North Carolina Department of Environmental Quality 610 East Center Avenue, Suite 301 Mooreville, North Carolina 28115 Re: 532 Jefferson Drive Charlotte, North Carolina Parcel No. 18709209 Incident No. 36906 Project No. 892-01 Ms. Beverly: Harmon Environmental, PA has been retained by Mr. Oleg Biller, the current owner of the referenced property. In 2011, a 550-gallon heating oil underground storage tank (UST) and 38.11 tons of petroleum -impacted soil was removed from the property. Analytical results associated with the confirmation soil samples indicated petroleum constituents remained in the on -site soil at concentrations exceeding the respective Soil to Groundwater Standards established by the North Carolina Department of Environmental Quality (NCDEQ). As a result of these findings, the NCDEQ issued a Notice of Regulatory Requirements letter requiring a Limited Site Assessment (LSA) be conducted at the site. On August 23, 2021 Harmon Environmental, PA submitted a Limited Site Assessment Report summarizing the methods and results associated with the requested investigation. As indicated in the LSA report, petroleum constituents were detected in the groundwater sample collected from the on -site monitor well at concentrations exceeding the Groundwater Quality Standards established in North Carolina Administrative Code, Title 15A, Subchapter 2L (15A NCAC 2L). A receptor survey was conducted as part of the LSA documenting seven water supply wells within 1,000 feet of the former UST basin. Based on the proximity of the neighboring water supply wells, the NCDEQ ranked the site as "High Risk". Since the completion of the LSA, the NCDEQ Guidance Documents have been modified resulting in the receptor survey radius being reduced from 1,000 feet to 150 feet from the former UST basin. On June 3, 2015, the property was acquired by Red Fox Residential LLC. The on -site structure was apparently razed by Red Fox Residential, LLA and a new residence was constructed on the site. On March 13, 2017, the property was acquired by Oleg and Irina Biller. Recently the Billers decided to list the property for sale. During this process, they discovered the UST history associated with the site. Based on changes in the UST program since the LSA was conducted, only two water supply wells documented by the LSA remain within the search radius. Ms. Trudy Beverly, P.G. September 10, 2021 Page 2 One being located at Tillman residence at 600 Jefferson Drive, the second being at the Albano residence at 524 Jefferson Drive. In 2011, both these neighbors responded to the Receptor Survey indicating their residence were connected to municipal water service, but historic out -of -service well remained in their yards. On September 8, 2021 Mr. Biller retained Harmon Environmental, PA to visit these two residence and attempt to locate the water supply wells. If located, Harmon Environmental, PA was directed to coordinate with a North Carolina Certified Well Driller to abandon each well in accordance with North Carolina Administrate Code, Title 15A, Subchapter 2C (15A NCAC 2C). On September 9, 2021, Harmon Environmental, PA visited the properties at 600 Jefferson Drive and 524 Jefferson Drive. During this visit, no water supply wells were observed at either location. In conjunction with this visit, Harmon Environmental, PA personnel interviewed both Mr. Albano the owner of 524 Jefferson Drive and Ms. Tillman the current owner of 600 Jefferson Drive to determine if they were aware of water supply wells on their property. Both owners indicated that they were not aware of wells being present on their property. Based on these findings, Harmon Environmental, PA recommends the NCDEQ reduce the risk ranking of the property from "High Risk" to "Low Risk" and allow the Billers to achieve No Further Action Status for Incident No. 36906 by apply a Notice of Residual Petroleum (NORP) to the property. As indicated in this letter based on both a visual inspection and interviews with the land owners no water supply wells were documented on either of these properties. Based on these findings, we request the NCDEQ consider reducing the ranking of the referenced incident "Low Risk" and allow closure of this incident with a Notice of Residual Petroleum.
