A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0405(a)(11) states, in part, `All waste shall
be removed from the tipping floor, the truck loading bays, and from behindpush walls by the end of each day of
operation and disposed of in accordance with this Subchapter. "
Republic Services of North Carolina, LLC is in violation of 15A NCAC 13B .0405(a)(11) for failing to
remove all waste from the tipping floor and the loading bay at the end of each day of operation.

During this inspection, the tipping floor was observed to have a build up of waste, potentially indicating that the
floor was not being cleaned at the end of every workday. In addition, waste was observed to have accumulated
around the edges of the scales in the loading bay. On October 1, 2021, Ms. Hernandez provided photos taken at
the end of the workday that indicated the tipping floor had been cleaned, although a small amount of waste was
visible along one section of the push wall. Photos of the loading bay indicated that it had been swept out and
washed down; however, some waste was still visible around the edges of the scales. In a phone conversation
following the inspection, Derek Bouchard, Environmental Manager, Republic Services, stated that a pressure
washer will be required to remove the waste caught around the edges of the scales every day.
To achieve compliance, Republic Services of North Carolina, LLC shall immediately take all steps
necessary to ensure that all waste is removed from the tipping floor, the truck loading bays, and from
behind push walls by the end of each day of operation and disposed of properly.
B. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0405(a)(10) states, in part, "Windblown
litter from site operations discovered during the daily inspections or observed on adjacent properties shall be
picked up and containerized for disposal by the end of each operating day.... ..
Republic Services of North Carolina, LLC was in violation of 15A NCAC 13B .0405(a)(10) for failing to
pick up and containerize windblown litter from site operations discovered during the daily inspections and
containerized by the end of each operating day.
During the inspection, windblown litter was observed hanging from the damaged sheet metal rear wall on the
exterior of the transfer station building. Mr. Bizzell stated that he was aware of the problem and had positioned a
roll -off container under the damaged wall; however, he was not able to reach the windblown litter to remove it
from the outside of the building. Ms. Hernandez stated that she would have a lift brought to the facility so that
facility staff are able to remove the windblown litter daily. Windblown litter was also observed along the property
outside the perimeter fence line, at the entrance and along the Overdale Road frontage.
On October 7, 2021, Ms. Hernandez provided a photo that clearly showed all windblown waste had been removed
from the damaged rear wall of the transfer station building.
To achieve compliance, Republic Services shall take the following corrective actions:
• Immediately adopt procedures for removing and properly disposing of windblown litter from the
exterior of the damaged rear wall of the transfer station at the end of every operating day;
• Immediately collect and return all windblown litter from the Overdale Road frontage and from the
road frontage surrounding the facility entrance, and adopt procedures to ensure that litter is
collected from these areas at the end of every operating day.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. All photos included in this report were taken by Susan Heim on September 30, 2021, during the inspection,
unless otherwise specified.
2. The facility is an MSW transfer station, permitted to receive non -hazardous waste as defined in NCGS
130A-290(a)(35).
3. Facility operating hours are 4:00 am to 7:00 pm Monday through Friday, and 4:00 am to 4:00 pm Saturday.
4. Republic Services contracts with Endurance Environmental (formerly K. R. Drenth) to operate the transfer
station.
Records Review:
5. Copies of many of the facility records were provided for review outside the scale house.
6. A copy of the Permit to Operate and the current approved Operation Plan were available for review onsite.
7. Training records indicated that the following staff have current NCSWANA Transfer Station Operations
Specialist certifications:
• Sandra Lucas — completed class 9/22/21 but has not received her certificate as yet;
• Ethan Bicking —Certification No. TS-2018069 —expires 11/15/2021;
• Johnny Titus — Certification No. TS-2020089 — expires 11/19/2023;
• Brian Bizzell —Certification No. TS-2018071 —expires 11/15/2021;
• Joe Prestandrea — Certification No. TS-200510 — expires 4/5/2023;
• Lamard Crawford— Certification No. TS-2014037 —expires 6/13/2023;
• Steven Darcy — Certification No. TS-2020040 — expires 6/24/2023.
