OBSERVED VIOLATIONS: 1) When I arrived at the site, it was raining and septage was being applied to the field. Applying septage in the rain is a violation of Permit Condition 10 which states “Septage shall not be applied during any precipitation event, or if there is standing water on the soil surface, if the soil surface is frozen, or if the soil surface is snow covered. The Permittee shall consider pending weather conditions when making the decision to land apply in order to prevent any discharge of septage outside of the permitted boundary.” The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1) The required signage was present along access roads. Be sure to keep the vegetation down around the signs so that they are visible. See picture below. 2) Access road ok. 3) All markers appeared to be up. 4) No septage discharges noticed outside of the permitted boundary of the field. 5) When I arrived at the site, it was raining and septage was being applied to the field. Applying septage in the rain is a violation of Permit Condition 10 as stated in “Observed Violations” above. The problems with applying in the rain are you increase the potential for ponding and runoff of septage and for creating ruts. Ponding of septage, runoff of septage outside of the permitted boundaries, and ruts greater than 3 inches in height are all violations of Septage Management Rules. No runoff or ponding of septage observed. No ruts observed. Talked to Ollie about applying septage in the rain. 6) Fescue stand ok. 7) pH of septage not checked. 8) No objectionable odors noticed. 9) Setbacks appear to be as permitted. 10) Received a copy of the soil sample taken last fall of the field.
