OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1402 (6) (A), "Small Type 1 facilities shall have an operations area less than two acres in
size and shall be limited to no more than 6,000 cubic yard material onsite at any given time, including finished
product."

During this inspection, it was determined that the unprocessed waste footprint was approximately 2.5 acres in size
and greater than 6,000 cubic yards. Several piles of mulch were also stored along the eastern side of the entrance
road. All mulch piles and unprocessed vegetative waste count towards the maximum 6,000 cubic yards of material
onsite at any given time. The operational area must be identified by markers that are visible from one to the
next. The waste must be processed and removed from the site.
B. 15A NCAC 13B .1404 (2), "A 100-foot buffer shall be maintained between all property lines and compost
areas for Type 3 and 4 facilities, 50-foot for Type 1 or 2 facilities."
15A NCAC 13B .1402 (5), "A 50-foot buffer shall be maintained between perennial streams and rivers and
compost areas."
Based on a review of Johnston County property records and this inspection, it appears that the YWN is mainly
located on parcels 13CO4022Y and 13C04021A. The boundary line between parcels owned by Mr. Weeks, classify
as a property line and the 50-foot buffer from the property line must be met. During this inspection, it was
recommended that Mr. Weeks either recombine the parcels into a large parcel or move the operational area so that
it is contained on one parcel to meet the property line buffer. During this inspection it was also determined that the
vegetative waste was stored directly adjacent to the three ponds located to the west. The vegetative waste must be
moved away from the ponds to meet the 50-foot buffer requirements.
C. 15A NCAC 13B .1406 (3), "Stormwater shall be diverted from the operations area."
And 15A NCAC 13B .0103 (e), "No person shall dispose or cause the disposal of solid waste in or on waters
in a manner that results in solid waste's entering waters or being deposited upon lands of the State."'
During this inspection, an area of standing water was observed in the center of the eastern portion of the land
clearing waste. Land clearing waste was found within the standing water. Mr. Weeks stated that the area of standing
water was the result of 5 inches of rain within a 24-hour period the week prior. The workers at the facility were also
in the process of processing the land clearing waste and attempting to remove the waste from the standing water.
During this inspection, Water Resources stated that the forested area behind the vegetative waste storage area was
flooded, and that waste was in water. The operations area must be graded to shed water after the land clearing
waste has been processed. All waste must be removed from water.
D. 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive." During
this inspection, several pieces of unacceptable wastes were observed within the land clearing waste. The
unacceptable wastes observed included a plastic 5-gallon bucket, metal wire, burnt and treated wood. An area of
construction and demolition (C&D) debris was identified within the waste stream near the eastern corner of the
waste. Mr. Weeks stated that the unacceptable wastes are removed from the waste stream before the waste is ground.
Ensure that the unacceptable wastes are removed from the waste stream and properly disposed of.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The site only receives wastes from Mr. Weeks other business enterprises.
2. The site is secured by an electronic locking gate.
3. The access road to the facility was identified to be ABC stone and ground brick and concrete. Numerous pieces
of painted brick and concrete, ground lumber, metals, plastics and iron piping were observed in the ground
concrete. A roadway and a large fill area were identified to the northeast of the operational area. The roadway

and fill area were found to have the comingled waste and ground brick and concrete. Several pieces of suspect
siding were observed in the large stockpile of crushed comingled waste, brick and concrete. It is recommended
that the siding be evaluated to ensure that asbestos is not present. All of the comingled crushed waste, brick
and concrete needs to be removed and properly disposed of. Only clean, unpainted concrete and brick may
be ground and used within the roadway. Please follow DEMLR and Johnston County guidance for
sedimentation and erosion control measures during the removal of the comingled waste.
4. 15A NCAC 13B .1406 (9)(a) "Signs providing information on wastes that may be received, dumping
procedures, the hours during which the site is open for public use, and the permit number shall be posted
at the site entrance." and 15A NCAC 13B .1406 (9)(c) "Signs shall be posted stating that no hazardous
waste, asbestos containing wastes, or medical waste may be received at this site." Please post the appropriate
signs at the entrance to the site.
5. 15A NCAC 13B .1406 (4), "Leachate shall be contained on site or treated prior to discharge. A National
Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC
02B prior to the discharge of leachate to surface waters." During this inspection, it was observed that a thick
layer of mulch had been applied over top of a non-native soil fill area to the east of the operations area. An area
of standing water with organic leachate was observed near the northeastern corner. The organic leachate must
be contained on the site and not allowed to enter waters of the State. It is also recommended that mulch be
applied at an ergonomic rate and disked in so that leachate is not allowed to form.
6. Land clearing waste is ground on -site and windrowed. The windrows should be monitored so that the mulch
does not spontaneously combust.
7. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 60 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 60 days to ensure issues noted in this inspection report have been addressed.
