STATUS OF PAST NOTED VIOLATIONS:
A. 15A NCAC 13B .0405(11) states in part"... all waste shall be removed from the tipping floor at the end of the
operational day and disposed of in accordance with this Subchapter...."
Jackson County is in violation of 15A NCAC 13B .0405(11) for failing to remove all waste from the
tipping floor at the end of each operational day. On the morning of October 1, 2021 at 6:30 am, a pre-
operational inspection of the transfer station was conducted to ensure that all waste was being removed
from the tipping floor as required by 15A NCAC 13B .0405(11). During the inspection construction and
demolition waste was observed on the tipping floor that had been left there from the previous operational
day.
To correct the violation, Jackson County must remove all waste from the tipping floor at the end of each
operational day and dispose of it in accordance with 15A NCAC 13B .0405. Additional inspections will be
conducted to ensure that the tipping floor is clean at the end of each operational day.

OBSERVED VIOLATIONS:
No additional violations were observed during this inspection.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on October 1, 2021.
2. On the morning of October 1, 2021 at 6:30 am, a pre -operational inspection of the transfer station was
conducted to ensure that all waste was being removed from the tipping floor as required by 15A NCAC 13B
.0405(11). During the inspection construction and demolition waste was observed on the floor that had been
left there from the previous operational day. All waste must be removed from the tipping floor at the end of
each operating day. (See Status of Past Noted Violations Section of this report.)
3. Staff had arrived at the facility early and were actively loading the waste that was left overnight into a transfer
trailer at the time of the inspection. Mr. Thomasson confirmed that waste had been left on tipping floor
overnight.
4. Following the inspection, facility security camera footage was made available by Chad Parker, Public Works
Director. The footage indicated three empty trailers were available at the facility at the close of the operational
day on September 30, 2021, when waste was left on the tipping floor overnight.
5. At 6:52 am, waste was also observed around the scales in the loading bay. Ensure that all waste is removed
from the loading bay at the end of each operating day as required by 15A NCAC 13B .0405
