Box 175 Jackson Springs, NC 27281 PARTICIPANTS: David Powell, NCDEQ – SWS Andrew Hammond, NCDEQ – SWS Todd Williams, Lucky Lady LCID STATUS OF PERMIT: Expired – site inactive PURPOSE OF SITE VISIT: Technical Assistance - closure STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Section met with Lucky Lady LCID representative Joel Williams and equipment operator Brian Caddel. Mr. Williams is son of original owner, and the property is currently owned by Ampersand Field LLC. Registered agent for this LLC, is Mr. Williams Sister, Dawn Wallace. 2. Facility has ceased operations but has not had an engineer certify final cover as of the date of this inspection. Buffers will need to be confirmed and cover depth to meet rules. Closure and Post Closure Care Rule 15A NCAC 13B .0567. Site does have good vegetative cover. Any repaired areas will also need vegetation reestablished. 3. Section staff met onsite to follow up and provide technical assistance to the closure activities ongoing at the landfill. Mr. Powell explained to Ms. Williams over the phone and Mr. Williams onsite, that he could explain rules and expectations but guidance on how to proceed or operations etc., would need to come from a consultant or engineer. Mr. Caddel is removing trees and large brush currently from the landfill foot print with heavy equipment and windrowing in the buffer. Some exposed waste has been discovered and will need proper cover and sloping. Some areas of landfill need slope work as well. This was discussed while riding the landfill and walking some areas. All waste should be appropriately buffered, with proper cover and 3:1 sloping when complete. Windrowing removed trees/shrubs in buffer. Exposed waste and slope needing cover/repair. Communicate with Tim LaBounty, Engineering Supervisor with Division of Energy, Mineral, and Land Resources (DEMLR), on any requirements DEMLR may have with this site/closure. Mr. Williams stated he would get with an engineer to certify LCID LF and will submit to Section, David Powell, along with a new PLAT map confirming buffers by a land surveyor. Obviously, if any buffers are not met them waste will need to be moved outside of the buffer and covered and sloped, correctly, according to rule. Discussions onsite with Mr. Williams were that 60 days would be reasonable timeframe for completing the closure and submitting the documentation. 7. Corrective measures are necessary as a result of this inspection and shall be completed within ~ 60 days’ receipt of this report.
