Dear Mr. Foster:
On September 17, 2007, the North Carolina Department of Environment and Natural
Resources (DENR) received the revised Passive Venting System Design Modifications prepared
on behalf of Hawkins Street Holdings, LLC for the above referenced property. The plan was
submitted in accordance with Notice of Brownfields Property Land Use Restriction Number 4.
Upon review of the material submitted, DENR finds the risk evaluation complete and approves
the passive vapor mitigation plan.

Be advised that this approval from the Brownfields Program does not waive any
applicable requirement to obtain any necessary permits, licenses or certifications for the above
listed activities nor does it waive any requirement to comply with applicable law for such
