The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff Amanda Thompson and David Powell visited site on August 4, 2021, with Mr. David Conard onsite.
Staff walked the site, discussed operations over the years, and saw what’s currently onsite. Staff needed to review records for determining status of NLCID and YWN on this property, which was done after the 8/4/2021 visit. Mr. Powell returned with Drew Hammonds on 8/24/2021, Mr. Conard could not attend, to look at site and discuss
options moving forward.
2. Mr. Powell reviewed Solid Waste Section records, which indicated the Unpermitted Solid Waste Disposal Site (Land Clearing Debris) was closed on 1/5/2000. The original notification was submitted by Sarah Margaret Luck, the previous landowner, on May 7, 1996. Further, landfills authorized under 15A NCAC 13B .0563 are not transferrable with the sale of the property. Moore County records indicate that the property containing the landfill was sold to Mr. Conard 11/20/1996, thus making the original notification filed by Sarah Margaret Luck, former property owner, invalid. There are no records with the Register of Deeds that a new permit or authorization was ever issued. As such, this facility cannot be operated for the purposes of fill or disposal with approval of the
Division of Waste Management. However, the site does have a Yard Waste Notification (YWN), but the last renewal was submitted on 5/28/2020. The landowner shall submit this form to the Department by June 1st of each year. If the landowner wishes to close the YWN, then all waste should be removed and a last inspection will be needed to confirm.
3. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished
product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for anyone dealing with the YWN.
4. The last renewal submitted in 2020, states that the waste onsite, “Natural Decomposition of parts of trees.” After viewing the site, its apparent a considerable amount of waste has not been removed from the site in sometime. It
is not windrowed or being ground for mulch. This is essentially disposal and this area is not approved for such activity. Yard Waste Notifications (YWN) are for staging and processing. All yard waste must be processed or removed and disposed at a site for that waste type or used to reclaim side slopes of a mine. YW cannot be given out to public unless meets conditions of 15A NCAC 13B .1406.

5. Some waste is along entrance roadway that was going to be firewood but has not been utilized and has been breaking down. Most of the waste is in the NE corner of the property. There is an elevation change that suggests
it was once a side slope for a mine, and this YW was being used on the side slope to block trespassing vehicles from going over the side.
6. At the time of the inspection on 8/25/2021, an undetermined quantity of wood shavings mixed with manure consistent with horse bedding, was observed in two areas pushed onto or into the wood waste. This site is not
approved for this waste type and the waste must be removed and disposed of properly. Contact the NCDEQ Division of Water Resources for guidance on the proper utilization of this waste type, (910) 433 – 3300.

7. Given the situation with the waste onsite, Mr. Conard needs to remove the unapproved wastes from the Yard Waste and stop accepting other unapproved wastes immediately.
Then Mr. Conard has three options with this site: a. The first would be to operate it properly as a 2-acre Yard Waste Notification. If that’s the case, then the YW should be pulled back out of the buffers, in most NW area of stored waste, and windrowed in the open are in front of where it now sits, as long as it is under the 6,000 cubic yard limit. A renewal form should be submitted immediately as well.
b. Second option would be to haul all the waste away to a landfill for that waste type and close the site after providing proper disposal documentation and a final inspection. c. The third option would be to permit this site for other processes and/or volumes. Discussions between Mr. Conrad and Solid Waste Section permitting would need to take place for permitting options. Any unapproved waste discovered during removal or processing should be disposed of at a site for that waste type. Contact Ming Chao, Permitting Engineer – ming.chao@ncdenr.gov or (919) – 707 – 8251.
8. While onsite there was evidence of YW being burned in the past. Please note, the burning of solid waste is prohibited.
15A NCAC 13B .1406 (7) Safety Requirements. (a) Open burning of solid waste shall be prohibited. (b) Equipment shall be provided to control accidental fires and arrangements made with the local fire protection agency to provide fire-fighting services when needed. (c) Personnel training shall be provided to ensure that all employees are trained in site specific safety, remedial, and corrective action procedures. (8) Reporting Fires. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident.

9. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff within 30 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in Compliance Actions. If the owner doesn’t process/remove all the current waste at this facility in a timely manner, then the site should be compliant with all of the 15A NCAC 13B .1400 rules for Small Type 1 Compost facilities (Yard Waste Notifications).
