Paragraph 25 of the Consent Order states: “For good cause shown, Chemours may submit to DEQ one or more requests for extensions of up [to] three months each for any deadline specified in paragraphs 19-24.” By letter dated August 21, 2020, pursuant to Paragraph 25 of the Consent Order, Chemours submitted to DEQ a request for an extension to meet the Paragraph 19 requirements in Bladen and Cumberland Counties west of the Cape Fear River. By letter dated August 25, 2020, DEQ granted an extension to September 25, 2020, and requested additional information with respect to the potential availability and provision of public water in Bladen and Cumberland Counties. By letter dated September 4, 2020, Chemours provided the requested information and requested an additional extension to meet the Paragraph 19 requirements in Bladen and Cumberland Counties west of the Cape Fear River. By letter dated September 25, 2020, DEQ granted an extension to December 15, 2020. As noted in those letters, DEQ has concurred with the potential feasibility of public water connections for certain parties in Bladen County west of the Cape Fear River and is continuing to evaluate feasibility for Cumberland County west of the Cape Fear River. Chemours, meanwhile, has continued discussions with both Bladen and Cumberland Counties regarding the potential expansions of their public water systems to supply affected parties west of the Cape Fear River, and those discussions remain ongoing. Accordingly, pursuant to Paragraph 25 of the Consent Order, Chemours requests a further extension of 3 months, to March 15, 2021, to meet the Paragraph 19 requirements in Bladen and Cumberland Counties west of the Cape Fear River. Further, as Chemours has discussed with DEQ and as noted in previous letters, the potential infrastructure expansions of the Bladen and Cumberland County public water systems may take multiple years to complete, necessitating 2 multiple additional 3 month extensions under the Consent Order. Chemours will continue to keep DEQ informed throughout this process. Because of the time sensitivity of this request, and because it is interim in nature, we ask for a prompt response.
