PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: Resolved: Non-conforming waste was removed. OBSERVED VIOLATIONS: 15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS. 15A NCAC 13B .0564 SITING CRITERIA FOR LCIDLFS The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 - This Notified Land Clearing and Inert Debris Site (LCID - N0321) has a Yard Waste Notified Site (YWN 27-002) and a Temporary Disaster Debris Site (DS-27-013) located on same tract of land. 02 - The LCID Site has an Air Curtain Burner (ACB) to dispose of the waste. It’s evident that the ACB has not been used to reduce the vegetative waste on this facility since the last inspection on 12/29/2020. This facility may need to start managing as a LCID LANDFILL as stated in the 15A NCAC 13B .0566 OPERATIONAL REQUIREMENTS FOR LCIDLFS instead of using the ACB (seems to be obsolete/in-operable) to keep up with the large volume of incoming waste. Site will have to be permitted by 2026. See pdf attached to email with this report. 03 - Roads are constructed of all-weather materials (gravel & sand) and is being maintained in good condition. 04 - Entrance road has locking cable/chain and signage. Need to add additional information to signage. 05 - 15A NCAC 13B .0566 OPERATIONAL REQUIREMENTS FOR LCIDLFS: (14) A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site. See pdf attached to email with this report. 06 - 15A NCAC 13B .0564 SITING CRITERIA FOR LCIDLFS: (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. See pdf attached to email with this report. 07 - Notes from last inspection, (12/29/2020): (1) The LCID waste piles are getting fairly large. Need to start removing through the use of the ACB and/or grinding as mulch to remove from this site. (2) As for the Inert Debris (Concrete), you are stockpiling this material too long. No grinding has taken place now for several years. (3) You will be able to reuse or sell this Inert Debris. (4) Need to put setback markers up. 08 - No efforts have been made since the 12/29/2020 inspection to address the above issues. 09 - Need to put boundary markers up (setback markers) as was stated in the 6/19/2020 and the 12/29/2020 inspection reports to be able to define the 3 sites listed above in #1 of this inspection report. Now the boundaries of The Yard Waste Site, Land Clearing & Inert Debris Site & Temporary Disaster Debris Site cannot be defined due to the volume of Vegetative Waste is one long pile that covers ALL of the areas. The DS-27-013 site will not be able to be Activated in the event of a Declared Disaster Event due to the issues mentioned above. 10 - There was also vegetative waste noted that was outside of the footprint of this facility or any of the other facilities. This MUST be removed and taken to an approved site. 11 - ALL of the above observed violation MUST be brought back in to compliance within 30 days of receipt of this report. In the event this is not completed a Notice of Violation will be issued to this facility. 12 - Corrective actions are needed due to the issues and observed violation listed on this inspection report. 13 - Digital pictures were taken during this inspection with some attached to this inspection report. Rainwater in path, not leachate. • This area is not allowed (permitted) to receive and store waste. Mr. Newbern was going to fill in a pond (located behind these piles) with this type of un-approved waste until discussed several years ago.