8. Transfer trailer inspection records were reviewed for July, August and September 2021 and found to be
complete. Log sheets note any specific issues found with each individual trailer as well as any comments
needed to clarify repairs needed. Mr. Bizzell stated that he had developed a routine rotation schedule

whereby two trailers are pulled from service and sent to the maintenance shop in Troy for evaluation. He
added that trailers found to have deficiencies or problems during the trailer inspections are taken out of
service immediately and moved to Troy for repair.
9. Copies of monthly facility inspection records were provided for January through September 2021 and
indicated that inspections are now performed by scale house operator, Sandra Lucas. All forms were found
to be complete. Comments concerning the extensive damage to the rear metal wall of the transfer station
building first appeared in the May 14, 2021 facility inspection report. (See Observed Violations section of
this report for additional information)
10. The following summary of waste tonnage received at the facility was provided for the current fiscal year:
• July 2021 — 11,968.62 tons;
• August 2021 — 11,715.40 tons;
• September 2021 — 10,569.70 tons (up to 9/29/21 only).
11. With regard to cleaning and maintenance records, Ms. Hernandez stated that the transfer station is pressure
washed on a quarterly basis. She added that the quarterly service was due to be performed within the next
week. 15A NCAC 13B .0405(a)(11), which became effective January 1, 2021, states, in part, "The
tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less
than once per month. The remaining areas of the site building including side walls and any
material storage areas outside of the building shall be cleaned with a pressure washer no less than
twice per year. Wash water generated from cleaning waste handling areas shall be contained and
treated as leachate. Cleaning and maintenance records shall be maintained and made available to
the Division. " Ensure that these cleaning requirements are enacted immediately, and that
records are maintained at the facility so that they are available for review upon request.
12. All liquids from the transfer station drain into an oil/water separator that is emptied as needed. Ms.
Hernandez provided records indicating that Safety-Kleen Systems, Inc. emptied the leachate in the oil/water
separator on 3/15/2021, 6/7/2021, and 9/2/2021.
13. The facility's approved Operation Plan (revised December 2020) requires that the facility randomly inspect
a minimum of 1 load of incoming waste per operating day. A review of the waste screening logs provided
for August and September 2021 found them to be incomplete — forms were not present for all operating
days. In addition, 15A NCAC 13B .0405(a)(8)(A), which became effective January 1, 2021, states, in
part, "Site personnel shall screen incoming loads weekly at a rate of no less than five percent of the
average daily waste tonnage reported in the site's annual report for the previous year. Waste
screening and rejected wastes shall be recorded in writing, and the records shall be kept on site
for no less than five years and shall be made available to the Division during a site inspection or
upon request. " Update the facility's waste screening procedures to ensure that the rate of
waste screening meets the requirements of 15A NCAC 13B .0405(a)(8)(A), based on the
average daily tonnage submitted in the FY2020-21 facility annual report. Note that this load
screening rate must be adiusted annuallybased on the most recent annual report.
Facility Inspection:
14. The front of the facility, from the entrance to the scale house, was observed to be well -maintained. A small
amount of windblown litter was observed along the Overdale Road frontage and in the area outside the
facility entrance. Ensure that windblown litter is collected and properly disposed of at the end of every
operating day. (See Observed Violations Section of this report for additional information)
15. Proper signage was observed at the facility entrance.
16. The site is secured by means of a chain link fence that surrounds the perimeter of the facility. Two locking
gates that are kept locked except during operating hours prevent unauthorized access.
17. A gap in the chain link fence that had been spotted during the previous inspection on January 12, 2021 had
been patched using zip ties. An inspection of this area of the fence found that several of the zip ties had
broken and the fence had opened up again. Facility staff mended the fence with a piece of chain link

fencing material following the inspection, and Ms. Hernandez provided a photo of the completed fence
repair following the inspection.
18. Facility access roadways are paved and were found to be in need of repair. Potholes were noted in the
approach area to the tipping floor and in the parking/storage area behind the transfer station building.
Ensure that repairs are made to the facility roadways as required by general permit condition 3 of
the 3416T-TRANSFER- permit to operate.
19. Traffic is managed by the scale house operator, who holds incoming loads at the scale house if the tipping
floor is full. The loader operator also directs trucks to the desired unloading location on the tipping floor.
