Field still closed because fescue not planted in the field. OBSERVED VIOLATIONS: 1) Wheat and ryegrass had been planted on Fields 5a and 6a. This is a violation of Rule .0842(a)(17) that states “approved nutrient management plans shall be followed.” The nutrient management plan has fescue as the crop for Fields 5a and 6a. Fields 5a and 6a continue to be closed to septage applications until the fields are reestablished in fescue as noted in the nutrient management plan. Call me when fields are reestablished in fescue. Fields must be inspected prior to any septage applications. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1) The required signage was present before you get to the site. Some vegetation staring to cover the sign. Need to keep the vegetation cut so that it does not block the sign from being read. 2) The access road was in good shape. 3) For the most part, the required markers were present. Need to place the marker for the northeast corner of Field 5b. 4) No septage applications noticed outside of the permitted boundaries of the fields. 5) Applications appeared to follow the nutrient management plan. No spot dumps or thick applications noticed. No signs of septage applications to Fields 5a and 6a. 6) Fescue present on Fields 5b and 6b. Fields 5b and 6b had been cut for hay. Bales still present on the fields. Be sure that the bales are removed from the site and not just stored along the edges of the field to rot. Wheat and ryegrass present on Fields 5a and 6a. Fields 5a and 6a continue to be closed until fescue has been reestablished as covered within the nutrient management plan. Fields must be inspected prior to any septage applications. 7) No objectionable odors noticed today. 8) No issues noticed with the setbacks. 9) Received soil report of the soil samples taken in the fall.
