Updated LCID Landfill Notification recorded with the Alamance County Register of Deeds July 13, 2017 Status of the Land Clearing and Inert Debris Landfill (LCID) Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On September 15, 2021, Chuck Kirchner met with Laura Morrow to conduct a comprehensive inspection of the J.L. Morrow, Jr. Construction Landfill – LCID Landfill located at 4423 Mebane Oaks Road in Mebane, Alamance County. 1. The facility is a land clearing and inert debris (LCID) landfill owned by J.L. Morrow, Jr. Construction Company. 2. The facility is not open to the public without appointment. 3. The LCID landfill is < 2 acres. 4. The landfill boundary is required to be designated. Ensure boundary markers are in line of sight and maintained as needed. 5. Per 15A NCAC 13B .0566(3), “Solid waste (working face) shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 6. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 7. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 8. Some logs observed on the east side of the landfill appear to be set aside for firewood. 9. Excavation, grading, and fill material side slopes shall not exceed three to one (3:1). 10. A ready supply of soil shall be available for cover material. 11. There was no indication of erosion or runoff observed during this inspection. 12. The LCID landfill is also a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS01-009. 13. The TDDSS is not currently activated. 14. The facility has an all-weather access road. 15. The facility is monitored by video. 16. The facility has signage. 17. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified.
