (9226-CDLF-2020) was issued to Meridian Waste North
Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on June 8, 2020 and will expire on January 10, 2061.
A Permit to Construct Shotwell Landfill, Phase 6, was issued to Meridian Waste North Carolina, LLC (Owner) and
Shotwell Landfill, Inc. (Operator) on June 8, 2020. The initial, substantial, construction authorized by the permit to
construct must commence within 18 months from the issuance date of the permit (by December 8, 2021). If
substantial construction does not begin within 18 months from the issuance date of the permit, then the permit to
construct shall expire.
Permit Approval to Construct Shotwell C&D Material Recovery Facility (9226-MWP-2020) was issued to Meridian
Waste North Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on November 6, 2020. The initial,
substantial, construction authorized by the Permit to Construct must commence within 18 months from the
issuance date of this permit. If substantial construction does not begin within 18 months from the issuance date of
this permit, then the permit to construct shall expire.
PURPOSE OF SITE VISIT:

NOTICE OF VIOLATION(S):
15A NCAC 13B .0542 (k) Erosion and sedimentation control requirements. Erosion control measures consisting of
vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to
prevent on -site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including
subsequent amendments and editions.
AND
15A NCAC 13B .0542 (f) (3) Areas that will not have additional wastes placed on them for three months or more,
but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative
ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph.
Shotwell Landfill, Inc (operator) and Meridian Waste North Carolina, LLC (owner) are in violation of 15A NCAC 13B
.0542 (k) and 69 (3) in that erosion control measures were not being used to prevent on -site erosion and areas that have
not had additional wasted placed on them for three months have not been covered and stabilized with vegetative ground
cover. During the inspection, large volumes of sediment were observed in the sediment pond and in the forested area to the
west of the landfill (Figures 1 and 2). Additionally, deep erosion rills cut through the soil cover into waste in some areas
along the western slope of the landfill (Figures 3 and 4). Erosion issues were previously noted in the August 19, 2021 and
April 29, 2021 inspection reports. And, during the inspection, the western/southwestern slope of the C&DLF had not been
stabilized with vegetative ground cover or other stabilizing material (Figure 4)
CORRECTIVE ACTIONS:
1. Within 10 days of this report, cover the western/southwestem side slope of the C&DLF with at least 6 inches of
earthen material.
2. Within 30 days of this report, stabilize the western/southwestern side slope of the C&DLF with vegetative growth
or other stabilizing material.
3. Within 30 days of this report, remove accumulated sediment from the southwestern sediment basin.
4. The forested area to the west of the landfill where sediment has accumulated is part of the approved Phase 6, which
according to the permit, if substantial construction does not begin by December 8, 2021, then the permit to construct
shall expire. By December 8, 2021, EITHER begin construction on Phase 6 and remove the sediment as part of
that construction, OR, if Shotwell Landfill will not begin construction of Phase 6 by the permit deadline, submit a
plan for Section approval detailing the removal of the sediment in the forest.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
Shotwell Landfill is a construction and demolition landfill, C&DLF, located at 4724 Smithfield Road, Wendell, Wake
County, North Carolina. The facility has received a permit to construct Phase 6 of the landfill, however, as of the date of
this inspection, construction had not begun. The facility has also received a permit to construct a Mixed Waste Processing
facility, which also had not yet begun construction.
The site was inspected by Davy Conners and Andrew Hammonds on October 12, 2021. Tim Webb with Meridian Waste
accompanied Ms. Conners and Mr. Hammonds for the inspection. In addition to the above noted violations, the
following was observed:

1. This inspection was the result of an odor complaint received by the Section the day prior. Along the side slopes
of the C&DLF, a hydrogen sulfide (rotten egg) odor was detectable and was strong in some areas where erosion
had cut into the waste. This issue was also noted in the August 19, 2021 inspection report. Within 10 days of
this report, cover any areas of erosion with at least 6 inches of soil to control odors.
2. During the April 29, 2021 inspection, the working face of the C&DLF was over a half -acre in size and a large
area of the top of the landfill outside the working face had exposed waste. During the August 19, 2021 inspection,
the working face was within a half -acre in size and soil was piled nearby for cover. Good job. There were still
some areas outside of the working face with exposed waste (Figure 1). Within 10 days of this report, cover
with at least 6 inches of earthen material or pick up any exposed waste on the top of the landfill outside of
the working face.
3. Per the permit, "The edge of the waste footprint for all disposal units must be identified with permanent physical
markers."
During the inspection, no edge -of -waste markers were observed. This issue was also noted in the August 19,
2021 and April 29, 2021 inspection reports. Within 30 days of this report, install markers clearly identifying
the edge of waste at the facility.
4. Per 15A NCAC 13B .0542 (1) (2), "Surface water must not be impounded over or in waste."
During the inspection, water was observed ponding on top of the inactive portion of the C&DLF. Within 10
days of this report, regrade this areas to promote drainage, in accordance with the site's sedimentation and
erosion control plan.
Per 15A NCAC 02C .0108(o) "Each non -water supply well shall have permanently affixed an identification plate.
The identification plate shall be constructed of a durable, waterproof, rustproof metal or other material approved
by the Department as equivalent and shall contain the following information:
(1) well contractor name and certification number;
(2) date well completed;
(3) total depth of well;
(4) a warning that the well is not for water supply and that the groundwater may contain hazardous
materials;
(5) depth(s) to the top(s) and bottom(s) of the screen(s); and
(6) the well identification number or name assigned by the well owner.
During the inspection, some of the wells observed had identification plates without any information filled out on
them. Within 30 days of this report, ensure that all wells have the above listed information permanently
affixed to them.
6. The landfill grass had been mowed and woody shrubs and trees had been removed since the last inspection. Good

7. Records were not reviewed during this inspection.
8. Per § 130A-309.05. (c) (1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored
at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through
sale, use, or reuse by December 31 of the same year."

During the inspection, a large amount of land clearing waste was observed being stored at the facility. During
the April 29, 2021 inspection, Mr. Daher said they had not ground land clearing waste since taking ownership of
the property and the waste has been accumulating since June 2020. Make sure you are grinding and using the
land clearing waste stored onsite, to be in accordance with the above reference General Statute.
