Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The two currently permitted storage tanks appear structurally sound. It appears that septage is being transferred to/from the facility in a safe and sanitary manner. No spills or leaks noted - currently the two tanks sound empty. No apparent vectors or odors noted. The approved setbacks are being met. Some excess vegetation around the tanks should be cut soon to maintain the required 5 foot cleared radius (free of excess vegetation or debris) around the tanks. The required signs are posted and the access road is adequate at this time. 2. No change in the area designated for the proposed dewatering facility except some foundation work has occurred (probably for the 2 future frac tanks). No septage activity has occurred in this area – all tanks & boxes are empty as required as the new permit modification has not been issued yet. The required 200 feet distance (for a high capacity site) will be maintained. Items needed for the permit modification are – a new SDTF application, final site drawings with a PE stamp, a signed operation manual explaining the process, a leak test (signed by a PE) for any buried or partially buried tanks or lines, and a disposal authorization (for solids going to a landfill or compost site)) – the effluent will be going on the disposal fields at this site. Treatment logs will be required when the permit modification is issued and authorization forms for any firm other than Belton’s Septic Tank Service that may utilize the facility. A pre-operational inspection will be required (when the treatment facility is completed) prior to the new permit being issued.
