OBSERVED VIOLATIONS:

A. 15A NCAC 13B .0566 (3), "All waste shall be covered with a minimum of six (6) inches of soil monthly, or
when the working face reaches one (1) acre in size, whichever occurs first."
During this inspection, the piles of broken concrete and asphalt previously identified in the June 2021 had not been
covered. All waste MUST be covered with a minimum of six (6) inches of soil monthly, or when the working
face reaches one (1) acre in size, whichever occurs first.
B. 15A NCAC 13B .0563 (1), "The site shall accept only yard waste and inter debris for disposal."
Concrete with metal rebar and a plastic corrugated drainage pipe were identified along the northern edge of the
working face. As noted in the April 2021 and June 2021 inspection reports, metal is not inert and must be cut flush

with the concrete and properly disposed of. The plastic corrugated drainage pipe and any additional
unacceptable wastes must be removed and properly disposed of.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is a notified land clearing and inert debris (LCID) landfill. The disposal area for the notified LCID
landfill shall remain under two (2) acres.
2. The gate was damaged and not locked at the time of this inspection. It is recommended that a gate be installed
closer to Hwy 903, if allowed, to help deter damage to the gate and unauthorized access.
3. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Sections
.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The
markers shall be of height and spacing so that they are distinguishable from the surrounding landscape,
and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not
visible during this assessment. Permanent edge of waste markers need to be installed to identify and to ensure
that the waste footprint is under the 2-acre limit and that the 100 foot buffer from the property lines is
maintained.
4. In accordance with 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall
not exceed a ration of three horizontal to one vertical at any time." The side slopes were identified to be
steeper than 3:1. The side slopes need to be properly covered and graded.
5. Areas that will not have additional wastes placed on them for three months or more, but where final
termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover
sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or
other stabilizing material. The Division may require further action to correct any condition that the
Division determines may be injurious to the public health, or a nuisance to the community.
6. The southern portion of the site needs to be mowed to allow for proper inspection. Woody vegetation was
found to be growing in the southern portion of the notified LCID landfill and needs to be removed.
7. Digital pictures were taken during the inspection.
8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 30 days to ensure issues noted in this inspection report have been addressed.
