Renewal YWN submitted on May 26, 2021. PURPOSE OF SITE VISIT: Follow-up to June 3, 2021 Notice of Continuing Violation. NOTICE OF VIOLATIONS A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 Facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including finished product." PARTIALLY RESOLVED: During the inspection, the land clearing waste had been windrowed. Roy stated that he had measured out the under 2-acre operation area, however, he had not placed the boundary markers. Roy stated that the markers would be installed within the next few weeks, and he would provide me with photographs of the markers. Mr. Harper stated that the under 2-acre operation area would include the windrowed land clearing waste and mulch stockpiles. Please provide photographs of the locations of the boundary markers once they have been installed. Ensure that the on -site material is under 6,000 cubic yards at any given time and under the 2-acre size limit. OBSERVED VIOLATIONS: None. Page 1 of 3 NORTH CAR()LINAD_E Q�� OepaNnent W Envimnmenbl Wel� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The previously identified stockpiles of mulch in the southeastern corner of the site have been removed. The area has also been graded so that water is shed from the area. 2. The previously identified stockpile of soil along the northern edge of the operation area had been screened and sold as topsoil. A stockpile of soil with some roots was identified to be adjacent to the land clearing stockpile. A second stockpile of soil was identified to the south of the windrows. Roy was in the process of screening the roots from the second soil stockpile. The roots would be returned to the windrows and ground. The soil would be sold as topsoil. Once the second stockpile has been screened, additional land clearing waste would be windrowed in that location. 3. Two piles of ground and dyed mulch were located within the operation area. Please remember that all waste and finished material counts toward the 6,000 cubic yards. 4. The area of concrete and brick debris, located to the east of the pond, had been removed, graded, and mulched. No unacceptable wastes were observed. Good Job! 5.
