PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B .1626(2) states in part, "the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals, if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. Alternative materials of an alternative thickness (other than at least six inches of earthen material) may be approved by the Division if the owner or operator demonstrates that the alternative material and thickness control disease vectors, fires, odors, blowing litter, and scavenging without presenting a threat to human health and the environment, in accordance with 40 CFR Part 258.21. " Davidson County was found to be in violation of 15A NCAC 13B .1626(2) during the August 24, 2021 inspection for failing to cover all disposed waste with either 6" of soil or a tarp at the end of each operating day. While cover in the active area of the landfill was found to have improved since the previous inspection, exposed waste was observed in the operations area and windblown litter was noted in the unused portion of Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA OepaNnanf of Environmental Oualiy Solid Waste Section the new cell. However, photos were provided by Tim Phelps following the inspection that confirmed the operational area surrounding the working face had been completely covered at the end of the workday, and windblown litter had been collected and disposed of properly. Therefore, this violation is considered to be resolved. In a conference call on September 29, 2021, Mr. Brushwood and Mr. Phelps presented an operations area work plan designed to prevent windblown litter and to minimize the opportunity for exposing waste throughout the workday. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The purpose of this inspection was to follow-up on the cover violation observed in the operations area during the previous inspection on August 24, 2021. 2. Photos included in this report were taken by Susan Heim on September 28, 2021, during the inspection, unless otherwise indicated. 3. During this inspection, facility staff were observed dressing the adjoining tie-in slopes of the inactive area of Phase 2. Mr. Phelps stated that the slopes were being prepared for seeding that would take place sometime in the next week or two. While some small rills were noted, especially on the northern portion of the tie-in slope, the rills were shallow, and no exposed waste was observed in the erosion rills. In general, the areas to be seeded appeared to be in good condition. 4. Some windblown litter was noted in the unused portion of the new cell and in and around the operations area. A facility staff member was observed collecting litter during the inspection. Please ensure that all windblown litter is collected and returned to the working face for disposal at the end of every workday. 5. Although still somewhat wet and spongy from the continual rain events that had occurred in previous weeks, the operations area was stable and afforded sufficient space to allow vehicles and equipment to maneuver safely. Some exposed waste was noted throughout the operations area, and Mr. Phelps confirmed that the entire area would be adequately covered with soil after operations concluded for the day. (See Status of Past Noted Violations section of this report for additional information Ensure that all waste is covered at the end of every operating day, as required by 15A NCAC 13B .1626(2). 6. The working face was found to be small and well controlled, and waste was being compacted as it was received. It was observed that some vehicles were leaving the tipping area before cleaning out their vehicles and closing their tailgates, thus strewing waste along the access roadway where it was being packed down into the operational cover. Some options for preventing this issue were discussed with Mr. Phelps during the inspection. 7. Although the vegetated areas of the inactive portions of Phase 2 were not inspected, Mr. Brushwood addressed the issue of the woody growth and small trees that had been observed during the previous inspection on August 24, 2021. He stated that a contractor would be coming to bush hog the landfill within the next month, and that the woody vegetation would be removed during that process.
