You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each
violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further
relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

STATUS OF PAST NOTED VIOLATIONS (List all noted last audit):

AREAS OF CONCERN AND COMMENTS:
1. The facility consists of a C&D and MSW transfer station, tire collection site, white goods collection site, metals
collection site, and other recyclables collection area.
2. The current Permit to Operate was issued on April 11, 2006. General Condition 3 of Permit No. 22-02-T states: This
permit is subject to review in accordance with 15A NCAC 13B .0201(e) on or before April 12, 2011. On or before
April 12, 2011, the owner shall submit a request for review and shall update pertinent facility plans including
the facility operation and waste screening plans.
3. The service area for this facility is Clay County.
4. Collected waste is transported from this facility to the Pine Bluff Landfill, Cherokee County, Ga.
5. Operational records for the facility are maintained at the Clay County Solid Waste offices located on Hilton Road (SR
1148) near Hayesville.
6. The facility received 440.84 tons of waste during the month of May 2008.
7. Hours of Operation: Monday-Saturday: 8:00 a.m. to 5:00 p.m.
Wednesday: 8:00 a.m. to 12:00 p.m.
Closed Sundays
8. A Review of training records include, but not limited to the following SW ANA certifications for all facility areas of
operation:

9. Waste screening records were reviewed. During the month of May, screenings were done on 5/7 (2,560 lbs), 5/19 (680
lbs), 5/20 (2,060 lbs) and 5/28 (1,840 lbs). Total pounds screened were 7,140.
10. Tire forms were reviewed. Staff need to make sure that all forms are completely filled out.
11. The tire collection area was observed. This is a semi-trailer and all tires were in the trailer.
12. The tipping floor was observed. Staff on hand was doing a good job of directing the public in unloading of waste and
sweeping the floor.
13. The yard waste area has previously been noted in this audit however it is actually located at the old landfill (20-01)
across the road. Details of findings are noted in that inspection.
14. The white goods area is located in a covered shed with a concrete floor. Freon is removed by staff and then moved
against the wall.

15. Other materials recycled are plastic, empty propane tanks, aluminum cans, steel cans, cardboard and newspaper. These
are collected in separate containers.
16. Used batteries were stored on a pallet in an upright position.
17. There are two tanks that receive used oil and antifreeze. These tanks are covered but setting on the ground.

Yard Waste Facility Notification
Dear Mr. Hogsed,

The Division of Waste Management, Solid Waste Section, has received your Yard
Waste Facility Notification. However, we require a resubmission of this form with some changes
and further explanations in order for us to process this notification.
In order to be classified as a Yard Waste Facility you must be composting. Currently on
item number 12 you state "Natural." The composting required for your facility must minimally
include the formation of windrows and annual turning of leaves. The grass clippings and leaves
should be separated from the rest of the yard waste you are accepting, formed into windrows
and at a minimum turned annually. If you are able to pile your leaves and grass clippings, form
windrows, and annually turn the leaves your facility would qualify as a Yard Waste Facility. All of
the other items you list as waste received can be ground with a tub grinder into mulch without
the requirement of a Treatment and Processing Notification.
We understand some of these composting requirements may be new to you as we are
more heavily reviewing the notifications submitted. If you need assistance with establishing the
proper composting requirements for a Yard Waste Notification you may contact the
Environmental Senior Specialist for Clay County, Troy Harrison, in the Asheville Regional
Office, at 828-296-4701 .
We will process your Yard Waste Facility Notification as soon as we receive the updated
form with the above modifications. Enclosed is the form you have submitted for your reference
and a new form for submission. We will keep the a copy of the original submittal so our records
show your submission was received April 24, 2008. If you have any questions in this matter
