PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff met with David Lambert and SME’s Sam Watts to conduct an inspection of T and P facility while inspecting CDLF new cell. 2. Facility roads were in good condition. However, dust was an issue and should be addressed. Rocking of the access roads will assist a small amount but water truck or other means of dust prevention should be determined. In an email update on 9/10/2021, Mr. Lambert informed Mr. Powell that gravel was being delivered the same day for the road to maintain the road and assist dust control. Mr. Lambert has also contacted the Town of Aberdeen and they are working something out to get bulk water from them for a water truck. They also have a vehicle that they can use (usually for de-icing roads in town) but they may can borrow and use until another plan is in place. Mr. Lambert also spoke to the Co-Chairman of the Moore County Fire Commission (Fire Chiefs from Southern Pines and Whispering Pines) and invited them to do training exercises at the landfill. Good job, please follow through. 3. Yard waste material didn’t have any visible unapproved waste during inspection. Good job. Be sure to keep all weather road access and separation of windrows for firefighting and containment should a fire occur. Some windrows were touching each other and had no separation. Storage pile/windrows of all types must be limited to 30 feet high and 50 feet wide based on the T and P permit requirements. Engineered woods waste must be kept separate from other piles and cannot be distributed for compositing but may be sent as boiler fuel. The areas for staging and processing the yard waste/trash should be built up to shed storm water without causing erosion and to keep leachate from forming. It should also keep waste from being in water after rain etc. Please continue to work on removing the older material, addressing in low spots of the staging area and grading appropriately. Some of this has been done, but much more is needed. Permit Attachment 3, Part IV. (12) - Surface water must be diverted from all operational and storage areas to prevent standing water in and around storage piles. Any leachate generated at the facility must be managed to prevent contamination of groundwater and surface water. Just remember, moving forward this material is supposed to be moving out, not just coming in and staying. Once Moore County catches up with removing old material, compliance in this area will be maintained easier, it is also being mixed with soil and being used as alternative cover on CDLF. Permit Attachment 3, Part IV. (10) - At least 75% of the material onsite must be removed from the site annually. Operations plan, annual reports certifications, vendor contracts, previous inspection reports, waste screenings, daily checklist and load checks for facilities onsite were also reviewed. 8. Corrective measures are necessary at this site based on observations during this inspection. Many improvements have been made and considerable progress in responding to the concerns inspection staff have mentioned in reports over the years and especially recent reports. Please continue with the momentum you have created on addressing problems at this site, and your others, as they arise in the future.
