Recorded in Vance County Register of Deeds: Book 1323 — Page 483. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." PROGRESS MADE: During this inspection, it was observed that the side slopes were being reworked to meet the three horizontal to one vertical requirement. The side slopes were in the process of being moved away from the edge of waste markers and properly sloped. Mr. Darden stated that the side slopes would be covered with soil once they have been compacted and sloped. Continue to slope and cover the side slopes. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. G.S. 130A-310.65.9' PROGRESS MADE: During this inspection, the top of the LCID had been covered with soil. Mr. Darden stated that the side slopes would continue be covered when they were properly sloped. At the time of this inspection, the waste at the facility has not been covered in quite some time. Continue the progress to cover the waste and ensure that the waste is covered with 6 inches of soil monthly or when the working face reaches one acre in size, whichever occurs first. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The access road is of all-weather construction and appears to be properly maintained. 2. The gate was not locked, and Mr. Scott Davis was onsite at the time of this inspection. 3. The site has adequate signage posted on the gate at the entrance. The sign had been removed from the gate and posted on a fence post at the entrance so that it is visible when the gate is open. 4. 15A NCAC 13B .0564 (6) (b), "Buffer Requirements: A site shall maintain the following buffer requirements: ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." The LCID currently occupies the 2-acre parcel (PIN 0315 02010), which is land locked by a 13.1-acre parcel (PIN 0316 02005). The waste appears to be contained within the 2-acre parcel. Due to the separate parcels, the property line buffers are not being met. In order to meet the buffer requirements, you must either recombine the two parcels, 3016 02010 and 3016 02005, or move the waste away from the property lines of the 2-acre parcel to meet the 100-foot setback. 5. Permanent edge of waste markers were observed during this inspection. The edge of waste marker near the northeastern corner could not be found during this investigation. Lush vegetation should be mowed and maintained to ensure that the markers can be seen from one to the next. Remove any trees growing within the landfill boundary. 6. The waste stream observed appeared to be relatively clean. Metal had been separated from the waste stream and placed off to the side for proper disposal. Some plastic bags were observed along the southern side slope. The bags were removed using the excavator and properly disposed of during the inspection. Good job! 7. The previously identified painted block, glass, and plastic had been removed. Mr. Davis provided Ms. Thompson a copy of the weigh ticket for the disposal of the waste. 8. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." A partial access road was identified during this inspection. Several areas were overgrown with vegetation at the time of this inspection. The overgrown vegetation along the access road should be mown to allow for proper access to all sides of the LCID. 9. Digital pictures were taken during the inspection. 10. Continue the necessary corrective measures at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow- up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
