PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 13 ADDITIONAL COMMENTS 1. Section staff met with David Lambert and SME’s Sam Watts to conduct an inspection of CDLF new cell. Operations plan, annual reports certifications, vendor contracts, previous inspection reports, waste screenings, daily checklist and load checks for facilities onsite were also reviewed. Section staff walked cell and surrounding. 2. Facility roads were in good condition. However, dust was an issue and should be addressed. Rocking of the access roads will assist a small amount but water truck or other means of dust prevention should be determined. In an email update on 9/10/2021, Mr. Lambert informed Mr. Powell that gravel was being delivered the same day for the road to maintain the road and assist dust control. Mr. Lambert has also contacted the Town of Aberdeen and they are working something out to get bulk water from them for a water truck. They also have a vehicle that they can use (usually for de-icing roads in town) but they may can borrow and use until another plan is in place. Mr. Lambert also spoke to the Co-Chairman of the Moore County Fire Commission (Fire Chiefs from Southern Pines and Whispering Pines) and invited them to do training exercises at the landfill. Good job, please follow through. 3. Future barrow pit area was visited, and is currently ready for excavation with trees and roots removed. A mulch berm around certain areas of the barrow area was also discussed, later via email, documents were forwarded to the Section to review. While we acknowledge that DEMLR included the proposed berm in your E&SC approval, even they note that if constructed solely out of mulch/compost, it will degrade over time likely resulting in the need for repair or reconstruction. That approval does not relieve the County of the need to comply with Solid Waste rules if applicable to the materials being utilized. As mulch or compost decomposes, it may leach, create odors, spontaneously combust, etc., therefore the Section would not be inclined to allow such construction utilizing 100% mulch (especially newer ground material), but would consider the use of older, already decomposed material and/or screened topsoil. Mulch could be used as temporary cover material up to 6” in depth on top of the berm to assist with establishment of stabilizing groundcover. Further, we must ensure that the use of waste materials managed at the facility are not used as fill or disposal, in conflict with other solid waste rules. Please evaluate which materials (topsoil, etc.) and estimated volumes are available onsite for these purposes, and submit modifications as needed as part of your proposal. At the time of this inspection, the CDLF working face appeared to be close to maximum size of one half acre or less. Landfill Supervisor and Mr. Lambert discussed the size of working face with Section staff about covering more and not letting it increase any further. At the time of this inspection, waste was being dumped at the top of the landfill and then pushed down slope in Cell 5. The working face shall be maintained in accordance with the rules 15A NCAC 13B .0542 (f) and .0542 (g). Visible from the access road, as you drive around the CDLF, are some rills and eroded areas, probably due to recent rain. Stay on top of these issues or may have exposed waste, seeps or worse issues which are harder to bring back into compliance. Erosion on slopes shall be repaired before seeding and establishing vegetation. Concrete was visible on North side slope of cell, please remove and dispose properly. They usually indicate an area that stays wet. Since this is an incline and not a low area that holds water, a seep may be present. That would provide moisture and nutrients. Please address. 7. Cell 6 Expansion is basically finished in construction, although there are some repairs needed. Be sure and check the Pre Operational Conditions in your permit and communicate with Section Permitting to ensure all requirements have been satisfied before proceeding. Erosion rills were present, storm water ponds had vegetation growing in them along with much sediment. Return all structures to design, plan and operational specifications. Discussion onsite was that the county would not move into new cell until approximately 8 months. Vegetating the cell is needed to keep further erosion and damage from occurring to new cell, as well as sediment filling up storm water ponds again. Outfalls for the storm water ponds, also sampling points, were overgrown and should be mowed and maintained. Erosion rills visible in photos below of western slope of cell 5. Currently there is still some older mulched waste left long western edge, just barely outside EOW for the new cell. Mr. Lambert indicated they left this to use with soil as 50/50 ADC when new cell starts. This material was placed in this location originally as a temporary storage, not permanent. It should be utilized and not left in place. 9. New cell rock roadway is constructed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 11 of 13 10. New Edge of Waste (EOW) markers are going to be installed around new cell. Mr. Lambert had them with him during inspection. Be sure to replace any others on the other facilities onsite. 11. White goods waste area still being staged outdoors and not on a pad. One big comingled pile with some separation of newer units that have not had CFC’s removed in back under edge of shed. It was recommended that a concrete pad be constructed or the site graded properly, and the waste be sorted and kept orderly, separating by items ready for Freon to be removed and the items that already had the Freon removed. A 300-foot by 300-foot gravel pad was going to be built for this area to sort and separate as well. A method of marking the items with gas removed should be implemented as well. Permit Attachment 3 Part VII - 11. The unit is permitted to receive white goods as defined in NCGS Article 9, Chapter 130A-290(44) and scrap metal. The permittee must manage the white goods in accordance with the approved operating plan and any applicable statutes and rules. 12. The permittee must provide for the proper removal of chlorofluorocarbon refrigerants (Freon) from white goods. The permittee must separately store the white goods containing Freon from the non-Freon white goods and scrap metal at this area. The area adjacent to the glass storage and white goods has all the older yard waste piles removed. This area is being built up with soil. Please continue to reclaim this area. 13. Corrective measures are necessary at this site based on observations during inspection. Continue to work on the issues mentioned onsite and this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff to follow up on these corrective actions. Failure to meet the conditions for compliance may result in additional Compliance Actions. Also, continue to communicate with the Section and updating David Powell.