20. A fire extinguisher and water hose were observed at the southern corner of the tipping floor and at the
entrance to the loading bay.
21. The inside of the loading bay walls was observed to be free from accumulated waste. Trash was noted on
the floor of the loading bay where it had fallen as trailers were being loaded. Mr. Bizzell stated that excess
waste is collected and removed throughout the workday as necessary to prevent it from becoming
windblown.
22. Surface leachate drains in and around the loading bay were found to be clear and functioning properly. The
main loading bay floor drain is recessed, and the concrete floor under the scales is sloped to direct the flow
of liquid to the drain. Accumulated waste was observed in the spaces surrounding the floor scales,
potentially indicating that these areas of the loading bay floor were not being thoroughly cleaned at the end
of every workday. (See Observed Violations section of this report for additional information)
23. The exterior wall of the loading bay had been previously repaired with sheet metal patches. During this
inspection, many of the patches were observed to have pulled loose from the wall, allowing waste to escape
the building. Mr. Bizzell provided a photo at the end of the workday following the inspection which showed
that all waste had been collected and removed from the northwest side of the building, as required by 15A
NCAC 13B .0405(a)(10).
24. The site is graded so that all liquid flows to the northwestern side of the property, where curbing directs it to
inlets. The inlets appear to be marked on site plan drawings as storm drains. However, discussions with
Derek Bouchard during the previous inspection on January 12, 2021 indicated that these drains connect to
the sanitary sewer. Please provide plans and information to the Solid Waste Section that explain how
surface water and leachate are separated at the site.
25. Five empty transfer trailers were staged in the parking/storage area behind the transfer station building.
Each trailer was inspected and found to be in good condition, with no holes or leaks visible. Mr. Bizzell
stated that he had developed a regular maintenance schedule for the trailers, and that trailers with damage
found during the required inspections were pulled from service immediately.
26. The rear parking/storage lot was observed to be clean, and windblown litter appeared to be well managed in
this area.
27. An inspection of the exterior of the transfer station building found a large area in the rear wall where the
metal sheeting had become unfastened from the superstructure, leaving a gap where windblown litter was
visible hanging out of the structure. Mr. Bizzell stated that he was aware of the issue but was unable to
reach the litter. Ms. Hernandez stated that she would have a lift brought to the facility so that the waste
could be cleaned up. (See Observed Violations section of this report for additional information.)
28. The transfer station was accepting waste during the inspection and tipping floor operations were observed.
However, what appeared to be a small shrub was visible in the waste pile, and facility staff were directed to
remove it for proper disposal at a facility permitted to accept vegetative waste.
29. The tipping floor had a build up of waste that made it difficult to inspect. While joints in the paving
appeared to show signs of wear, no large cracks or holes were visible.
30. A leachate drain is cut into the push wall near the northwest corner of the tipping floor that allows liquid to
flow to the loading bay where it is captured by the leachate collection system. Some waste had accumulated
in and around the wall drain, and a pool of leachate had begun to collect along the push wall. Ensure that
all leachate drains are kept clear and functional throughout the workday.
31. A facility staff member was observed conducting a waste screening during the inspection. A residential
collection vehicle was directed to unload slowly on the tipping floor away from other waste. By having the
driver pull away slowly as unloading proceeded, waste was spread out sufficiently to be able to be inspected

easily. No unacceptable waste was found in the load, and the waste screening log sheet was completed and
filed in the scale house.
32. Damage to the inside walls of the transfer station was visible in several areas. The large separation of the
metal sheeting on the back wall that had resulted in windblown waste leaving the rear of the building was
evident on the northwest end of the tipping floor. Additional damage to the interior sheet metal was
observed along almost the entire length of the rear wall, and a portion of the right wall, near the northeast
corner of the building had also been pushed in, causing a void where waste could accumulate behind the
concrete push wall. In addition, deflector panels that help direct waste into trailers in the loading bay are
bent and crumpled, causing waste to fall outside the trailers and also to adhere to the deflector panels
themselves. Ensure that the transfer station building is maintained to prevent litter from escaping the
building.
