Notice of Violation July 6, 2021
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566 (1) - The site shall only accept those solid wastes that it is permitted to receive.
At the time of this inspection, there was unapproved waste visible and soil containing MSW waste was still
present. During last inspection the soil that was added for a seep contained MSW trash comingled in it and was spread out in the NLCID. Robeson County was instructed to remove this soil and dispose in the MSW landfill and it has not been removed. Location is about the center of the NLCID on east side of the covered
waste.

2. 15A NCAC 13B .0566 (9) Solid waste shall not be disposed of in water.
At the time of this inspection, waste was discovered along east side pushed into water. Area had been mined and is now grown up and holding water. Pull exposed waste out of water and from EOW and back to the inside of landfill approved area and cover appropriately.
Some uncovered/exposed waste pushed into wet area. Should be brought back inside EOW and covered properly.

ADDITIONAL COMMENTS
1. Purpose of visit was to do a follow up inspection on the Robeson County Landfills and the recent Notices of Violation Corrective Actions. Mr. Powell revisited the site on 9/15/2021 to look at the progress.
2. NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3) acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes.
3. Although there was an additional EOW marker, there was not enough to determine the limits of the approved 3-acre disposal area clearly. Additional Edge of Waste markers (EOW) should be visible on at least the four
corners of the original 2-acre notification and then the four corners of the one-acre extension. Proper installation of EOW markers and the presence of an attendant should aid in waste being managed within the limits of the approved area. EOW markers should be visible from marker to marker.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. Roadway waste that was outside the western EOW in the road, has been moved, covered and sloped. Good job.

Looking ~ south along road, NLCID on left. 5. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. County staff have requested a Permit for LCID. Permits and approved operations plans must be followed. Contact Information for Robeson County Section Engineer Project Manager Benjamin Jackson – Benjamin.Jackson@ncdenr.gov / 919 -707 – 8234 office. Recommend that County staff follow up on the status of the permit application.

6. There was a fair amount of waste onsite that either needed to removed, some taken out of water, or compacted then covered and sloped appropriately. Onsite discussions were that a contractor had recently been hired, BMCO, to assist the Landfill with its operations. 7. Staff issues aside, it is Robeson Counties responsibility to operate the landfills in accordance with the rules. Failure to bring the site into compliance may result in enforcement actions up to and including fines, or additional requirements for the facility. The County should consider all options including if necessary, contracting out the operation of this site or possibly modifying the hours of operation until staffing and equipment are sufficient to maintain compliance. 8. Mr. Powell revisited the NLCID on 9/15/2021 to check on progress. Unapproved waste was being removed
upon inspection. There was a significant amount. MSW waste mixed soil was still present along the east side of the NLCID. This needs removal ASAP. More cover has been added although there was waste present that was uncovered during last visit, 8/12/2021. Waste shall be covered when working face reaches one half acre or waste has been onsite for 30 days. There was a small amount of sheetrock waste on top the LCID that had cover, SE side. Please remove and dispose of properly. Ms. Kristina indicated the equipment was down for repairs during inspection.
9. Corrective measures to bring this facility into compliance should be complete within ~ 30 days’ receipt of this inspection report. A follow up compliance inspection will be conducted by Solid Waste Section Staff to check the conditions for compliance Please contact me if you have any questions or concerns regarding this inspection report.
