Foster MACTEC Engineering and Consulting, Inc. 28001 Yorkmont Road, Suite 100 Charlotte, NC 28208 RCFOSTER@mactec.com Subject: Civil Site Drawing Review and Approval Sonoco Flexible Packaging Facility 2203 Hawkins Street Charlotte, Mecklenburg County Brownfields Project Number 09066-05-60 Dear Mr. Foster: On October 4, 2007, the North Carolina Department of Environment and Natural Resources (DENR) Brownfields Program received a request for civil site drawings review and approval to confirm the design was in accordance with the Notice of Brownfields Property (NBP) recorded on the above referenced property. This request was submitted by MACTEC Engineering and Consulting Inc. on behalf of Hawkins Street Holdings, LLC. The following areas were identified in the cover letter for specific approval: • Drawing L-4 (Site Plan), L-5 (Grading Plan) and other plans depict designs that involved soil disturbing as part of the proposed site development activities. Land Use Restriction Number 3 in the NBP required approval of work under the former building foundations for the Sonoco Flexible Packaging Building. The assessment, sampling, and removal activities for soil under the building foundation were completed in March 2007 and August 2007. No additional work is required at this time. • Drawing L-4 (Site Plan) depicts a proposed in-ground swimming pool at the property. Land Use Restriction Number 5 in the NBP prohibits the use of groundwater on the property and required precautions when exposed. Available site data indicates that groundwater should not be exposed during installation or use of the in-ground swimming pool. However, if groundwater is exposed, a health and safety plan should address how to handle the incident such as covering the area with soil or dewatering into drums for off-site disposal. The plan should also address worker exposure and precautions. Please submit this plan for review and approval. Mr. Foster October 21, 2007 Page 2 of 2 • Drawing L-5 (Grading Plan) illustrates the existing grade elevation and proposed finished floor elevation on the property. Land Use Restriction Number 6 in the NBP requires approval for site grading and elevation work. This work is approved for the civil drawings dated August 6, 2007. Once redevelopment is complete, property contours and elevations should not be changed without DENR notification except for mowing and pruning of above-ground vegetation. • Drawing L-4 (Site Plan) and Drawing L-6 (Required Planting Plan) and other misc. drawing with open spaces as it relates to being a passive park. Land Use Restriction Number 10 of the NBP states the property may not be used as a park except in areas where two feet of clean fill, or another cover approved in writing in advance by DENR. According to your civil drawings, two feet of fill will be installed in these passive park areas. DENR approves the drawings; please send documentation once the installation is complete. Note, the plat map is required to be updates to state “Recreation Approved” once redevelopment is complete. In addition, please note that Land Use Restriction Number 15 in the NBP requires the owner of any portion of the property where existing or later DENR-approved monitoring well is damaged shall be responsible for repair of any such wells to DENR’s written satisfaction and within a time period acceptable to DENR. Given the scope of your project, you may want to abandon all current site monitoring wells, set-up a meeting with DENR and the Responsible Party to discuss new monitoring well locations that work with your redevelopment plans. Access to the party conducting remediation or environmental assessment of the property is provided through Land Use Restriction Number 14. Upon review of the material submitted, DENR finds the civil drawings acceptable. Be advised that this approval from the Brownfields Program does not waive any applicable requirement to obtain any necessary permits, licenses or certifications for the above listed activities nor does it waive any requirement to comply with applicable law for such activities.
