Regional Disposal is in violation of 15A NCAC 13B .0405(11) for failing to remove all waste from the tipping floor at the end of each operational day. During the early morning inspection conducted on September 15, 2021, waste was observed on the tipping floor. Scale house operator, Danielle McBride was asked if any loads had been received that morning and she indicated that no loads had come in so far. Kurt English was asked if any waste had been left on the tipping floor overnight and he stated that there had been waste left on the tipping floor. When asked why waste was left on the floor, he stated that staff had run out of time and trailer space. Page 1 of 5 D_E FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management �aAT��ARo��NA � °°�` ItItE111111°�'°"��� Solid Waste Section To correct the violation, Regional Disposal must remove all waste from the tipping floor at the end of each operational day and dispose of it in accordance with 15A NCAC 13B .0405. Additional inspections will be conducted to ensure that the tipping floor is clean at the end of each operational day. MSW Left on Tipping Floor Overnight The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on September 15, 2021. 2. Construction and demolition waste is transferred to the Whitestone Valley Construction & Demolition Landfill in Talking Rock, Georgia. MSW is sent to the Pine Bluff Landfill in Ballground, Georgia. 3. The facility is open Monday through Friday, 8:00 am to 4:00 pm and is closed on Saturday and Sunday. Records Review 4. The permit and operations plan were available for review upon request. 5. Tonnage records were reviewed from the FY2020-2021 Facility Annual Report. The facility started receiving waste on January 4, 2021 and received 1,452.169 tons of material from January 4, 2021 to June 30, 2021. Certified Transfer Station Operations Specialists: • Cody McBride • Kurt English • Jacob Anderson • Gavin Killian • Josh Lovingood • Bronson Newton Waste screening forms from January 4, 2021 to September 14, 2021 were available for review. The forms showed the final disposition of any unacceptable waste that was encountered. It appeared that additional waste screenings need to be conducted to meet the requirements of 15A NCAC 13B .0405(8)(A). 15A NCAC 13B .0405(8)(A), which became effective January 1, 2021, states, in part: "Site personnel shall screen incoming loads weekly at a rate of no less than five percent of the average daily waste tonnage reported in the site's annual report for the previous year ... Waste screening and rejected wastes shall be recorded in writing, and the records shall be kept on site for no less than five years and shall be made available to the Division during a site inspection or upon request." Please ensure sufficient waste screenings are being conducted to satisfy the five percent of the average daily tonnage rate requirement. Operations Inspection of the Transfer Station (2003-TRANSFER-2020) 8. Windblown litter was well managed at the time of inspection. 9. The transfer station consists of a pre-engineered building. MSW is dumped on the north side of the tipping floor and C&D waste is placed on the south side. 10. The facility does not have a loading bay; waste that is deposited onto the tipping floor is placed into transfer trailers via a material handler. 11. During the early morning inspection conducted on September 15, 2021, waste was observed on the tipping floor. When asked why waste was left on the floor, he stated that staff had run out of time and trailer space. All waste must be removed from the working face at the end of each operational day. See Observed Violations Section of this Report. 12. The tipping floor and push walls were in good condition at the time of the inspection. 13. No unapproved material was observed on the tipping floor. The facility has two roll off dumpsters on the tipping floor and use them to remove and store any metal that is found in incoming loads. 14. One transfer trailer was parked on the loading bay floor and it appeared to be leak resistant. 15. The trench drain at the entrance to the facility was clear and appeared to be functioning as designed. Other Comments 16. The facility is permitted to receive land clearing waste and wooden pallets constructed of unpainted and untreated natural wood. 17. A pallet with cardboard attached, some engineered wood (plywood) and two pieces of painted wood were observed in what appeared to be a recently dumped load of land clearing waste. Remove the unapproved material from the stockpile. 18. During the November 19, 2020 pre -operations meeting, the land clearing material from the construction of the transfer building was discussed. It was agreed upon that the existing land clearing material that was piled along Trull Road on November 19, 2020 to prevent unauthorized access could be left in place. Additionally, it was agreed that any land clearing debris that was accepted for treatment and processing could not be added to the existing material on the berm and would have to be stored separately and managed in accordance to the permit and approved operations plan. No additional land clearing waste can be added to the berm. All incoming loads of land clearing waste shall be stored separately. Adding additional waste to the berm would be considered a disposal activity and a violation of the permit to operate and operations plan. 19. Land clearing waste that has been brought into the site has been placed up against the berm on the northwest side of the property. Per the Permit to Operate, Part VII: Miscellaneous Solid Waste Management, number 22: "Wastes received, and product stored, shall be maintained in reasonably sized piles with adequate fire breaks Page 3 of 5 D_E FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management �aAT��ARo��NA � °°��`°`It ° "°m° °°��� Solid Waste Section and lanes in accordance with the approved operational plans and the pertinent rules." Ensure that incoming land clearing waste is stored with adequate space between the berm and stockpile in case access for firefighting equipment is needed.
