PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS 1. At this facility there are two notified LCID landfills, N1089 upfront, and N1104, one-acre site, in rear. Site has been closed to the public and is just used for Harris Trucking. According to the new LCID Rule 15A NCAC 13B .0563(6), effective January 1, 2021, the notification facilities has to be either closed out or converted into a permitted facility by January 1, 2026. 2. Harris Trucking was actively pursuing a full LCID permit from the Solid Waste Section. However, what was submitted was not a complete permit application. After meeting onsite, Harris Trucking is still considering a new permitted site depending on meeting with their engineers, whom have been hard to contact. It is suggested Harris Trucking reach out to Solid Waste Permitting on how to proceed if wishing to pursue further. N1104 back NLCIDLF one-acre site The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The notified sites were located on separate parcels and meet all required property line buffers back in 2019. Sites appeared to still be in same shape with good vegetative cover mostly. 4. Soil cover was staged on the front NLCIDLF N1089, which is one currently being used. N1089 has erosion rills needing to be fixed and sloped. Unacceptable waste was not observed during this inspection at either site, good job. 5. The edge of waste markers (EOW) were in place on some corners. Mr. Powell discussed with reinstalling the corner markers that were missing in correct locations and upgrading for high visibility. Suggest tall white PVC pipe. One should be visible to the next. 6. On top of the NLCIDs there were ruts in places. Ensure proper drainage is in place to prevent water from ponding on and around the LCID foot print. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 N1089 ruts and slope need fixing to shed storm water and allow standing water. 7. Some exposed waste was visible on top of the front N1089, that was newer and some older waste around bottom side slopes of N1104. Cover and slope accordingly. 15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. N11004 exposed waste bottom of side slope. EOW marker needed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 8. Side slopes shall be maintained at no steeper than a 3 to 1 ratio. After proper covering and fixing, be sure and slope appropriately, while keeping waste inside the 2 acre EOW and buffers. N1104 needs slope fixed and address low spots which will hold water adding to potential leachate. 9. If owners choose to close the NLCIDLFs, then a final inspection will be needed AFTER meeting closure rules and addressing all issues in previous inspections. A copy of the 15A NCAC 13B .0567 CLOSURE AND POST-CLOSURE CARE REQUIREMENTS FOR LCIDLFS was emailed to Chad Harris on 10/4/2021. 10. Corrective measures are necessary as a result of this inspection and shall be completed within 30 days’ receipt of this report.
