Landfill recorded March 7, 1994. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: Date of Last Inspection: August 6, 2021 A. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." At the time of this inspection, uncovered land clearing waste was observed around the edges of the clearing. One pile of broken concrete and one pile of asphalt were observed near the edge of the clearing. The waste was overgrown with vegetation, therefore, making it difficult to determine the extent of the uncovered waste. Deep erosion rills were noted along the western edge of the waste. Ensure that the erosion rills are repaired and that the waste is covered with no less than six inches of soil monthly or when the working face reaches one acre in size. Remove the overgrown vegetations to allow for proper inspection of the landfill. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The access road is of all-weather construction and appears to be properly maintained. 2. 15A NCAC 13B .0566 (6), "The site shall be secured by barriers such as gates, chains, berms, and fences to prevent unauthorized access." During this inspection, the site was not secured by such methods. 3. 15A NCAC 13B .0566 (14), "A sign shall be posted at the entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site." No signage was posted at the entrance of the site. 4. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not visible during this inspection. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two -acre disposal boundary. 5. The waste stream observed appeared to be clean with no visible unacceptable wastes. However, if unacceptable wastes are observed, they need to be removed and properly disposed of. 6. Several areas were overgrown with vegetation at the time of this inspection. The overgrown vegetation should be mown to allow for proper inspection. 7. Digital pictures were taken during the inspection. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
